[D106] HIDING ASSETS DURING DIVORCE: IS IT LEGAL & THE PENALTIES - BY DIVORCE LAWYER SOUTH AFRICA

  • Are you thinking about a divorce? maybe you worried that your spouse will hide their assets from you. If your spouse is hiding assets from you, you will not get the proper divorce settlement that you actually deserve.
    When a couple gets divorced, all of the assets have to be considered. You may find that your spouse is actually hiding assets from you This is very concerning especially if you don’t know much about their assets.
    Here are some steps you can take today to prevent your spouse from hiding assets:
    o Make a list of all known assets in the marriage
    o Try and get copies of tax returns filed by your spouse in the last 3 years
    o Make a list of all income and expenses of your spouse
    o Get a copy of your spouse’s previous wills - that will usually contain a list of their assets
    o Check if your partner has any debit orders of their bank statement for life insurance or any kind of savings
    Also be on the lookout for these key signs that your spouse is starting to hide assets from you. These are:
    o Your spouse is become very defensive and secretive.
    o Another sneaky trick is if your spouse defers his salary and bonus from work by signing a new work contract. By doing this his income from work will be shown to be less, until the divorce is finalised. They then claim a small income which will mean less money for child support or maintenance.
    o Another way is if your spouse over inflates his expenses by claiming they now owe money to friends and relatives and has to pay them back.

    The big question is : - Ive noticed alot of women taking jobs without benefits. What happens if she has nothing to give the man, not a car, not a provident fund, NOTHING.? - but HE has a pension fund. Is that looked at? Does that fall away? - Can one person really walk away with benefits of the divorce and the other just left to dry? How does the man recoup from that? how is this legal?.

      It depends on the marital system that the couple got married in. In other words if it was in community of property then its 50/50 regardless

    Exspouse sent millions(from businesses and investment) over to his gf during divorce. Magistrate ordered him to reimburse 5million(confirmed still in gfs bank but depleting). His own bank account is 0, he has dissipated many assets and sold equipment etc. What can we do to get the money or enforce court order? How do we compell the gf to return the money to his account for writ of execution to apply?

    My Ex-Husband, refused to show up at the lawyer's appointment and hid from the sheriff to sign the divorce settlement, I heard he started to dispose some of the assets, , he withdrow all the pension funds , it's been more than 3 years, and am struggling with the kids, he married again, what should I do?

    My husband has been handling the finance the last 5 or 6 rears ever since he sold his company and I have recently become aware of the fact that my name is not on one single investment nor is it even on my car or our 2 houses and he says since we have a will and a trust it doesn't have to be .and I also found out he took 100k and invested it into a commercial building and I was shocked that he didn't mention this and I have since found out he did 100K three more times not mentioning it, now I have lost all trust in him , and I don't know what to think Since he sold his company he seems to think his is the only opinion that matters we have been married 45 yrs and are ready to retire ,children are grown . should I seek legal help

    I am in a process of divorce, my husband is the one who has been handling everything, now I just find out that he took money from our mortgage after he filed a divorce that was in 2018 when he filed a divorce and 2019 he went and take third bond now the mortgage bond is high and the house was bought 2004 when we were still boyfriend and girlfriend and I had his first born 2004 and 2005 we were married what can i do in this situation about him stealing the money from homeloan while we are in a divorce

      It looks like your husband is abusing his financial position over you. You can get an urgent court order stopping him from doing this.

    Why do they have to care about the asset. It literally doesn’t belong to you. Fr fr imma send John wick down to do the job. Fam she tryna rob u, it’s not ok

      It all depends whether you married in community of property and whether there is pension and if there are children during a divorce.
