That bay county sheriffs sergeant deputy was way out of line. He was out of his mind too. That's because Jason refused to give his ID. Which is under the 4th amendment. Jason Gutterman is in a video titled "Amagansett Press Looks Good in Handcuffs" begging to be released promising to identify himself and explain himself like he was warned to do or else he'd be arrested. Once the cuffs go on, the Sheriff decides he needs to explain himself to the judge. Gutterman was bothering the UPS Distribution Center, refusing to explain his and his son's actions, filming UPS for no apparent good reason.
Apologies to the residents of Panama City. You will be paying for this ego arrest indirectly from your paycheck via state taxes. The Federal civil suit will take 1-2 years to process. It will most definitely settle out of court for around 40-60 thousand. Close to half will go to the attorney and associated court costs, and he will likely walk out with around 25 grand. The point of the arrest was simply to get them out of there. The police could care less if they file a Federal suit since the town insurance carrier will foot the bill.
I'm thinking Jason will NOT settle this out of court, he is such a strong advocate for the 1st amendment, it is not about the money to him, it is the principle of stopping their tyranny and sending a strong message. I for one am looking forward to watching those jackasses squirming on the stand trying to explain their fascist incompetence. LOL
In as much as the taxpayers do foot the bill. There's always the issue of what happens when a town, village or city goes bankrupt. Yes, it has happened. Not necessarily due to situations such as this. Enough lawsuits, like this, will push them into bankruptcy. The eventual chain reaction could leave these officers without a job in the end. Of course they don't look that far ahead and realize the potential consequences of their actions. That would be too smart
If police officers violate a persons / peoples civil rights and they do so knowingly, it ( the settlement ) should come out of the officers and departments pocket, NOT the tax payer. All police should be forced to carry and pay for their own liability insurance. Doctors do, security companies do, and lawyers do. Why not police?

If it has been ruled by the supreme court or a federal appeals court, the qualified immunity doesn't exist.

I saw this when it happened. Amagansett Press had no interest in the school nor the kids. He's got his own son with him.
They stand up for their rights and the rights of others.
That bay county sheriffs sergeant deputy was way out of line. He was out of his mind too. That's because Jason refused to give his ID. Which is under the 4th amendment. He chose to stay secure with his documents. Something that this sergeant should have known. Instead the sergeant got mad because Jason wouldn't comply with his unlawful command.
Yes, the ole' catch and release. As long as they control, control, control, they think they win.
