    About liens....a lesson learned the EXPENSIVE way...We bought a brand new center console 22 foot power boat...brand new mind you. On the day we went to consummate the deal, the seller was very cagey about sharing the bill of sale.....I wanted my lawyer to review it but he hemmed and hawed and said "fine, if you don't want the boat, I have a waiting list of people ready to buy it right now". I relented and went to their offices (in a trailer...that should have been my second red flag...and reviewed the bill of sale. All looked normal except for the line that read that "the buyer assumes all liens". I pressed on that issue but again, the seller told me essentially "take it or leave it". I signed. A few hours later I got a phone call from the gentleman who built the boat over the winter...nice guy but....he was never paid for his work and yup.....I owed him $20K. The lesson.....do not sign any legal document without having it reviewed by a good lawyer....I let my passion overide my reason and got taken to the cleaners.

      So sorry to hear this Alan. It has happened a bunch in the housing market as well...buyers feeling like they HAVE to accept a seller's terms. Many people don't understand that liens and other encumbrances typically follow the boat, not the owner.

    So useful Just had a deal fall through where the dealer and owner concealed a past fire (insurance write off). I found out from walking the dock. Talk to dock neighbors if a local boat!

    When I follow a sailing site, it's for sailing. So many sites go off on tangents I can't go with. This is the first time it was worth hanging in. This was the best advice I've ever heard for purchasing a boat. Well Done!

    Really well done. You most likely saved quite a few people a lot of frustration. I have bought and sold with and without brokers. It's a minefield and rarely an enjoyable experience.

    so, this is what I got from this:
    Questions to ask used boats:
    1. Has there been any damage/insurance claims?
    2. How the title is held, where is the boat registered and are there any leins? Title, registration, and flagging?
    3. Is the dingy a separate registration?
    4. Have taxes been paid?
    5. Electrical upgrades? Receipts
    6. Have there been any structural modifications?
    7. Escrow?
    8. List of sale items and dates of transfer
    9. Currencies/exchange rates

    Not tens of thousands, but I travelled to southern Greece, paid for a survey and sea-trialled the French-flagged boat. Once back in port and we were reviewing the documentation there was no certificate proving (the advertised) VAT paid status. The owners and the broker tried to convince me the booklet that showed some kind of French "motor tax" from the 90s was sufficient. I balked and went to Athens for a few days to weep then flew home with my tail between my legs. After hiring a lawyer in France to get my deposit back (yes) I was out $6,500. Can't say I enjoyed the trip but I DID learn lessons I'll keep forever. And maybe some of you can learn from it too. Great vid guys. Thanks.

    Really enjoyed watching your videos as we are currently boat shopping. We are moving from a monohull to a catamaran. The survey of the first catamaran we wanted to purchase didn't go well so we decided not to move forward with it. Really helpful to see that it happens to other people as well. Please keep up in the loop of your boat shopping, I know you guys probably feel like you want to keep it all private now until you have a boat but it's so helpful and we are rooting for you guys! The right one will come along!
    We have seen the outremer 49 in the yard at boatworks, we kept an eye out for you guys and then learned it didn't go through.

    This is so great, always learn so much about boats. Boat maintenance, repairs., things to look out for and things to not look out for. Your video today is like the icing with the cherry on top, the creme de la creme as it were. I don't believe I would still have an interest in looking for a boat if it wasn't for the diligent manner in which you guys lay things out and the humour you both bring to the subject matter.     I guess sellers (some) confuse escrow with escroc (crook in French) it seems, always the same they put you in a rush (similar to phone hacks) and your done, and sadly usually you don’t have too much leverage even if it is obviously an illegal sale contract.     Given your determination and experience during this process was there ever a time where building your own was a consideration ? As I sip my coffee in my "O'Kelly" mug .. I say this only because it seems like shopping for a new or used craft is quite a lengthy affair. Thank you !

