    EDIT: The grade issued to the officer is a means to highlight the fact that the law may be flawed. As I said in the editorial section of this episode, the officer followed the law as it is written, and that alludes to grander problems within Florida's legislation. The real issue here is the language of the law, not the conduct of the officer (in regards to Florida's fleeing statute).

      I would respectfully disagree with your assertion that the law states one must immediately stop. I understand that the case law leans in this direction (at least in fla), but finding a better location has been used (not sure what states) as a successful defense from fleeing charges. The subject also did a pretty good job at communicating that decision.
      I have never spoken in your comments section b4 because i primarily come to learn legal interpretation, and i rarely disagree with your assertions. I love this channel, thanks for all your hard work and research.

      If you don’t pull over right way, of course they would pull a gun on you. They don’t know why you’re fleeing. You could be an armed felon. The cop tells him the reason for pulling him over which is what he’s supposed to do. You sound very uneducated.

      Hey either individual with vision or inability to process thought issues, he pulled the gun because the motorist kept driving for 1 minute with blue lights on. If 1 minute is too much time is disputable but that is the reason... I dont expect you to understand that concept but I do expect you to seek out help.

      @@MTFL007 It's far easier to judge the officer negatively after the incident. However, as you said, in the moment the unidentified driver was "fleeing" from the police. Fleeing isn't something an innocent person does. That is why the officer expected the worse. i.e. he wouldn't be having dinner with his wife and kids.

      May we politely suggest the following de-escalation for remedy?
      THE TRUST IS COLLAPSED....in other words, your company is no longer granting them any more credit.
      If the policeman is not lawfully investigating the crime on behalf of the male/female victim and is entering YOUR company jurisdiction without you summonsing them, then would it not be advisable to be politely placing YOUR public-servants/trustees under your notification that your company is charging $707 per hour/part-there-of for YOUR company time and also $717 for YOUR company performance?....and that any further communicating (verbal) and/ or corresponding (written) with your company, is with them accepting the terms & conditions of the commercial contract IN THE PRIVATE (the cop and their CHIEF and their POLICE UNION is now with PERSONAL liability.... because Notice-to-Agent-is-Notice-to-Principal....and also through JOINDER....and they also lose their qualified immunity)
      This way, you are NOT resisting/refusing to obey/comply with their orders/demands/policy /questions, but instead, you are now willing to perform WITH THE CONDITION that payment is with your company immediately, because you have NO CONFIDENCE with them administrating YOUR company trust!
      THE PUBLIC TRUST IS COLLAPSED...Why is YOUR company issuing them extra credit! Are YOU not the executor and the beneficiary of YOUR trust?...making them the trustees, whom are with their fiduciary obligation and duty-of-care to be NOT causing you injury nor damage nor loss nor harm.
      Is THEIR job YOUR job? Is THEIR company policy YOUR company policy?
      not unless and until they are PAYING for your company time & performance
      THE CONSTRUCTIVE TRUST IS COLLAPSED...YOUR company is no longer performing free-of-charge!
      You may be willing to pursue the matter through the small-claims-court and/or through arbitration which is held in-the-private because PUBLIC court is only for the PUBLIC servant.
      YOUR TRUST FUND IS NOW WITH RESTORATION....YOUR company is now making money from every encounter with YOUR public-servants because the days of doing something with your trustees for free are over.
      PS-Be the BUSINESS man with the public-servants.......NOT the victim.

      @@wb1291 The only time a cop should unholster their gun is when there is an imminent lethal threat. The only time they should point their gun at another human being is right before they pull the trigger. The amount of times I've seen US cops pointing their guns at other people willy nilly, when there was no reasonable threat, much less an imminent lethal threat is crazy. There is no excuse for it. If a cop is at the point where they're so terrified from prior experiences that they start pulling out their gun and pointing it at people at unreasonable times, they need to have their badge taken.

      Wrong. Police have to deduce your future actions by the actions alread witnessed and they do this with great caution for their own safety. It happens quite often that cops get shot at by people who have no reason and the cops know that. So if somebody does not pull over it can mean that they are trying to get away - that can indicate that they might be up to no good. A cop cannot read your mind. Follow the instructions.

      So true deb, most citizens need to know that cops are just REGULAR men and women off the streets put on the force with no type of training and nor type of understanding of the basic laws.
      That is why we see so many videos on yt because it seems the chief in every department in every state don't give a chit about their tyrants knowing the law and just rather have them go wild on innocent citizens as in beat, harass, intimidate and be overly agressive. 🤷🏼‍♂️

    When seatbelts laws were first enacted, the government said they would NOT be the sole reason for a traffic stop. That didn't last long. It's now used as revenue enhancement.

