Dude, i gotta say that when my car got towed, i had a case with about 40 switch games in it (valued between $20 and $70 a piece). Of course, the tow company just stole them. That's $2000 or so...
If i could have backed up my games, i totally would have. I wouldn't have been carrying around $2000...
As a member of the Nintendo developer program, there is NO WAY i would pirate Nintendo Switch games that i hadn't paid for... (or any current generation video game)

Well yeah. That is kind of how the law and the court systems tend to work in normal modern-day civilized countries (ie., not Russia or North Korea, etc.). A prosecutor must prove that the defendant had somehow harmed the "victim" in some way. If there is no "victim" (in other words no harm to anyone), then there cannot be a lawsuit.

Under the DMCA, we're allowed to make backup copies of the games we purchase. If the defendants lawyers are smart, they'd argue that having the right to create a backup of a game without circumvention devices to enable the backup is the equivalent to selling a firearm without the bullets. I mean, SCOTUS has already ruled that a right is useless without everything being able to exercise it (thinking about when Cali tried to limit ammo). The DMCA definitely need an update. Leaving it up to the courts is a terrible way to govern.
The disc cases have a proof of purchase label on them don't they? I'd say I should be allowed to replace/backup my scratched disc since I have proof of purchase
@@slarbiter Exactly. That's the whole reason we have that law to begin with. These companies wield encryption like it's a shield against even legal backups, and I believe that was never the intent of the law. I believe the DMCA needs to be reviewed about ever 5 years and updated for the times. Those who framed it would never have thought it would be used as a way to prevent private citizens from making legal backups, but here we are. The language is too ambiguous and leaves too much to interpret, which was the 90's short sightedness of said framers.

No store in the world would allow someone to just go in their store and steal stuff, i agree with you copies should be allowed to be made, but this is currently complicated because it will be abused
The saddest part is that Nintendo gave an exit option before dropping the hammer and it wasn't taken. At that point one has to blame themselves, especially when there is already proof of what Nintendo does to people in the court system when the exit option isn't taken.

As much as I can't stand Nintendo I do agree that they were being reasonable in this situation.
I hate to say it, but I also agree. I would have had a huge panic attack, signed everything and disappeared. But i know what this guy was thinking because I was in his shoes once: He invested a lot of time and money, the profits were pouring in, he was going to be rich and couldn't stop. I still mod consoles, but I don't mess with the switch, not publicly anyway.
@@ocstrangeness I'm trying to learn micro soldering myself to mod my own hardware too. It is getting hard to find switch modders and I honestly prefer it be that way rather than for modders to put themselves at risk of being sued by Nintendo. If I wanted to mod my switch badly enough I would either get an unpatched v1 or learn to do it myself, even though I know that it is a very tricky solder job to do. Frankly though I much prefer emulating it on my ROG Ally or Steam Deck at least for the time being.
@@GreenLeefMusic It's always nice to see somebody interested in learning. I use the Hakko fx-650 with the t34 tip, it's only 15w and about as safe as it gets. So, try that? I work on switches but it's too dangerous to advertise because I don't want to end up paying fines, so my experience with it is limited. You don't want me to do it because I'll probably mess it up. The patched v1/v2s are the easiest, only a couple of points. I do advertise the GameCube and never had any complaints, but my favorites are the PS2 and the 360.
I considered getting a Mig Switch dumper just to back-up my legally purchased physical game cards, with every intention to keep my physical cartridges. Unfortunately, I could see some people selling off their physical games causing others to get their consoles inadvertently banned.
In that situation both consoles would be banned. The one running the original cartridge, and the one running the mig cartridge.

When are these modders going to figure out that they need to make the security circumvention tool and directions so that the user is the one circumventing the security either one time (as sort of a security check scrubber/remover or even a side stepper) or anytime the software is run, rather than building it into their own emulating or device. That, along with making a profit on stolen software is what makes it so easy to go after these guys
Thats the issue. They only won the yuzu case because they had links to lockpick on their site. The other emus dont so that are thriving. The mig on the other hand was special since it actually USED the switch itself to play them similar to an r4. It still allows folks to just go find a rom and load it up on non modded switches and play em. It will be hard to prove it in court since the mig switch relies on folks to already have their own dumped roms or otherwise to actually use it. It cant work on its own.

I know the Migswitch is a red flag for Nintendo but the situation is kind of ridiculous. Basically it's like every time you buy a Nintendo product, 90% of the price is for the game itself an the rest 10% is for funding their lawyers.

I’m not sure how true it is. But I heard if someone copy’s a game to their switch using the mig, and then sells you the physical game. If you attempt to play it, your account will get banned.
Both accounts will probably be banned. The way the mig works is it copies all the unique identifiers and keys instead of circumventing those keys.
I believe there is a risk of that happening.
If both players try to play the game plus a copy of the game simultaneously, then Nintendo would have reason to ban, but without that the players would probably be indistinguishable from friends passing a legit cartridge back and forth barring close analysis of the players' geography and logistics of exchanging, etc.
MiG switch is for use of your own backup and play. Its not a good tool for piracy, infact older methods are better for. Mig switch is to legally play a backup of your own cart.
It won't matter anymore in the distant future when the online servers go down. At that point, banned consoles and non banned consoles will be on an equal playing field. So, the mig could prove useful after Switch is no longer supported.