      They considered it, but the time frame is well over a year, so they aren't building one

    Great question to ask, currently trying to get insurance for a client who bought a boat with a salvaged title thinking they would be able to get insurance. They bought it before contacting me before i had a chance to do research for them. I have not been able to place them with anyone of the several carriers (worldwide even) I have access to and feel terrible for this older couple who own an uninsurable boat...can't even get them a liability only policy. If you or your followers have a salvaged titled boat and know of a carrier i would love to pass it along to this couple. Thanks!!! great videos...all of them!!!

    Sage advice. Some brokers like our first would make Ned Kelly look like a gentleman. He couldn't lie straight in bed, could hide behind a snake etc. I was accompanied by a practising barrister and he just couldn't help but continue lying (He stated he had taken another deposit on the boat and would sell it from under us if we didn't go ahead and we would have to go to court to get the deposit back.) Complain to the Queensland Marine Brokers Association, said someone. He was the president of that association. However my last experience with a broker really restored my faith. Prior to that our private boat sale contract was handwritten and made up on the spot between us and the purchasers. It went well, but the deposit holding is not a comfortable thing.

    In the UK you need to know what the VAT status is of the boat you want to buy. Regardless of the boat’s age. There is lots of chatter about boats that have been kept in the EU and VAT and brexit which has complicated factors etc.

    Great video as always. I am looking at a catamaran that has had front and rear hull extensions, along with a shortened mast for the ICW. How do you know if it was done correctly and will not adversely impact the safety or other aspects of the boat? Thank you very much. Long time fan.

      Guessing: You'll need a reputable naval architect or some such with the equivalent knowledge. Also guessing that the naval architect will have to examine the original drawings for that boat and also the drawings that were made for this redesign. Finally that naval architect will have to examine the boat in question to see that the actual work was carried out to spec. Alternatively you could contact the naval architect who did the actual work of this redesign directly. Depending on who that naval architect is, you could either trust that person or choose to have another naval architect double check the work and design.

    Thanks for the information on boat buying. It can be a daunting process with mine fields everywhere and buying a boat in a foreign country just adds more complication. Don't a lot of countries impose a sales tax on the sale of a boat? I have heard of people making the deal in International waters to avoid that but I would be Leary of taking a brief case full of cash out to sea... I considered building a boat at one point until I learned that a typical 40 foot monohull takes about 10,000 man hours to complete. That would have taken me years... Thanks for the video. Good Luck with the search. If I ever buy another boat I would hire you two as consultants if possible... 🙂

      Wish I could say we are experts in all things everywhere, but we are not. I can tell you that if a boat is USCG documented in the US, it is usually a fairly straightforward process. If held in an corporation in a foreign country, you need to do a lot more research and talk to an attorney familiar with those laws.

    The O'Kelly's taking us to school. Are you all adjusting to being on land full time now? I had asked Wiley about you all and he said that there are boats out there, but nothing that meets your criteria and kind of stated you all were doing your own search. Sailng Doodles had that friend that had an amazing catamaran but they did a lot of work to it and even got a specific year because it had special rigging. Probably outside your price range.

      With boat #5, we are now incredibly specific about what exactly we are looking for. On top of that, we feel the boats that do meet our criteria are overpriced by about 15-25% and that a market correction is just getting started. So as much as we would LOVE to buy a boat tomorrow, we know from first-hand experience (mistakes) what happens when you get desperate. The right boat will work when the time is right. Between now and then, I would say land life has its benefits and drawbacks. We will enjoy the benefits for now.

    Thanks for that great lesson. Great to watch you again in your usual one week slot :).
    I previously have had an extreme aversion to brokers when selling a boat because of their enormous cut and also when buying a boat because although they offer to get answers to any questions there is no possibility to chat to the owner which brings up follow-up questions and allows you to make an assessment how the boat has been used.
    The issue of who is going to hold the deposit is however a bit more difficult in these situations. Fortunately my last boat was bought from an old guy who had owned it for 15 years and had it moored outside the front of his house where he had lived for decades so it was a pretty safe bet. The boat was also a well known model built in my country (Australia).
    I would be very scared to buy a boat in a foreign country. Typically as an Australian a lot of boats appear that are built in South Africa or France and have been sailed to countries like Indonesia or Pacific Islands or even Asia where I wouldn't trust the law at all or my ability to enforce it even if the law was fair.
