  • The plaintiff bought a china cabinet from the defendant’s store, but when it was delivered, the plaintiff says the defendant’s moving guys broke the glass and the door. The defendant promised to fix it, but the plaintiff says she’s tired of waiting, so she’s suing for the damages. The defendant claims he reordered replacement parts, but the plaintiff refuses to respond to his calls to schedule the installation.

    Give me a break! He called her multiple times, left messages most of those times and he’s getting reamed for assuming she would see her caller ID and call him back? If she was as desperate as she said she was to talk to him why wouldn’t caller ID spark her response? It sure would me. As would the 3 minute message he left.

    Nah this lady is crazy, if she is being honest and saying she's called him a million times then she would recognize the number when he's calling her. Also the judge blowing up on the guy when he said he left a voicemail every other call is ridiculous, he didn't say "oh i have never left a voicemail ever" like if he's got 5 god damn pages of phone records and he left a message every 2nd call that means this lady got dozens of messages that SHE never responded to.

      The judge blowing up on this guy is totally wrong! Instead of commending him, for being honest that he didn’t leave a voicemail on every single call (a one minute call is more than enough time to leave a message.) she blasts him for not leaving a message every single time… This lady is nuts!

      No she's not. She was more than patient, and the vendor admitted that she's a great person. That shows that she wasn't the typical pain-in-the-butt customer. They knew where she lived, why not go to her house with the glass?

    Marilyn castigating the defendant was ridiculous. If I call someone and leave a message and they don't call me back, I don't leave a message the next time I call as well. I figure, well, I've already left a message so when they check their messages they're not going to want to get multiple messages from me. Leaving a message every other time or every third time is perfectly adequate.

      The message was left on one of the last few calls he made. Should have left a message from the very beginning. I’ve had dentist offices leave me 2-3 voicemails just to confirm an apmt. It’s not that hard.

    He had call logs and an invoice that he had the glass ready. She didn’t have call logs to show she called and didn’t have an estimate to show how much it would cost to have someone else do it.
    He should have won this case.
    I almost always agree with JM, but she got annoyed with him and ruled according to that not the evidence on this one.

    He didn't need to get grilled like that, especially with him trying to do the right thing. Yes, it would be mindful and smart to leave a voicemail everytime but it's not on them when the other person doesn't check their phone.
    If you don't know how to check it, ask someone. Especially when awaiting a certain phonecall.

    He called & called. If a number keeps calling, generally people are curious to know who it is and answers. He did leave a VM & she didn’t call back. She was negligent, not him.

    I don’t agree with this one man. The lady didn’t answer her phone . He left atleast ONE voicemail. Isn’t that enough? If the lady is SO ANXIOUSLY waiting on it? She’d have jumped on that one.     that was weird.....i go through ALL my voicemails to make sure no one has phoned me to whom i need to respond. Judge Milian doesn't?? how does she not miss calls from friends? Scrolling through missed calls is easy....it takes virtually no time at all.

    If this woman called as many times as she did there would be no way she wouldn’t recognize the number. The number may even have the company name on it. What does age have anything to do with it? I’m 52 and that’s ridiculous. My mom texts. That woman couldn’t pick up her phone, open it and NOT see that he called in the missed call log. Come on…

      LOL Exactly My mom is 74 and knows what a missed call is and knows how to return it. Unless he was calling from another phone or she was calling the wrong number. At the end of the day he left a message and she wanted to sue for the 1st missed delivery . In my opinion lol

    Wow Marilyn, chill out!!! That was totally unnecessary for her to yell at the defendant, and tell him that he HAS to leave a message every single time he calls. He has left several messages. It’s the plaintiffs fault, 100% that her China cabinet has not been fixed yet. I also feel that Marilyn’s ruling was wrong. If the plaintiff won’t allow the defendant to install the glass, then it’s on the plaintiff to pay out of pocket for the installation. Fortunately for the defendant, he doesn’t actually have to pay that $150. I really hope that the plaintiff can’t find anyone to install it for that price. It would be hilarious if every company charged a minimum of $500 to install it. I say that only because she is the difficult one in this whole case.

