    I think now is the right time to install dashcams in our vehicle. I hope trucking companies do the same for their trucks.

      India is a country where general people don't know the meaning of accident. If a big vehicle fatally injured someone, automatically its driver's life is in danger. Mob would gather and take law in their hands. Dashcam would not save them

    Very neutral reporting brother. You shared both sides of the story. I think installing cameras in front of every truck should be made mandatory which could be checked if some accident takes place. Govt. could provide funds or subsidies to achieve this and it will benefit all parties.

    Hello,
    I like your statement, " They don't receive the respect they deserve, they frequently face harassment."
    I myself is a truck driver in Canada and drive truck to USA. Hence, I can feel their pain.
    Here in Canada and USA, if you have a camera installed, your insurance will be lower and if you don't have it, one's insurance will be significantly higher. Hence, most of the companies have a camera installed and it is mandatory to have 10 hours of sleep so that the driver is not tired and drowsy. The main reason for the accidents is not having proper sleep and proper breaks in between their shifts due to drivers facing health issues related to kidneys, eyes, back pain, etc.
    I request everyone to respect every truck, rickshaw, taxi, bus drivers, they drive alone, they have no one to talk, they dont see their families for 2-3 weeks which causes them stress and depression, due to which they have mental issues as well. We receive our food on the table due to truckers they deliver to our nearby stores.

      They get harrasment from traffic police. There is an issue in Chennai port, to enter the Port, Truck driver have to pay 100 rupees to collection agents arranged by Chennai Traffic Police. If a driver don't pay, he will have to wait for almost a week without food, water, toilet facilities in scorching sun and rain.

    Once as I was driving my car and was taking left turn after turning on the indicator. One rash motorcyclist tried to overtake me from the left side and collided against my car and damaged the left front door. Inspite of placing all these facts before the inspector of traffic police station, the SHO booked me for rash driving! In the court I paid Rs.2000 fine for closing the case.
    I have also seen truckers routinely run away after causing an accident. They abandon the truck. There is need to protect the victims.

    Dash cam should be made mandatory by law.. atleast in fleet vehicles or commercial category trucks/vehicle but above point by narator can't be made to not implement this law.. if this is the case than hit n run should be legal & there should be no criminal/nyay laws because anyways investigation is always against defendant

    Yes that's true truck drivers maintain thier lanes....its often the car owners who drive thier cars like they own the road and no laws can touch them. Also the bus drivers speed thier vehicles like f1 cars even they call themselves "expirenced drivers" but they often cause a lot of accidents

    You are just giving one view point . My uncle died due to negligence of a truck driver. What about the families who lose their loved ones, they don’t have children? Any accident that happens needs to be reported and how the drivers should make their case to avoid injustice to both sides should be taught or written by government. Like taking pictures of the scene, providing legal support which ever party needs it and tighten the agencies providing the drivers license. Education about drink driving is a must

      You're responding emotionally. He said nothing about not holding them accountable. He said that they need protection against false accusations and extortion attempts (prosecuting unfairly just for monetary gain) Your uncle dying as a result of negligence has nothing to do with families falsely going after truck drivers for a payout when those drivers were not at fault.

We have had 5 or 6 cases this past year where the 4 wheeler driver said our guys caused the accident or said we hit them and drove off. Our cameras proved otherwise. Lawyers advertise on TV that if someone is involved in an accident with a big truck, call them. It's a lottery ticket for people.

    But there is another point na ? Either who was in the mistake one should not hit and "run" na ?? If they didnt run and if they inform to ambulance or police there is a possibility of saving a life . And one more question. If they hit and didn't run means will they face the same punishment??

    Isn't there a clause in the new law which says this fine and imprisonment term is applicable only when "if the driver flees"? What if the driver helps the victim? The fine or imprisonment isn't applicable?

      Yes it is mentioned that driver will be punished only if they flee. If they stop to help or simply surrender to police, they will not face issue.

      They flee to protect themselves from being lynched by mobs who have no clue what happened but would always blame the bigger vehicle. Sadly, that's how majority of people think in our country- bigger the vehicle, guiltier it must be. Indian mob is the most brainless and dangerous in the world.

      It's likely that they will always flee to save their own life. Usually victim of truck accident dies, when a driver kills a person the driver will never remain there to face public. Public doesn't give justice to any one court does. If the victim dies then the driver should flee then police and court will punish the driver as per legal basis

      There is no such clause in the law. The law only says that any driver may face upto 5 years of imprisonment for death due to rash and negligent driving. But if the driver after causing such death doesn't inform police or a magistrate then he may face upto 10 years of imprisonment.

    There are huge number of cases where truck drivers are found drunk when the accident happens. This step is taken in good cause. Anything good is always criticised. At least with the fear of punishment they will be vigil now

    There are some people in the comments speaking about dashcams and I agree with them. It should actually be made compulsory for the owners of these vehicles (2/3/4 or more wheeler) to install one in their vehicle. It will not only make roads safer but also give a huge employment option too as many companies will start producing them. A win-win situation for both the government and the public. Hope the government takes this as a suggestion.

    But the number of accidents because of rash driving by heavy vehicle driver is also not less. In fact greater number of accidents occur because of rash driving by heavy vehicle most of the deaths occur in those kind of accidents only.

