Alec Baldwin Criminally Charged With Involuntary Manslaughter For 'Rust' Gun Shooting

  • New Mexico First Judicial District Attorney Mary Carmack-Altwies plans to file two felony charges of involuntary manslaughter against movie star Alec Baldwin. The Santa Fe DA said Baldwin will face up to five years maximum jail because of the gun charge at a jury trial for killing cinematographer Halyna Hutchins. Baldwin's lawyer said he will fight it.

    Any one else would already be in prison after being tried. This man wrecklessly took the life of a co worker and thought he was above being punished for it. Well finally it would apear justice will have her chance.

      The maximum penalty is 5 year’s mandatory jail. And the DA is really coming out hard on him finally. She told CNN that "Every person that handles a gun has a duty to make sure that if they're going to handle that gun, point it at someone and pull the trigger that it is not going to fire a projectile and kill someone," she said.
      "An actor does not get a free pass just because they are an actor. That is what is so important. We are saying here in New Mexico, that everyone is equal under the law,."

    About time!!! He has been free too long. He violated the primary rule of firearm safety. NEVER point a gun at a person! The only exception is self defense. Otherwise, simply do not ever point a gun at a person! It bears repeating over and over. He never should have pointed a gun at her, blanks or no, and also should not have pulled the trigger with his weapon pointed at another person.

      @@johnpglackin345 blanks can still kill! John Erik Hexum and Brandon Lee both died from guns loaded with blanks. Rule #1 is something to always remember.

    I'm not an 'armoror' by any means but, I take firearm safety to the highest degree. I've been in situations (controlled ranges), where I've seen unsafe handling of firearms. I've taken the time to correct the person 'doing it wrong'. There's also, been times (after I've corrected someone, and see them repeating the bad habit AGAIN), that I've packed up my stuff and left. If I agree to do a one on one training session with a new shooter (or an experienced one), and they don't follow the 4 basic rules of firearm safety, the session is dome, right then and there!

      That's great that you help people to know safe gun handling. Of course the real danger is crime in the streets and they adhere to no rules. But for those of us who are law-abiding and care about our safety and the community, we pass along the rules to new gun onwers as we learned.

      I train the exact same way. I'll show & explain to a person WHY you obey the 4 main gun COMMANDMENTS. But ignore them twice, & training is done ! My life is more important than a careless person mishandling a gun.
      They are called "COMMANDMENTS" for a reason ! They are NOT called 'suggestions' or 'options'.

    Thank you for continuing to cover this tragic shooting. I hope that her family will get justice. You are the only journalist who explained to me the motion that Baldwin was using before the fatal shooting. In my opinion he was reckelss

      But they eventually catch up to the criminal(s).
      The Judge & DA usually by then are pretty upset with the Defense counsel for wasting everyone's time.
      It's going to be an INTERESTING Jury trial !

    Definitely didnt see this coming. Figured he would get off. Still think he wont be convicted, but I think the charges are warranted and a fair charge. I said millions of times I don't expect these hollywood types to even understand how a gun works (short of pulling the trigger...which he did) but they are supposed to check them, Baldwin just said "F it". Whatever happens, its tragic. I hate all of this.

      Agree it's tragic and terrible and wouldnt have happened if he had adhered to the gun safety rules. You dont think a jury will convict him because he's so famous?

    Prime example is OJ. In California he objects to his ex wifes new boyfriend & goes free. In Las Vegas he doesn't have enough cash to buy back his memorabilia so he used his gun, he ended up in prison.

    1-Treat every firearm as if it were loaded, 2-Always keep firearm pointed in a safe direction, 3-Keep your finger off the trigger until you are ready to fire, 4-Do not point your firearm at anything you are not willing to destroy and 5- Always be sure of your target and what lies beyond it.

    If found guilty, of course he can NEVER handle any gun again (or own them). I am not a lawyer, so I am unsure if he can even be allowed on a set with firearms present. In a gun store, if I want to examine a weapon, I expect the salesman to check it before he hands it to me, then I check it as soon as it is in my hands. Cannot be too safe. Great job Emily!

      If he’s convicted of a felony, I can’t think he will be cast in any movies with guns again! But yes I also always check my own gun as I explained in the video - even on TV sets or photo shoots.

      Wisdom dictates:
      Always ALWAYS check to make sure any gun you handle there is no round in the chamber !
      And open that cylinder and drop the mag to make sure the gun has ZERO rounds of ammo in it.
      If you can't personally verify the gun is empty, refuse to handle it.

    I am not in any way sticking up for Baldwin or trying to justify any of his actions or in-actions, but I will say, those "single action" western pistols really have "Hair Triggers" when those hammers are cocked and ready to fire. It's understandable him saying that he didn't pull the trigger, but with that weapon, it does not take very much at all, a slight touch and bang. Still, screwed up and big mistake he did not check the weapon, his fault, his responsibility.

    It’s the armourers fault. 100%. There should never ever be a live round on any movie set in history. And props guns will not accept a live round. Not that I like Baldwin but for sure it’s not his fault.

      Well it’s not up for debate now that charges have been filed. The DA charged both the same counts. Also no one has claimed that the armorer brought live rounds to set.

      Why is the DA refusing to investigate:
      - WHO brought the LIVE ammo to the movie set.
      - WHY someone brought LIVE ammo to the movie set.
      - HOW much LIVE ammo was brought to the movie set.
      - HOW come the Armourer didn't recognize the LIVE ammo immediately & have it removed from the property immediately.
      - WHY didn't those who touched the gun examine it for LIVE rounds, dummy rounds, blank rounds
      Last time I checked, ammo doesn't have legs of its own !

    Is it possible in his rush to get this scene, AB never checked the pistol he was going to use, to see if it was loaded ? This was his #1 job as Producer and as the one handling the pistol.
    If you go back to the Video Emily posted in 2020, her finger was NEVER once on the trigger and she NEVER once aimed the rifle at anyone !
    AB of all people should know these 2 gun Safety Commandments / Rules.
    AB now blames the woman who had a "Safety talk" on the "Rust" movie set, the very morning she was shot & killed. Who was this woman ? Halyna Hutchins !
    As far back as I can remember, AB has almost always came across as belligerent, haughty & full of pride.

    I was hoping they would bring these charges MUCH sooner.
    Rule #1 of gun safety is you treat EVERY gun as if it is loaded and do NOT point it at anything you do not intend to destroy.
    The FACT that he claims he "didn't pull the trigger" is OUTRAGEOUS! The ONLY way that gun CAN FIRE is if you pull the trigger while the hammer is back.
    Of course, you mentioned these points. Which just just proves that baldwin is an uneducated baffoon. But, last I checked, you don't get leniency for being stupid.
    I just wish he could get MORE time behind bars for this.

      Baldwin could get a 5 year mandatory if it goes to trial and if the jury picks that charge and if he’s convicted.
      Legal experts tell me it only took this long because he’s famous and they had to be careful

      @Emily Miller , I can appreciate them wanting to make sure ALL of their ducks were in a row before going to trial. It gives them a MUCH better chance of getting the conviction and maximum sentence.
      I do keep forgetting that this trial is NOT happening in Hollyweird. The chances of a successful prosecution are greater in the state of New Mexico as opposed to Commiefornia.
      Have you heard anything about the trial being an open or closed proceeding? This is one that I would watch if it were televised. I would at least like to see the verdict (especially if they come back with the guilty that I am hoping for) and the sentencing.
      I hate to sound vengeful, but I would be elated to watch the color drain from his face and that smug grin of his droop when they say "GUILTY."