    I never return a 'missed call' and most young people when they leave a message (if at all) don't say what their number is, like I'm supposed to go through my missed call log and compare what time the message was left to what time there was a missed call to find out their number. Very frustrating...

    That was an unnecessary rant by the judge. If he called multiple times and left multiple messages then you would look and recognize the number. You don’t need to leave a message every single time if you’ve called over 10 times lol. That’s a waste of time. They see your number. It hasn’t changed.

    That plaintiff is so full of it. She just thought she could use the broken glass as an excuse to sue & get her china cabinet for free. That's why she never answered his calls. She was trying to build a case by letting time pass so that it appeared as though he wasn't willing to fix it. She didn't bargain on him having phone log records. I think the judge ruled incorrectly in this case. The plaintiff never allowed the defendant to come over & fix it. And why didn't the judge ask for her call logs? She claims that she called him a bunch of times. And then says that she doesn't want to deal with the defendant anymore...please. He was nothing but nice. She just wants whatever cash she can get & will probably have her "neighbor" put it in for free. JM should have just given her the glass & called it even. This was a ridiculous lawsuit. $280 for a simple glass install & $220 for "lost wages"...🙄

      Meh...I don't think she called again after the furniture was delivered & the glass was broken. I think she thought the defendant would be so sorry that the glass got broken that he would return the money for the cabinet. When he offered to only replace the glass...she deliberately ignored him to build a case. $280 for a simple glass install & $220 for "lost wages"....🙄

    If I'm waiting on a business to call about something I paid for, I'm calling back. The number is logged in my phone, under the business name, until our business is complete. Message or no message. Yes, it's professional to always leave one. But I'm not going to avoid the company just because they didn't leave a message.

    I usallly caller id call back first before checking messages. Specifically now a days where caller id from phone will usually display a name for business at very least when you dont have them in your contacts. In fact I get annoyed by messages.

    I don’t check voicemails at all since most are ghosts where it’s nothing, not even a missed call but I got the message to waste my time, the odd time it isn’t it’s usually a scam call or outright wrong number.
    Checking missed calls is easy. Idk why she’s such a birch about it. Plaintiff probably can’t check missed calls OR messages on her phone. So how is it his fault he can’t get ahold of her? Is he supposed to call her every 3 minutes?

    He had the glass there since it happened, he has calls records, and the Plantiff wants to day he’s not trust worthy.. I would not want t go back to her house either... She can install that glass for underc$100.00 for the cement glue and was rewarded $150.00 she send $$ and that’s exactly what she got... Not a person I trust at all some people is it’s just about money instead of humanity’s we’re has it went ??

    Judge Millian was a little out of line with how she spoke to the defendant. It's not like he didn't call multiple times, and although it is a good business practice to have left at least 3 vm's, he had the proof to back his story. She kind of made it seem as if his age and/or his generation was the reason he didn't leave multiple voicemails. She just should have gotten her point across without treating him like a criminal.     The judge got this one right. The lady took off of work 2 days in a row waiting for a promised delivery. Called the store multiple times with no callback. She had to physically go to the store in order to get a response. By many in the comments section logic, they ignored her calls and that’s bad business.

      Judge Judy usually shuts people down way too quickly because she’s so arrogant and thinks she knows everything. And why compare the two different shows? They are different for a reason. Different judge, different styles and beliefs, different fanbase. If you like to watch two different talk shows do you compare them to each other and try to make one of them more like the other? No, that would be boring, no variety.

    Judges be on power trips. Since he showed records of the number of calls the Plaintiff should have checked her messages knowing she was expecting a response from them. Since she didn't check her messages it's partially her fault so she shouldn't have been awarded $150.