      In Virginia, a driver cannot be pulled over for not wearing a seatbelt. If the driver is not wearing a seatbelt while pulled over for an actual infraction, the seatbelt issue can become a citation.

    This happened to me in the 90s before bodycams & cell phones. I was pulled over a half mile from my house, we lived in the country at the time. There were no other houses for miles. I decided to keep driving until I got home like i mentioned earlier it was approximately a half mile. I turned on my hazard lights & kept my speed steady. The second I turned into my drive, the officer litterally jumped out of his car before it even came to a complete stop. He preceeded on going ballistic he started cussing me calling me names & and saying the only places woman should be aloud was the kitchen & bedroom. Then, he proceeded searching me made me shake out my bra & hold it out so he could see my breast. I was scared to death, horrified & humiliated. He put me in hand cuffs & leaned into my body for like 5 minutes it fealt like a lifetime. He told me repeatably he was arresting me for fleeing & i was going to love, love, jail. I started crying & he told me to dry my tears or he would give me somthing to cry about. I seriously thought he was going to rape & kill me that day.. While he was searching my car my husband & brother pulled up. My brother saw me crying & ask me what happend. My husband ask the officer what happened & if he had a warrant to search my vehicle he told my husband he was not searching & that he was simply retreaving my registration...! To tie this up...! After my husband arrived & started questioning him he decided to let me go with a warning. He unhanscuffed me & left. The next time I saw him was in court when i decided to sue him. After the city lost the lawsuit the officer eventually resigned from the department. I received a settlement for $69,000 after attorney fees ect...! After my ordeal I decided to return to college. I received my Bachelors degree in criminal justice & 9 years later, I received my Masters degree in Psychology with a minor in criminal Psychology...! I didnt drive for 2 years after this ordeal & even when i did start driving again i was terrified eveytime I saw an officer.. Something like this does something to a person. It scares them & takes away their since of security & trust...! Unfortunately not alot has changed since ny ordeal, we now have better technology, but police misconduct is still a major problem to this very day...!!!

      Pulled out a gun and detained because he fled from a police officer. The police officer had no idea who the driver was or whether the driver had a weapon stashed within reach of the driver's seat. Innocent people do NOT flee from the police.

    You know what these types of incidents cause. They cause depression, anxiety at the thought of stepping outside of your front door and great mistrust of all public officers. It happened with me and not a day goes by where I don't think of that interaction. It scars you and is imprinted on your brain.

    What is really disturbing to me is that this almost NEVER happens in high income neighborhoods. I have lived in both. When I lived in a low income neighborhood, cops were like nazi militia. Upon moving to higher income neighborhoods, cops are like "your best friend" and you tend to know the one cop by name and have spoken to them a few times, always friendly encounters.

    Had a cop pull me over using a bogus "no seatbelt" accusation. I was wearing it the whole time. He said I must have put it on after I pulled over. I gave him my ID and insurance (which he didn't even bother to check) and told him to just write the citation so I could disprove it in court. He asked how I was going to do that because the courts "always take the cop's word". This is when I pointed to the dash cam with the driver view (it was new tech at the time) that had been recording for the last hour. I told him if he tickets me, I'll be admitting it and this conversation into evidence. He gave me back my ID and insurance and told me I was free to go. He didn't even apologize.

    I was pulled over for speeding twice and unbuckled my seatbelt to reach in my glovebox to get my registration and insurance since I knew I’d have to give it to the officer. I got an additional ticket both times for “not wearing a seatbelt” when both times I had it on but the officers claimed I wasn’t wearing it since it wasn’t on when they walked up to my car. Both times I told them I just unbuckled it to get my registration and both said, “That’s what everybody says”. After the second time I realized that was a sneaky and trifling tactic they use to give out extra tickets and make more money for the city. So, just a word of advice, keep your seatbelt on through the entire stop.

      I had a state cop threaten to have my car towed for running from them....bear in mind I was pulled over by a city cop at the time. You can imagine how well they took it when I pointed out we wouldn’t be talking if I had ran from them. Naturally I was being “hostile” which became reasonable suspicion to search my car.

    This is so sad. It's freaky when the thin blue line pulls this crap. To arrest and/or put people in these situations for little to no wrongdoing is egregious! It should be a relatively big crime (one with a victim) to arrest someone and put them in a cage, but to put people through these traumatic situations, such as in this situation because the guy didn't pull over fast enough (he wasn't speeding away or trying to evade) is abusing your authority and abusing the grounds for arresting someone.

      That is not why the weapon was drawn. It was drawn because the motorist did not immediately stop as required by law, and was therefore fleeing, which is a felony in Florida. Standard procedure for a felony stop is to approach with weapon drawn.