The MIG Switch can't be sold with games on it. It pulls a special certificate on your game, which makes it impossible to give to your friend. It won't register it.

Well call it bad luck, nintendo would sue anybody even if they didn’t download their games I would definitely say that it’s always been about money power control it’s not about the customers the only reason Nintendo does what they do is to make money but deep down their professionalism is fake, Japan has a lot of corrupted companies and they enslave their own people for money control and power.
The only thing that the MIG Switch may protect it is the reader/writer by DMCA law you are aloud to make 1 backup copy for YOUR OWN usage that includes the pc software. That was the same reason copies of cds/dvds were legal

Modchip installer here: This is why i don't advertise N's products on etsy. The first warning would have given me a heart attack. The most i may or may not have sold would have hypothetically been loaded R4 cards, even that made me nervous.

It really depends I guess... seems like a lot of times they will settle... the first dude may have pissed them off with agreeing to stop but continuing and ignoring them giving him chances... so who knows for sure. Doubtful whatever they sue for these guys will be able to pay... I do think a lot of times these lawsuits are to make an example out of people... we will see.

It's not very good. Can't install updates, you have to eject it every time to cycle through your games, and it's kinda expensive. Just look for an unmodded v1, if you can't solder. Found mine at a pawn shop for $130 and threw a 1tb sd card in it. Still has 300gb free, I'm working on that.

Should be completely legal to make copies of your own games. Period. Even in the US. Nintendo has lost before, and they need a few more so they understand that when a customer buys something, they can do as they wish with it. The mig switch was said to back up your own library. I see no issues. The hardware modding is the same. I will mod what I want or buy a service if I want to get it done. Can it be used for bad? Yes, but you can't prove motives or see the future. Unless Nintendo can actually prove the loss of money with hard facts during all their profits (which they couldn't), then I think the whole thing should be thrown out. The signing of the paperwork was probably not the best idea if you were planning on fighting.
Theres no law on the books that says you cant. You cant sell unauthorized copies. Get a clue

Nintendo had a lawsuit against the game genie. It was discovered that the altered code that the game genie does, makes the game a different product. Sounds very similar to that. Something about fair use.

I got my MIG Switch from Modded Hardware and when it finally came in the mail I sold it on eBay! for what I paid because I didn’t want to get banned from Nintendo but after I sold it eBay delisted my sold MIG Switch saying Nintendo said it violated there piracy policy 😂
Didn't you read the documents? THEY have your mig switch now. But there's nothing illegal about buying a modchip, so don't worry. Same reason it's not a crime to download pirated movies, it's the uploading part that gets them in trouble.

I would love to see someone create an independent gaming platform not tied to big corporations (PC is closet thing right now), and with new PC handhelds getting closer to but I would love to see a handheld android based gaming machine (what switch pretty much is) but with an open ecosystem and see if can get developers from IOs, Switch etc to move catalogs over. Tremendous number of games are coming from small developers that if a platform existed and the profit split was advantageous many probably would. I know of a lot of gamers who have switched to pc gaming who are just tired of even remakes and updates being 50+ dollars. Yet they purchase tons of games in the 5-15 dollar range, I get it for true triple A games, but those are the exception. My next handheld system I purchase is not going to be made by one of the big boys. Retro handhelds and handheld gaming machines are selling in droves and there is a reason beyond nostalgia.

Imagine if Nintendo spent this time and money on making their own FPGA console that would play all their old carts, but also their own proprietary roms you could buy at a reasonable price. Most of the piracy scene would be under cut real quick. ... But nope... Spend millions on legal battles instead.

Because at this point Nintendo has spare money to pay for copyrights for specific games to be dumped onto the FPGA console to play every game in existence. But at the same time they're no different from Sony, Sega, or Microsoft because they care about profits over consumers, so we have to step up to the mantle and archive whatever is necessary on the current hardware AND past hardware. This is basically the consumers fighting against Nintendo that literally acts like North Korea & China Dictators to us.

I think people should not mess with other peoples products, but at the same time nintendo is missing big on the retro market. If they remake old consoles to play old games in modern hardware I would definately buy them. Thanks to the analogue consoles I have been able to replay all my old games that I still own to this day. Love your content. Good to learn about lawsuits and how this thing in the end is just buisness.

Watched the whole thing for ya. I'm really just glad I don't have to be the judge on this one. I agree with both sides to an extent, but more with Nintendo's side. It is their properties. I just wish Nintendo would do more to allow us to pay for the games we want to play and that would eliminate 90% of Roms being downloaded and also make them money. But I thought it was nice of Nintendo to just tell them "stop, and we'll just call it good" and then look what he did... not too bright. Now he's got a ton of bricks dropped on his head!
