It's not even a crime to pay someone not to speak of something, so long as it wasn't a crime. Companies and politicians do this all the time. Congress has a host of people who were paid to not go public about worse claims.
She is absolutely correct. Any prosecution will be overturned in a higher court, but the fact they are doing this shows how far we've fallen.
He was campaigning for president. What he did was election interference. Then he hid the payments. That's falsifying documents. Documents he was required to submit as a presidential candidate. There's two crimes.