    Atwater v. Lago Vista here in Texas was where a woman had her kids in the car and one of her kids dropped some kind of toy out the open window in a residential section, and so she turned around and was slow-rolling back through to see if she could spot the toy, and had her seatbelt off, and the cop "caught" her and eventually arrested her. She LOST after spending over $100,000 on lawyers arguing up the WRONG arguments. The two supreme court cases of MEYER v. NEBRASKA and NEBBIA v. NEW YORK hold that we have the RIGHT TO BE FREE from Bodily Restraint, until and unless we have either been CONVICTED of a jailable misdemeanor or felony, and until and unless we have been ADJUDICATED mentally unable to care for ourselves or are harmful to others yet not culpable, and thus have to be committed to a mental institution. OTHER THAN THAT, we have the right to be free from bodily restraint. Period. End of story. But the cops are NOT taught these rulings.

    I got accused of fleeing once. I was 18 or 19, and I got pulled over for speeding. The trooper was driving a mostly unmarked camero back when they drove those.
    I drove up beside him thinking that was a nice camero and nothing else. There was traffic all around. He got on my tail and i thought he was going to drive through me. So i was going to get over as soon as i could so he could pass me (thinking this was a regular person in a hurry).
    Finally, he sounds his siren and i realize he is a cop/trooper. He didnt have lights on top and the car was mostly unmarked. But he wrote it up like i was trying to flee his camero at 60mph in my sedan.
    I always wished i could have asked him in his mind what he thought my plan was to escape his much much faster car while traveling the same speed i had been travelling before. And i also wished i could have asked him why did his car not have lights on top and was barely marked at all? Maybe its design worked. Im much older now but still think about that from time to time and wish i had argued it instead of just paying it. Im sure its the kind of thing i could never have worn then because i was young and he was older so why would a judge have believed me.

      That’s going to be a disputed fact in the Section 1983 action. It is possible that he was wearing it the entire time and it it is also possible that he buckled it after he saw the sirens. That it is disputed generally helps the reasonable suspicion for the stop to not qualify for a determination of qualified immunity on that particular cause of action (4th Amendment Detainment). However the fleeing statute kind of raises the possibility of qualified immunity or even simply a dismissal on that cause of action since the officer then had reasonable suspicion for the stop and as the statute and litigation of the statute is described in this video that’s going difficult for the plaintiff to challenge a qualified immunity defense. The search of the vehicle is more problematic. Personally I think they should have ticketed him for fleeing and impounded the car and gotten his documents during the inventory. I think the search is the only thing that will survive summary judgment in the sense that was most likely an unlawful search.

      May we politely suggest the following de-escalation for remedy?
      THE TRUST IS COLLAPSED....in other words, your company is no longer granting them any more credit.

Many times this channel has stated that an officer's attitude and interaction as contributing factors in the grade they were given. So, you are mistaken when you say grades are only based on how well the law and procedure was followed. Racism displayed by any cop is an automatic F.     I heard about one case in Florida where a driver slammed on his brakes as soon as a marked police car activated lights and the officer rear-ended the car causing the driver to need medical attention. When it went to court the driver stated that he "only followed the law as written" and was awarded damages for his car and medical.

    The sad thing about this is there are apps (that all police officers should have) that tell precisely who owns what property. If these officers are concerned about the businesses, they or their office should make it a point to know who owns them. It is clear these officers didn't want to back down from the confrontation but were looking for a way out that didn't show weakness... the stranger was their ticket.

    I got pulled over for doing a rolling stop about 3 years ago. Didn't see the officer's lights because my car's back window is small and I was unfortunately suffering from some slight sleep deprivation that morning. He didn't have his weapon drawn but he had his gun unholstered and his hand on it when he approached. I had NO idea he was behind me until he activated his siren. Wrote me the biggest ticket he could and called for 3 cars of backup. I was scared out of my mind. I tried fighting it in court, hoping the prosecutor would give me a deal for a lesser charge but they wanted to stick it to me and it took forever for the points to fall off. They really go on a power trip if you fail to pull over right away.

I would say the entire stop was unjustified. Before you tell me this is unlikely. I have on no less than 3 occasions been pulled over for not having a seatbelt on even though I did. Each time I was wearing dark clothing and it was in full daylight. Officers make mistakes and it is up to the officer to not commit perjury to justify their actions.

