  • If you’ve been faithfully following our Basics of Music Copyrights and Royalties video series, congratulations. You’ve earned your Disc Makers Bachelor’s Degree.
    This week I delve into Master’s Degree territory with a discussion on Neighboring Rights and SoundExchange, their collection society in the US.
    There’s good news and bad news for American artists: yes, some royalties are available, but you’re shut out of a huge chunk of royalties. Worst of all, those royalties are collected, but get redistributed to other artists.
    In this week’s video I discuss:
    -What are neighboring rights?
    -Who gets paid neighboring rights?
    -Why are US artists ineligible to receive a sizeable chunk of the neighboring rights royalties that have been collected?
    -What is SoundExchange, and which neighboring rights can they collect on your behalf?
    -How do you get your share?
    WARNING: You may feel cheated after watching this video.
    Now go out and get what’s yours.

    That now make sense, when registering with Sound Exchange they claimed Sound Cloud were already collecting royalties for the songs I registered.

    First off thank you for publishing that Sag _ Aftra musicians Fund list . I was on it. This.vid is full of great info. My question today is this. There are.bunch of youtube channels with my productions. up some with 647k views. How do i get paid for this? I never gave anyone permission to publish those records on CZcams! One such record is a vinyl 33 rpm song called YES YOU THRILL ME by LES.FEMMES.

    If the artist is signed to a major record label "Sony music, etc" then they do get their internacional neightboring right because they are afiliated to each one of them globally.

    Thanks Tony. Quick question: I was under the impression that radio pays your PRO for plays. I know you said in the previous video that this is done by the PRO making a "best guess" as to amounts paid and distributed. Is this considered a "royalty payment" by the radio industry? Again, thanks for the info and the education. I appreciate your time and effort on doing these. BTW: clean audio this time out - no repetitive "bulk erased tape" noise as in the last video.

    • @tonyvv
      @tonyvv Před 4 lety +1

      Yes, radio pays the songwriter/publisher a public performance royalty.

    So are neighboring royalties getting paid to foreign societies outside the US from terrestrial broadcasters, for the use of US sound recordings?
    And if so, why do those international societies still continue to collect royalties generated from US owned recordings, knowing that neighboring rights are not recognized by US Artists and Master Rights Owners?

    How do you collect that 5 % of the none featured artist? That was sent to the American federation of musicians? So I have to register with the American federation of musicians to collect those royalties too ?

    I signed up with Sound Exchange years ago but just recently back in March started submitting my catalog. it's a lot of work if you manage a large catalog but hopefully worth it. Anyway, I'm still waiting for them to approve my submissions. When approved, how many years back will they go to calculate how much I am owed? Thanks.

    Hello Tony, thank you for all this information. About the sound recording royalty, I’m not sure I understood correctly. Is it mandatory to go through a distributor to collect this royalty or can you register as a sound recording owner directly at SoundExchange and get the money from them directly? For example, what if your distributor of choice doesn’t have an agreement with the digital services, do you lose the money? Or what if you’d just prefer going directly to SoundExchange? Thank you

    • @tonyvv
      @tonyvv Před 4 lety

      You can go direct to SoundExchange. However, they pay part to the artist and part to the label, so you'll have to register as a label too.

    • @tonyvv
      @tonyvv Před 4 lety

      Depends on the royalties you want to collect. I’m not sure it’s possible with neighboring rights for US artists. You can check however with SongTrust. I saw they are building out their neighboring rights division.
