      True. But in my experience, the EMT has the personal belongings when possible, hands it to ER staff, and they get info from personal belongings- or police.

    A trustee can steal the money so that's not a smart way to make the trustee a family member I know a guy who's uncle is stealing the house his Dad left for him. .Besides it causes fights in the family. When it com's to money, people can. become greedy.

    Hello. I am just now seeing this video. I think this will be good for me. I have been ill off and on so I am trying to make different types of arrangements. I have 2 sons and so far 2 grandchildren. I have no one in my family I can trust not even my own mother ( She 79 right now - Long Story that involves my DNA test). I would trust my oldest child instead of the youngest child. I am learning much with this video. I don't have much but I have been saving more since I am older and closer to retirement.       Shalom, I live in PA and I use Anderson for my personal businesses (WY LLCs) and also used them to help set up a trust and LLC for my parents in SC. Unless your personality, style of learning, and level of trust mandates you meet with someone in person, you should be fine working with Anderson via phone and email. I've never met anyone in person there.

    My 96 year old mother died recently and never had her house in her will due to she was afraid if she placed it in my alcoholic brothers name and he got into a serious accident she might loose the house. The other children all have our own homes and want the house that my brother lived in with our mom for 75 years to go to him. He is disabled so my sister got a signed & notarized paper saying our sister is in charge . Dopes down in Philadelphia City hall first gave her the wrong form, second trip gave her a different form for us to have notarized, third trip new & correct forms that we got notarized then on return trip told her to hire a !awyer. Every time she goes to center city it's a two hour round trip drive and $25 to 35 for parking. Amazing how many people that steal pay checks from city of Philadelphia have no clue how to do their job. We all thought that our mother put her house in my brothers name after our father died.

    Agree and you’re amazing as always. One thing though, if the LLC is a professional corporation, you probably should put your interest in the trust in the event your share is being sold to others in the professional practice. Heard of a doctor who didn’t and his practice went through probate. By the time estate was closed, the patients had already move on, practice was no longer valuable and other members lost interest in buying his membership interest.

    If you have some rental properties in one member Sole proprietorship LLC then do you just need to create assignment on that llc and say i am transferring 100% this llc interest into the living trust and on the living trust and you are done? if you do this is you don’t have to take each property out of existing LLC and prepare a separate deed for each properties and record those properties individually under the trust name? or you have absolutely take all properties out of llc and re-record them under the trust ?

    How about if a property of the grantor is under a contract to sell that says it's payable in a few years. Can that be put under a trust so that the trust can still keep collecting the balance so that it goes into the trust even when grantor already passed away?

Additionally, when dealing with online financial accounts, estate planning for digital assets protect income that your digital assets can generate such as royalty rights or revenues from an online business.

      You can use a living trust for your primary residence, but you would not be able to have the anonymity. We generally like land trusts better for rental properties and a primary residence for clients that want to be as anonymous as possible.

    So will it still be better to have a living trust if all you actually have is tangible personal property? No house, car, real estate etc.

    I have two kids who are very different from each other but equally trustworthy in their own way and close to me. They are also close to each other. I don’t want to leave the living trust to both. Could I have a family foundation with assets in it that one controls and the living trust for the other to manage? Have you seen a similar situation to this?

    Very informative. You have discussed transferring ownership of LLC to a living trust. I just created an LLC with the living trust as a member. Do I transfer the property (which is currently under the trust) to the LLC? Will this cause probate issues later?

    What about, if you have only one beneficiary and inside of living trast, just put your beneficiary in the deed of your hous? Is that double? Thank you.

      There are so many other consideration than just a home. Health, end of life, burial/cremation - to name a few. Plus, if you put a child on your home, you could lose your capital gain exclusion, step up in basis, homestead, and the home is also on the hook for any liabilities they may incur at any time (even while you are alive).

    My biggest question is transfer of ownership of assets to the living trust a taxable event? I cant imagine it would work at all if so.
    In canada asset transfers are taxable events. 30% gone.

    What about term life insurance policies ? My grown kids are the beneficiaries......what would be the issue there ?

      The same issues that apply to whole life policies will also apply to term policies. Generally, you will want to name your trust as the contingent beneficiary (after your spouse) if you have minor children. The trust will then manage the money for the benefit of the minor beneficiaries. For adult beneficiaries, there could be a number of reasons you do not want to give them a lump sum payment. For example, their creditors can access those funds to pay off debt if received personally, but cannot access the funds if paid to the trust. Or, if the individual has problems with substance abuse, the trust can include mechanisms that require successful completion of a rehabilitation program before any proceeds are paid out.     If I leave funds in a trust for my son to get paid on a month basis after I pass, he gets married , 3 years later they divorce. Will she get a monthly portion of what he gets from the trust for the rest of her life?

      We would need a lot more facts to suss this out, but generally if the funds are kept separate and there is a solid prenuptial agreement, then no the divorced spouse would not have direct rights to the trust funds.

    Toby if you have outstanding mortgage on the property you cannot have a living trust on it. For information to all. Any thoughts on this. Other than push hard to get it paid off asap.

      You can move a mortgaged property into a living trust and the bank cannot call the note due. The Garn-St. Germain Act, 12 USC § 1701 (j)-3, and the corresponding regulations prevent a lender from calling a loan when a borrower transfers residential real estate of less than five dwelling units to a revocable trust.

    asking the question again
    If you have some rental properties in one member Sole proprietorship LLC then do you just need to create assignment on that llc and say i am transferring 100% this llc interest into the living trust and on the living trust and you are done? if you do this is you don’t have to take each property out of existing LLC and prepare a separate deed for each properties and record those properties individually under the trust name? or you have absolutely take all properties out of llc and re-record them under the trust ?

      You explained it correctly. If title is in the LLC name, you only need to transfer upper ownership in the LLC (called membership) into the living trust.
