I don't see what makes it not an instrument. It's definitely not high class but it makes sound in a controllable way which to me makes it a legitimate instrument like Jack Blacks toy saxophone

What I mean to say is usually kids musical toys, at least the kind I saw when I was growing up, weren't useful for making music in the traditional sense. They were toys that made a lot of random noise but they couldn't be played the way you play a guitar or piano - by intentionally chosing notes. In contrast, this toy guitar (as well as some of the newer kids keyboards like the b. Meowsic) are capable of playing intentional notes, and thus, a song. I think that's pretty cool (or impressive, on the part of the makers, for doing such a thing at a low enough cost to be viable). I just didn't expect a kid's toy (something made of bright plastic and marketed at children, not at musicians) was still capable of being used for music this way. Sorry if that made less sense than my original comment, but I think that was my thought process.
