    I’m not an Everton fan, what sporting advantage have Everton gained by spending a fortune on a new ground? You do realise that with the fact that other massive clubs have got away Scott free, having already built their stadiums and squads is really what pisses fans off, and that’s not just Everton and Forest fans.

      If there’s no sporting advantage to building a new stadium, then why build one? Just stay at goodisen. A new stadium will give them larger support at home games, more revenue to further invest in the team. I know it’s all theoretical but the intent of a new stadium is surely to gain sporting advantage in some form?

    That guy is talking nonsense if he believes the PL have come out of it well. It showed there was no proper system in place. The punishment was made up on the spot. They look like amateurs. Richard Masters needs to be removed.

      You can appeal decisions to the Court. This is how the UK Legal System is built and the Premier League is no different. Amateur.

      The system was agreed between the PL clubs. The PL rules create the independent commission and the independent commission decides the sanction. It’s not that complicated unless you really don’t want to understand.

      @@thorntonovskithat’s real life Tesco literally do compete head to head with corner shops, thousands of independent greengrocers, butchers etc went under when supermarkets took over. I really don’t see why any club shouldn’t be able to live the dream if they have a rich owner, FFP is just about keeping the big clubs big and the rest at bay. The PL would have been very boring if Blackburn, Chelsea, Man City etc hadn’t been able to spend big.

    Simon's point, starting @13:25, is a good one: "pointing the gun at the Premier League is a ridiculous observation because the Premier League is upholding the rights of the other 19 clubs...it's the independent comission. [Pointing the gun at the PL] is sabre rattling from feebleminded people who don't understand the principles of what they are talking about, and it gets them currency...they won't read the summation or the appeal because it won't concur with their world view."

    Premier league has come out of it well 😂. Worse part of it with Everton imo was when they referred them to the independent commission and then the premier league planted the seed by coming out in the media before the hearing recommending Everton get a 12 point deduction. Then you’ve got Man City who have 115 charges dating back 15 years ago and still one charge hasn’t been heard yet. If it was fair across the board with clear guidelines and punishments there would be no excuses for any club but it’s quite obvious it’s not fair across the league as premier league has there favourites 🤑

    Forest DIDNT fail the £105m. They failed the £61m because they were under different rules to every other team in the premier league

      Not quite true, Bournemouth only had £61M as well and Fulham only had £83M but the principal you are concerned about is the same. Teams coming into the Premier league should be able to spend up to a £79M loss in their first year (as opposed to 35M) if they are not bouncing back and up to 57M loss if they have bounced back first time so that their 3 year loss is 105M the same as all the other clubs in the league. Otherwise the dice are heavily loaded against the promoted clubs in their first seasons. Frankly the system is anything but fair and nothing to do with ensuring the financial stability of the clubs. Forests situation is particularly dumb as to meet the rules they are supposed to have happily given away almost £20M to sell Brennan Johnson early enough to meet a deadline that was arbitrarily and ignorantly placed in the middle of a transfer window. How is that helping their financial stability…….

      @@scifimonkey3 Fair point well made worth pointing out that Bournemouth were in their second season of relegation parachute payments following their relegation in 20/21, therefore having a significant chunk of their losses covered. A luxury and advantage which Forest didn't have having been out of the top tier for 25 years. Another example of how skewed and unfair the system is. But I agree with your suggested solution. Let's also not forget that Bournemouth were found guilty of breaching EFL Financial Fair Play max losses in the year they got promoted, and got away with just a £5 million fine, which they even managed to negotiate down. That's where it gets even more frustrating that the same rules have not applied to some pretty serious breaches in the past.
      By going down this route the PL are making a rod for their own backs with City. If Forest and Everton are potentially facing relegated as a consequence of their minor breaches spanning just one single charge each, then if even half of the 100 odd charges against City are upheld then I don't see how they can't be dealt a Juventus-style punishment in 2006 and face automatic relegation and start the season in a Championship with a points deduction. Anything less would be seen as a fudge and inconsistent. It would be completely unprecedented in English Football.

      It isn't only meant to help their financial stability, it's meant to ensure fair play. Forest hanging on to their best player for half a season when they were over what they could spend and got a decent offer for him is not ensuring fair play.@@scifimonkey3

    failed to notice two of their 9 reasons for punishing Everton are legal incorrect. Everton got half the points deducted that the league wanted. In all measurable reasoning the league have been buggered into oblivion by Everton's lawyer. They tried to act tough to avoid an independent regulation and ended up proving it's is absolutely necessary.

His companies were injecting 10’s of millions of dollars into the cub, your club. Your clubs whole business model was based on him and when he was banned, the walls fell down around the club and why your in FFP issues. Typical fan who doesn’t care where the money comes from and then wants to cry wolf when you are found out. Maybe target the individuals who created this issue.

    I am LFC fan but I dont want any club to be treated unfairly especially our brothers and sisters across Stanley Park who deserve better. Other clubs have done worse but received absolutely no sanctions. Monetary sanctions are not sanctions because more money than sanction is made when violating P&S. CL>$100M, PL>$50M, cups>$45M. But give $50M fine they still gain >$150M. I believe this may have something to do with our gaffer leaving.

    These punishments are too arbitrary especially with the emotions of football involved. They need to do it season by season and say for each £1m you go over PNS you lose one point. It stops all the arguing.

    If the sanction can never be more than 9 points ( i.e. worse than going into administration), then Newcastle, Man City et al, can spend whatever they want and only be hit with max 8 points sanction.

The fact that it's took the Premier League so many years to even say that Man City have breached has actually made the situation worse for the Premier League as questions will be raised to what they do about everything the club has achieved already if they had been financially cheating. It's a mess and it does massively questions of the integrity of the Premier League even more.