    Indian state should mandate ( and fund ) dashcam cameras on every commercial vehicle.
    The intent of the law is correct but it could be used against the trucks ( by small vehicles and police administration) .
    The intent of the law should be to avoid the fleeing of commercial drivers in case of accidents , dashcams first and trianing of drivers to take the victim to hospitals should be the way forward .

    True,
    Dash camera is necessary.
    Two years ago, in Kerala, a NP truck was taken into custody for death of a biker. A week later a Car dashcam video of same accident got viral showing that KeralaSRTC bus driver intentionally sandwiched the biker between the bus and truck causing the biker fall under the truck.
    After the video, the bus driver was arrested and given bail by police itself. Recent news is that driver has been dismissed from government job.

    Many Indian truck drivers work for grueling stretches, often exceeding 18 hours a day. Continuous driving periods of 30-36 hours are not uncommon. This extreme fatigue is a major contributing factor to the high accident rate on Indian roads. Leaving such a strenuous job is also difficult, as there's often a large pool of readily available replacements willing to take on the burden.
    And Government will never force companies to reduce working hours because it will increase the cost of transported goods.

    I get why they went on a National wide strike. But i think insted of rectifying the law as the drivers said government should make dash cams mandatory for large truks and buses, as most of the vehicles are not own by truck drivers their companies will pay for them.
    Increasing punishment for hit and run is a good thing to do ,at least for me. My friend was a victim of hit and run. He was thrown into bushes beside the Highway at night and the place was a bit away from town so no one was around at that time and no lights. We found him the next day. Doctor said if the driver had call an ambulance he would be alive.If the punishments are strict at least some of them will call for help out of fear for punishment .

    If the case is manipulated to go against the truck driver, wouldn't that be a flaw in the legal and investigative process? Maybe they should also add tort reform to the law. Meaning that you can't bring a frivolous lawsuit when it hasn't been proven criminally that the driver was responsible.

    I have few points to make
    1. The punishment for hit and run cases must be much more stringent because it's your duty to atleast inform tge authorities regarding any mishappening. Also If authorities are duely informed then there should be some relief for the person involved.
    2. Having dash cams on vehicles should be mandatory for all vehicle manufacturers.
    3. The most important observation i have is that the lack of serious debates in the parliament and lack of a strong insightful opposition is forcing the general public to take the matters to the roads and hence huge baseless protests have become common, disrupting the economy of the nation.

    This law seem to be useful to reduce Hit and run cases in India,
    But on other hand , I think that this law is not pass keeping the driver situation in mind since most of unemployed or aggressive people of try
    to find a way to harm or poor people of India which also include these truck driver who work 8-10 hrs in a day to have 40000 income in a month
    and let assume a driver stop after the accident then in most case these aggressive people try to kill him without knowing whose mistake was that.
    And at last tell me which driver have 10 lakh for paying that fine
    Government should know that these driver are driving in India not in canada like palce

    The problem are not the laws but enforcement and trained policemen(besides UT's, is a state subject). Hence why the evidence act has also been amended to encourage proper investigation. Overall the laws are fair & justified if you actually read them in TOTAL & in CONTEXT! NONE OF THE LAWS are specific for large vehicle drivers so the fact that they are the ones "worried" smells fishy! Indian traffic and drivers are probably the worst in the world, its noisy, reckless, anarchic and very often FATAL, if India wishes to become a modern developed country, she ought to sort this chaos out immediately!

    No one is talking about mob beating of driver if they cause little damage. Those people should also be changed. Police and mob both are against drivers, including normal family cars.
    This law somehow feels like it will be misused, even if intentions are good.

      What are you talking about? This rule is for all drivers irrespective of what vehicles they drive. It will even be applicable to bikers.

    All I can understand from these protests is that these truck drivers will continue to drive recklessly purposefully and they dont want to just get away with it.
    Govt should make dual dash cams compulsory for all, one facing the cabin with driver in it and one on road, if possible the data of the speedometer should be recorded with date and time too.
    And stick with this law.
    India will never even be a decent country to live in, 90+% population here wants everything for free, dont want ro follow any law and just cry about justice. And good only in doing riots for self interest.

    I think these laws are not just for commercial heavy vehicle drivers but for all (bike to truck and all that types of vehicle drivers that falls in between ) which is till now has not been highlighted by mainstream news media !
    problem with these two bills ( rash/negligent driving and hit n run bills ) are how to prove your innocence ( no camera on motorbikes and large nos of vehicles and large part of roads donot have cctv coverage ). long jail term: 10 years hit n run . these is too long !
    no bail provisions right from police station but from court that means spend time in jail . why no rewards like reduced sentence terms and fine if one brings the accident met injured person to hospital ? (stick and carrot policy)
    how to contact police when you are on run after you met an accident in a new place as you are being chased by the mob on wheels : govt should have at least provided a national emergency phone number like 112 or 100 to file a report over the phone and those emergency call center guys should also give direction to driver to the nearest police station and also simultaneously send police vans to a designated spot on highway to intercept the driver who called and rescue them from the mob .
    why no 20 years non-bailable jail term for angry mob who most likely will beat the driver to death ?
    why no law till now on roadrage that is a frequent occurrence now ?
    and what is the guaranty that police will be neutral and not treat drivers as ATMs or will do forensic tests after accident to know why an accident happened : was it the driver's fault , was it due to bad road design or was it the other person's fault and was it because the road was not maintained properly i.e potholes !
