    Mover is absolutely right. If he picked up the incomplete order and brought it to the Plantiff he would have to answer for why it’s incomplete.

      You’re absolutely right then the store could’ve blamed the missing pieces on the mover. He did the right thing by leaving The incomplete furniture set.

      Except he’s absolutely wrong. All they’d have to do is get it in writing somethings are missing. 🙄 I had movers bring stuff to me, a table and chairs… except they also were supposed to bring a couch. They didn’t, so I didn’t sign the delivery for all those items. They wrote that it wasn’t delivered and then I signed and got the couch later.
      It’s not much different here.

      I'm a commercial driver. Doesn't always happen that way. Failure to sign for a delivery can avoid the entire delivery.
      Drivers do NOT have to accept a short load. Because once it's in your possession you are responsible for it, whatever is on the manifest you owe.
      I would have asked for confirmation from both parties that an amendment was made and I'd expect a piece of paper saying so. That driver knows what's up. Smart dude.

    All sales are final, a good question, why are 5 pieces missing from a sold order ?
    As a delivery driver previously, I would not pick up a incomplete list unless both parties are aware of the situation and agree for the partial pick of consigned items.

      These sales persons are devious, they let the buyer select the things ,paid for them, then at the bottom of the receipt which is the last transaction, they have printed that " all sales are final!" I guess she didn't say that to him before payment. If I know the terms and conditions of a product before I pay for it/them and I don't agree ,I am not buying them/ it

      Contracts / warranties/ refund policies exist for a reason and doesn’t have feelings no matter if you’re rich or poor. Don’t complain, read the receipts and if you’re too busy or ignorant to abide by stores rules, that’s on you. Get over it.

    I feel like the mover is right… you take all of it or none of it. Just like when someone accepts store credit or money as an exchange, then the matter is closed bc they accepted the deal. JJ talks about this often.

    When he received his sales receipt, which is after payment, there is the all sales final notice, at the bottom. Should that not be disclosed prior to payment, not afterwards?

      It’s up to the buyer to ask these questions. If you’ve lived longer than 21 years of life and have often gone shopping at stores or even online, it’s impossible for you to not know “refund policies” are. And if you’re not, than ask questions before buying. It’s that simple.

    One of the few times jj asked for a receipt and actually got one.
    So many people give her bank statements or say they don't have it.
    That receipt seems to be his very downfall as well.

      I disagree, a receipt is given after payment is made. A contract is agreed before payment is made. He should be told that all sale is final before he decides to make payment and not after he has made payment. JJ got it wrong this time.

You agree to the "contract" the moment that you hand over money, and receive your receipt. Especially from any "second hand" stores...Thrift stores, or Consignment (this case) stores....LOL. But to just rely on a receipt given after a payment has been made as evidence of a binding contract is just ludicrous. What if the receipt stated that he could only own the furniture for a month? Should he be bound by that?

      @@iykeharrison9161 Usually (99.99%) of the time, if it's on the receipt, they have the signs all over the place as well. ......and as for that .01%??? They get a sign up lickidy split, soon enough, if something like this happens....LOL!!!!!
      Try going into a "second hand store", and NOT see a sign. Or many signs, that says [ALL SALES ARE FINAL]...You'll be hard pressed trying to find one.....LOL !!!!!

      Exactly. I was looking for a comment like this. Him picking up and signing for incomplete goods could potentially results in the liability falling back on him if for whatever reason, one of the parties claims that all items were picked up instead of the partial amount.
      It's obvious that there is room for human error especially concerning all of the disputes and the fact that the pickup wasn't arranged until months later.
      Like going to a car dealership, if the accessories that are supposed to come with the car happen to be incomplete, there's a separate document that gets signed stating which item(s) are missing and what is being done about it

      If only there was a thing we could write on and a thing we could write with, and a way for people to sign an agreement on the picked up items. Oh well, he’s totally right since no such things exist in life. We are very primitive. People really watch judge shows and think you can’t get the store to sign that they only gave 9 items? He just has to do nothing?

      You've never had a shipping/receiving job, have you?
      If the manifest is incorrect, you go over it with your supplier/receiver/customer before anything is loaded/unloaded and you make the appropriate alterations to the packing slip stating what's missing, what's damaged, what's this, what's that-- then you both sign and date and you both keep a copy for records.
      Same with the bill of lading. If it's not correct upon pick up, corrections must be made and *all parties* sign and date to signify that they are aware and accept these changes.

