We had like 5 accounts on eBay that stole our Support Your Friends design and were selling shirts. We reported all of them and eBay did nothing.

We had some goober selling bootleg trash to cash shirts…we just let him do it, because he was a big fan and we didn’t want to break his heart.

A few questions, Josh. Was it an exact copy and was there anything artistic about the design beyond mere text comprising a slogan?
If it's just a slogan with no artistic elements, that would need to be actively trademarked to be protected, and you'd have to litigate against anyone infringing on it, or risk losing it.
Otherwise, if there are artistic elements that they duplicated identically, that would be copyrighted automatically if you were the original creator and you'd need to file a DMCA. They could counter file to get it put back up and you'd have to sue at that point.
In either case, there cannot be prior art of the same thing, or you wouldn't have a valid copyright or trademark.

I went to Boxery too the other day and was off put by their shipping pricing. Then I found them on Amazon and got Free shipping. Didn't have all the sizes I needed but helped with the pricing tremendously. And got the other sizes I wanted off Ebay from a different seller. Over all saved compared to the boxes + $90 ship.
Staples has good box prices and free shipping also
@CGB999 I originally bought from them a couple years ago. But for my hat boxes 8 x 8 x 5. The price wasn't feasible. Just found it funny Boxery was literally on Amazon with shipping baked in but still cheaper than their actual site.

Cary, there is a difference between authentic and authenticated.
If I meet a celebrity and rhey sign something, that signature is authentic. If I send it off to an expert to analyze the autograph and give it their seal of approval as real, that's authenticated.
Many people are happy to have an authentic signature that isnt authenticated, if they can save money.

You're wrong about the lawsuits. I was Hut with one for a plush I had listed on ebay. Default judgemental in the same Illinois court without notification or any chance to defend myself. It was for a brand called Sparrow that owns trademark on some toy. I had a piece of glassware with a sparrow on it and that is what got a $159k judgement against me. I only found out after the plaintiff notified ebay AFTER the judgement and my funds were taken and my account was suspended. You need to know about this. It cost me over $20k to get it resolved as they were looking to place liens on my bank accounts and home. These are no joke lawsuits and attention needs to be brought to it.
You have to be served before Judgement can be placed. If you were not served then they can't just hit you with a 159k judgment. Any lawyer could get that thrown out and any Judge with common sense would not even hear the case. But you saying you had a sparrow on a peice of glass and it wasn't even their own Inventory? That makes absolutely zero sense ?

@@commonwealthflipper to clarify... I had a piece of glassware that had 'sparrow' as a keyword. The suit was claiming I was selling a counterfeit plush under the sparrow trademark for a character called 'Booba'. I never heard of, nevermind sold or listed anything such plush.
These lawsuits fall under what is called 'Schedule A Defendant' suits or 'SAD' suits. They are very real and they come almost exclusively through the Northern Illinois Federal District court (7th Circuit). There is a great video here on CZcams that explains what they are. It's titled 'The Company That Sued 700 Small Businesses at Once || Understanding the SAD Scheme'.
You are not served and you do not have an opportunity to defend yourself because the defendants are listed on the 'Schedule A' form which the judges in this court seal, even to the defendants. There are also a couple white papers you can read if you feel so inclined. You can find one by Googling 'A SAD Scheme of Abusive Intellectual Property Litigation' it is written by Eric Goldman from the Santa Clara University School of Law.

I sell on Amazon and I always delete the product and listing after I sell out of it. There are so many times where someone changes the listing to something else. And if it’s something that else shouldn’t be sold, your account can get hit because it shows you had it up at one time even though it was a totally different product.

I do sell lego pieces on ebay and they are 10 pieces for $1 and then the shipping is $5-6 and people pay it quite a bit. I do calculated shipping so they can buy multiple but surprisingly they will buy just one lot.
I have satellite internet ( Viastat not starlink ) and it doesn’t work well for whatnot streaming. Could be my plan or the fact that the dish is pointing at my house not the sky 🤔

dude sometimes you need to just list the auto. I recently sold a bar rescue plaque that said this bar was rescued on this day and it had a faded auto from Jon Taffer. listed the item with the story and no coa. did minimal research and I personally think it was real. Auction ended at $295 and i paid $3. gotta do it sometimes.

Mercari changed their settings to allow entering prices like $9.99.
Lets be clear, if I take a line from, say, a Taylor Swift song. Say "karma is a cat". Lets say incorporate that line into a graphic on a t-shirt. The graphic is a drawing of a cat playing with a ball of yarn, and some of the yarn has unraveled, and the string that's unraveled has formed itself into cursive script that reads "karma is a cat", that is unequivocal fair use.
I have taken a tiny fraction of a song lyric and transformed it into a completely different medium, a graphic of a cat playing with a ball of yarn where sone of the yarn has formed text of that small piece of the song, I have already met 3 elements of fair use, and I only need to satisfy one to claim fair use.
Furthermore, you cannot copyright or trademark exclusive use of your actual name or appearance. If I take a photo of somebody, I can sell that photo and I can use a person's name to describe the subject of the photo. What I can't do is misrepresent it as official merchandise, approved or endorsed by the artist, or anything fraudulent, deceptive or anything that would be designed to intentionally cause confusion to potential customers that I have any affiliation with some other brand or the artist or approval from them.

Comic Grading question..... I have a variant cover 1 in 25,000 special event (had to purchase huge amounts of comic for variant Gold Seal cover) it's a mini crossover (X-Men Phoenix) now Foxfire.... it's rare enough it's not listed as even existing.
It's high grade 9 minimum.