      Because they run the other leagues in england and have experience docking points and sanctions for rule breakers. Efl have more experience and understanding than the prem do on this

    It’s not unprecedented, Sheffield Wednesday got a 12 point fine a few years ago. The rot set in and despite getting 6 points given back, the damage was done and we ended up in League One.
    Nobody cared about us then, so why should we care about Everton now 🤷🏼‍♂️

    Everton is a great club but they were never the victims. it's like if a person gets caught speeding and they're sentenced to death. There is no death penalty in UK law, especially for speeding or driving offences. they can only complain on the severity of the sentence. The PL isn't corrupt either. Everton breached rules THEY signed as a PL club and thus helped form!

    It’s still not clear. Why can’t this be more transparent. £x = y pts. Surely, a simple mathematical formula could be applied, especially as the “recklessness” (as it’s being referred to in the article) is quantifiable. For example, if a club breaches FFP at the lower limit that equates to being penalised one win, 3pts. The upper limit is 2 wins, 6pts. Something like this is transparent and would give clubs a good reason to “tow the line” and fans the ability to fully understand the intended consequences. Deductions and appeals, like the ones we have just seen, make no bloomin sense and only play to the fact that there are NO clearly defined and understood rules. How can that be in a sport which is wholly based on clearly defined and understood rules?

    Today's FFP don't work for club going bankrupt, need to go back to the old FFP rule that really helped the poor clubs avoiding greedy owners.

    Everton's breaches are not sporting advantages, they ended up going over because of certain reasons..1= lost £200m in sponsorship naming rights due to the sanction on Usmanov because of the Russian invasion of Ukraine..2= Gilfy Sigurdson was worth £20m on the financial books (players worth) so cos of his unfounded allegation for 2 years Everton had to pay his wages whilst not playing and when he proved his innocence he was deemed worthless on the financial books...3= Interest payments on loans for building Stadium which were not counted on Everton's books until midway through the building of the Stadium the Premier League changed the rules so the interest payment amounts are now set against the £105m your allowed to lose...4=Everton had mislead the Premier League with its accounts on purpose to dupe the Premier League into not going over by said amount which the Independent Appeal has cleared them off...5=Everton over the last 3 years are the 3rd lowest spenders on transfers...6=Everton have opened their accounts and books to the Premier League for the last 3 year's when they openly told the Premier League they were worried that they were coming close to breaching FFP...7=Everton have had to have permission for every transfer in and out they have made for more than £5m so had to get approval for each transfer by the Premier League...8=Everton have sold £140m worth of players in the last 2half years...9=Everton have spent less than £45m on incoming players over the last 3 years...Those are the facts to all the haters who think Everton have basically just taken the piss and deserved to have a bigger points deduction than for going into Administration and becoming Bankrupt and losing 100's of people's livelihoods and jobs + all the money you owe when you go into Administration get voided and not paid..And the penalty for that is 9 points GO FIGURE all you smartarses

    Waiting for... talkSPORT to address the fact that Everton is the 3rd less net spender on transfers the last five years so NO the club havent got a sporting advantage, the whole argument is totally bs.
    The fact that the club is building a new stadium to be more competitive in the future ain't even a topic, this is the main reason for this. The whole case is based on the envy that Everton does get a proper stadium,fit for modern times and the fright from the so called big clubs that Everton will close the gap.
    The best thing about Everton getting a lower sentence is seeing Simon Jordan almost in tears. I bet he will cry and bite his pillow if Everton survives yet again.

      Read the commission's report. Spending on the stadium is allowed. Everton tried to say that some of the spending on players was actually on the stadium. Their own accounts showed otherwise.
      It's why this didn't come up in the appeal, because they admitted it.

    When you have a KC who knows his stuff, he will work the system to avoid complicating a further outcome. You have to source a route that any commission cannot corrupt!
    Jordan can look as smug as he likes, but the arguments could never be made in the appeal due to legal bias, nuances and egos!
    The whole process and implementation of investigation/punishment by the EPL against Everton has been an Insidious, Stochastic Psyop operation to ensure the club suffered prolonged periods of uncertainty.

      You might want to do some research as Leicester, Leeds & Burnley agreed to drop the lawsuit as it could put Everton out of existence and instead are negotiating out of court on a settlement. So the exact same thing will happen next season.

    Bottom line is no one forced Everton to waste vast sums of money on a bunch of highly paid deadbeats or a new stadium. They knew what the FFP rules were and failed to work within the parameters. They’ve admitted fault but disagree with the punishment. Get over it and move on

      What everton did was originally to say some of the money they spent on players was spent on the stadium. Their own accounts showed that they were lying. They even admitted it.

      @@lilbaz8073 stadiums have never counted towards psr. The prem changed the rules without a vote and now they do count towards losses on psr. Its nothing to do with players, we haven't hardly signed anyone for 3 years, just constantly sold all our best players.

      Hence why chelsea gave players 8 year contracts to spread the cost of the transfer fees over 8 years.
      Their wages were at 95% of turnover. Add the amortisation costs they were over.
      They even admitted to it. So stop calling foul.
      They voted for the rules. They knew the rules. They broke the rules. They got punished.

Everton’s position was that any interest attributable to expenditure on the stadium should be excluded from its calculations and argued that accounting standards meant that the commercial loans would have been repaid or never drawn down had it not been for stadium redevelopment and, as such, could be capitalised as they were directly attributable to a qualifying asset (the new stadium) and therefore excluded from calculations.
      The prems argument.
      the interest payments could not be excluded as Everton had not in fact incurred any interest cost in relation to the stadium and interest on an inter-company charge did not impact earnings before tax and therefore could not be excluded from PSR calculation; and