      I agree with him too. You don't send uber eats driver to pick up your combo with fries and a drink and because the fries aren't ready, or they're out of them he just delivers the nuggets and the drink.

    A customer doesn't get the receipt or contract as JJ calls it until AFTER you purchased items. They should be told BEFORE they buy that all sales are final!!! After you give them money then they're giving you the "contract" which isn't right or fair, imo.

      IT IS NOT A CONTRACT.
      No matter how you say it, or put it, Judge Judy is WRONG 100% by saying that is a contract.

      You buy a chocolate bar from me, on the receipt it says at the bottom 'buyer agrees to buy 100 chocolate bars a week from me'.
      Do you now have an obligation to buy 100 bars a week from me now? Of course not. A contract needs consideration from both sides before reaching agreement. A receipt is a receipt, a contract is a contract.
      So, no, it is not legally a contract.

    That's why at my previous job we had the return policy posted, we explained the policy upon purchase, and had them sign the receipt. I had a customer try to pull this same garbage after spending 2 hours with him, he even applied for financing, and still tried it afterward.

      The plaintiff is a fool to finally expect all 14 items he paid for, but there is only 9. He lost the case of the contentious sale, but, he was sold 14 items, now there is only 9 for pick up. The furniture store does not have the right to do that, resell paid for merchandise.

    Bet the store sold the other items during the time frame of the cc company having given the money back and then didn’t have them when it was reversed, but why would they fight it? For people thinking the delivery guy was “right”, just write a note and have them sign that items marked/listed we’re not available for pickup. It’s not hard.

      I'm from a place where people care about a happy customer just as much as they care about the sale. Nothing wrong with informing your customer or asking if they're sure about their purchase, because all sales are final. I've been told that plenty of times prior to my purchase. Word of mouth business is the best way to get more customers. Why not ensure for yourself, and for the customer, you have happy customers, so you can get more customers through them? And besides, it's just courteous and the right thing to do. Especially in sales, you can tell if a customer is unsure. Where you from?

    as a person who does doordash on the side, i would never pick up half of someone's food, how much less half of a furniture order. also, "all sales final" doesn't mean anything in america, especially if that isn't expressly stated on the products or discussed beforehand. he clearly bought furniture that he found out was overpriced and changed his mind.

    The buyer is at a huge disadvantage because it was only shown to them post-payment. The "contract" that Judge Judy keeps harping about that is on the receipt should not be binding because the plaintiff or any buyer of that furniture would NOT have seen it until items were paid partially or in full. Money had already been exchanged.

      It is a contract when you decide to sign it before reading or decide to leave the store before reading and taking items.
      Either way you have enough time to read a receipt before you sign and enough time to read before you leave the store with the items. So again it’s an agreed contract

    I think it’s ridiculous that you are made aware that all sales are final after you’ve already bought items and it’s declared on the receipt. I know customers need to do their due diligence but stores should also have duty to make this aware to customers with every possible transaction beforehand.

    If the wording " All sales final" is only on the bottom of the receipt then you have already paid by then so how can it be a contract. Unless you are made aware of that clause before you commit I dont see that it is a valid " contract" You can't have a contract that only puts the conditions AFTER you have committed! I think JJ is wrong here.

      I used to work for a clothing store years ago and for our Final Clearance items, not only the signs say it but we tell customers before processing their payment. I’m sure there are signs at the front of the store, on the furniture themselves (like in the printed description and pricing), and the associate tell you before processing the payment

    Now Judy is being a little ridiculous. It does not matter if a receipt says all sales are final. If he was smart he would have brought a copy of the statute. However, as She still had the furniture in her possession, and consumer purchase LAW states no matter what the receipt says you have a Cooling-off term, the rule allows you to cancel a contract within a few days (usually three days) after signing it. As explained by the Federal Trade Commission (FTC), the federal cooling-off rules gives the consumer three days to cancel certain sales for a full refund. And as he had not yet picked up the furniture he had every right to cancel it. If he had taken it home that would be different. WAKE UP JUDY.
