Rayshard Brooks case | Legal experts weigh in decision to drop charges for APD officers

- Special prosecutor Pete Skandalakis has said he determined it was "reasonable" to use deadly force by Atlanta Ofc. Garrett Rolfe in the shooting of Rayshard Brooks at a Wendy's in June 2020.
He said the officers "acted within the scope of their duties" when they began to arrest Brooks at the Wendy's on suspicion of DUI and had "no idea" a struggle would occur and result in the shooting of Brooks.

It shouldn't even have taken 2 years to drop all charges. The former DA was to fast to judge and to charge even after seeing the body cams, dash cams , Wendy's CCTV and cellphone video. The former DA made up lies and twisted the videos to make it seem the officer kicked brooks after being put down. If I was them I would sue for millions after this ordeal.
Only a biased,racist white person,that thinks police are always justified when killing an unarmed black man would think this decision is ok.We all know what it is.
Don't assault then try to run from the police with one of their weapons. Simple.
The cops should have been trained enough not to allow their taser to be taken from them. Sloppy cops.

The former DA Paul Howard thought a taser was a deadly weapon when he charged 2 cops a few weeks before with assault with a deadly weapon for tasing 2 students. So..........

Extensive video evidence has been available to the public since the incident occurred. I watched body cam videos that started from the initial encounter with Officer Brosnan, all the way through the scuffle when at least one of the cameras was knocked to the ground and laid there still recording and picking up the events on audio, was later picked back up by another officer after the shooting occurred and others were on the scene, returned to Officer Rolfe, and recording all the way to the moment at which Officer Rolfe was at a location where he would provide his briefing of the event. At minimum, there has been available two different body cam videos, as well as video from Wendy’s surveillance, bystander videos, and audio from the 911 call made by Wendy’s employees when Mr. Brooks kept falling asleep in the drive thru lane. In addition, there was later a public video of the hearing held to determine if Officer Rolfe was wrongfully terminated. At that hearing, one can hear testimony from multiple officers and investigators, none of whom say that this was wrongful use of force. Mr. Rolfe’s counsel presented extensive evidence of letters of support for Mr. Rolfe from multiple community members and fellow police officers. The ruling at this hearing was that there were, in fact, procedural violations problematic to Officer Rolfe’s termination, and he was reinstated.
It is clear, Mr. Griggs, based on your comments about being glad that 46 minutes of video is being made public, that you yourself have not taken the time to review all of this available data, and if you have not done so at the time of this interview, perhaps you should consider that it was irresponsible of you to go on television to provide legal commentary on this controversial case with which you have not fully familiarized yourself.
We all have the benefit, the privilege, of being able to split hairs and break down a violent encounter, moment by moment, from the cozy vantage point of our living room couch. We all have that privilege because there are men and women who choose to place themselves at risk every day, serving to protect us and hopefully prevent us from having to be in those situations. And yes, as with any sampling representative of society members, there are some officers who get it wrong, maliciously and/or negligently, and those officers should be prosecuted and fully held accountable for their crimes. But not every instance fits this narrative, and should not be proclaimed as such without thoughtful examination of the available data.
This shooting was, indisputably, a tragedy, but I find your arguments that these officers should be tried for murder, to be weak and circumstantial, at best. Uninformed, at worst. If it is your opinion and argument that lethal force would’ve been fully justified at second 7 into a violent altercation but not at second 15, maybe you should ask yourself if you are trying to stretch the reality of the facts to fit a narrative that is ill fitted to this case.

I must say I agree with the DA. Rayshard brooks is another black man who made a foolish decision against police, he was clowning and being a fool, okay a taste is not a lethal weapon, however is he takes and disables the officer he can take his weapon and shoot him and u don't wait around to see if a person is gonna shoot you 🙄 shoulda, coulda, woulda,....HE could have stopped and followed directions. Very disingenuous, Brooks wasn't carrying a non functioning taser. Yes, the taser prongs were deployed. However, it can still be activated against the skin. The officers must have been in fear of being tased, having their gun taken, then killed with it. The officers also had to consider, if Brooks would have used that taser on an innocent citizen, for example, to car jack a car. Those officers and their police department would absolutely have been held liable for not stopping Brooks. Ridiculous 🙄
I want to hear what that defense lawyer with the bow tie has to say about the Patrick lyoya case.
He said if mr. brooks was wrestling with the cops trying to fight and use the weapon then I would understand using lethal force.
I’m curious to know if he feels that Patrick shooting was justified lol Patrick did all that with a police officer and people still say it’s not justified lol

The police initially claimed the shooting was justified because the man was firing the taser at the police which they claimed is a "deadly weapon". However, whenever police use a taser on a citizen they NEVER refer to it as a deadly weapon or a deadly use of force.
So what would u have done? Since apparently you were there and know the mindset of someone dealing with someone who’s gone nuts and trying to break away.
When a taser is used to shoot someone from the neck up that is 100% deadly force which is what Brooks did.

Well he was in the driver seat and no one had come to get him in the time it took for someone to notice, call police, and police to get him.
Society was dealt a generous favour, with his demise, plain and simple.

@@christerry1773 No. The full video is public. One officer kicks the taser away from Brooks and briefly puts his foot on his shoulder. There was no kick.

It's supposed to be from the cell phone video of one of the guys in the drive-through line, but as far as I can tell it hadn't been released previously. I'd love to see it myself so I'm not relying on the special prosecutor or the prior DA for their take on it.