      In the military: we are taught the "Deadly Force Triangle" since more than likely we will have to do armed watches at entry points, pier security, topside rover, etc.
      We also run drills about once or twice a week where the deadly force triangle and levels are explained to us. We simulate armed intruder, forced entry, suspicious package, etc. And believe it or not, most often, people don't unholster their (wooden) weapons for these drills. Because it doesn't meant the requirements for the Deadly Force Triangle.
      We are given such a strict mindset of when it is ok to draw your weapon. We are told that once you draw your weapon, you intend to use it. You point your weapon, you intend to use it. There are no warning shots, it is a matter of life and death, the protection of self and others, or a danger to the public.
      And it's just horrifying that law enforcement don't seem to get that. In fact, it seems like they are taught that going for your weapon and pointing it at someone is your first option while still giving verbal commands.
      Any person with basic firearm experience and safety knows that's a bad fucking idea.
      They brandish their weapon with such carelessness that it makes me think no officer should ever be armed with a deadly weapon because they are just looking for a reason to use it.

      Same thing happen to me in SOBE ( south bch ) in Miami . The lit me up on 7th and Ocean drive and was surprise that I did not "pull" over immediately. Anybody who does not know ocean drive, your not pulling over anywhere with a big truck on ocean drive at a 8pm Saturday night.
      I had 7 cop respond by cars, bike and on foot.

      The guy drove for at least a whole minute before stopping. If it is unsafe to stop there, the police officer has a PA and can instruct you to pull into the next parking lot/side street. Fleeing, by definition, is moving away from someone or something. So if you are signaled by police, signal your turn and slow to a stop within 200 ft.

      I drove for 60 seconds while the cops tried to pull me over to get to a safer spot since we were in rush hour traffic on the main road. I actually had 3 of them by the time I made it to where I stopped. I at least slowed down and used my hazard lights to acknowledge the cops. I also didn't try opening my door like this idiot driver, I rolled down my windows, and I kept my hands on the wheel so the officers could see them. The cop was pissed at me for continuing to drive but let me go with a warning since I did everything else right.

      I've seen no statute that suggests you must only pull over once you personally feel safe to do so. It would be unreasonable to write that into a statute, too. Every person fleeing/eluding would attempt that defense, but that's not even the main issue with it. The main issue is that the court cannot reasonably measure whether you felt safe. They could measure whether a reasonable person would feel safe potentially, but that still likely wouldn't absolve Mr. Black of what he did. I'm saying this as someone who, at least morally speaking, finds it justifiable what Mr. Black did, according to his own reasoning.

      Gun was pulled for fleeing, not for a seatbelt. When cops engage in a pursuit, they are trained to stop the vehicle under a gun point because there is a high probability of a weapon being inside of a car. The speed of a vehicle is NOT important. I know it looks stupid, but if the guy had a gun, it wouldn't look stupid. Cops were actually very polite and professional during this interaction, I've watched the whole body-cam footage as well, you can find it somewhere.
      I don't know how many of these videos you've watched, but the editors would never give the officer that high of a mark for gun being pulled, unless it was completely lawful in that situation.

      The cop put his lights on, but Mr. Black didn't stop right away and kept driving for a good min. Any cop can think "may be he hid something illegal away". I don't even think that's racial profiling. That's more than a reasonable suspicion to have. A lot of drug busts or DUIs happen with a broken tail light or failure to stop at a stop sign.

    You do not have to stop for a cop in any place that is not safe or that will obstruct traffic or otherwise be unsafe for either you or the officer. I just got pulled over a few days ago. I put on my turn signal, turned left onto a side street, and then into a business parking lot. At no time did the officer act like I was "fleeing". I live in Florida. As long as you do not speed up or act in any way that you are trying to evade the officer you can not be charged with evasion or fleeing.

      If the driver started opening the door without being told to do so then it was totally justified. We'll never know since the audio didn't start until after he started opening the door. Had he sat in his seat with his hands at 10&2 on the steering wheel then this probably would have been a relatively chill stop.

    Officer said he pulled him over for not wearing a seatbelt, gun drawn, orders him out, and you can clearly see and hear the driver tell the officer he has his seatbelt on and watch him undo it to get out of the car and he gets a B? You missed this one by a mile.

Black people are abused at a disproportionately low rate compared to their level of crime. It is a simple case of people with little to no training being given absolute power over other people and using it to satisfy their own egos

      This is why i tell by black brothers to remain calm and in control when dealing with cops, Even when you are in the right. Know your rights, state them assertively and confidently but not aggressively. And after all of that if a police still wanna fuq up at his job, let him. Why are you stopping him? It’s your duty to let him fuq up. Just make sure to get it on camera and sue him in court.

    Simple solution: as soon as the lights flash on, slam on your breaks with all your strength, then after they smash into you, sue the officer for following at an unsafe distance, and causing whiplash...they can't defend against this, because they should have reasonably expected the vehicle to stop immediately after they turned on their lights.
