As a retired lawyer who practiced international divorce I can tell you that the US and the UK are members of the Hague Treaty concerning child custody and abduction. The court that has jurisdiction over the children is in the place where the children are habitually resident. Therefore, if the couple declared their residence in the UK then the UK courts have jurisdiction no matter what a FL court says. The problem here is that most courts dealing with custody don't have any idea what the treaty requires. It was reported that Sophie has the children and Jonas won't turn over their passports.
exactly.... florida law does not supercede federal or international law. but they also have an educational problem anyhow.... so it is important to get those kids out of florida

Seems like in the last 6 months they weren't established ANYWHERE. They moved to England in April. Finally got a rental in May. Joe took the kids on tour with him in August. Now she wants them with her in September. Its going to take a judge's own ruling to decide where they need to live.

what is interesting is that no one considers what kind of individual would set up a smear campaign against their former partner. no one considered what kind of individual would blindside the other partner on their breakup on the public stage. I really hope that more education on abusive relationships comes to light so that people like poor Sophie will not continue to get blasted from multiple sides: from her estranged ex and from the media/public opinion. Kudoes to Taylor Swift for being a support for Sophie in this difficult time.
Especially when they know their children will eventually see this online.

So lemme get this straight... Joe and Sophie were looking for a house in the UK. They'd been living there and renting a home for months and had a realtor. There effectively resided in the UK. Joe offers to take the kids with him while she's filming (false pretenses), then makes a bee-line for Florida (which just happens to have passed brand new divorce legislation), files surprise divorce papers over a holiday weekend (and the court documents do show that she wasn't served with the papers until after it had made the news), and had a judge declare that the kids can't leave the state DESPITE the fact that they were living in the UK. He refuses to hand over the passports. She can't take them to the home that they've known for several months now. His team then starts a smear campaign while he's taking publicity shots with the kids in a known pap photo location. I'll also mention that Joe has a history of messy breakups... The infamous Ring camera footage hasn't been released. He hasn't even specified what was supposedly on that footage.
This, quite frankly, was obviously calculated and has Kelly Rutherford 2.0 written all over it.
I believe the international treaty supercedes Florida law in this case

The main residence isn’t clearly defined in the case as the children haven’t spent 6 months in any location consecutively.

Not only that, but the kids weren't in FL when he filed, and they aren't there now. They're in NY with her. There might also be a problem with service unless he waited for her to return to the States to serve her.

She filed a court doc to get access to her children after she met up with Jo to get the kids (as was their plan pre divorce papers) and he handed over the kids sans passports.

This really sucks because I loved the sisterhood between the Jonas wives... I didn't like the smear campaign against Sophie because it was only Joe's version. And we didn't hear her version until she filed court papers about a week later.
It was fake the whole time. Honey get some life experience and you’ll see through those lies.
My boyfriend of 4yrs left to go to work one morning and never came home. There was no fight, there was no discussion… In fact, he was intimate with me the morning that he left to go to work. And we had talked about what I was cooking for dinner. When he did not come home I texted and called. He kept pretending that he was stuck at work and would probably have to spend the night there because he was just too tired to come home. None of it sounded right, and obviously red flags went up immediately. I kept calling, and he would not answer. I later found out he was not even at work. When I finally got a hold of him, he was angry and aggressive and gaslighting me. I was completely blindsided. I had no idea what was going on. we had just signed a lease together. I cannot afford this apartment on my own. I later learned that he had quit his job and he moved to another state. All of this was calculated and I have no idea. I’m glad there were no children involved. But even after four years, the pain is so deep because I thought he was my best friend.

I have friends going through a divorce and their ability to be amicable is incredible. They’re easily the best divorced couple I know. If you’re going through a divorce, especially with kids, it’s the goal, but it’s rare to see it happen.

The children are the number 1 priority! I had the benefit of parents with an exceptional, loving and happy relationship. I was not so lucky when I married, and it was very clear when my children were quite young. 1 and 3 years old. I was devastated my kids wouldn't have the same loving relationship to grow up with. Though there was much animosity between my husband and myself, we put it aside for the sake of our babies. We promised each other to save our complaints to share with our friends and never our kids. We were both good about keeping that promise. We divorced while the kids were still tiny so they don't remember us ever being together. I often wonder how we pulled it off as we were quite young. (Early 20's) But we did it! And our families,to their credit, went along with our wishes. We avoided so much angst to the benefit of our kids. Children should never be put in the position of choosing sides or being pawns. Choose a healthy atmosphere for your little ones as much as possible. ❤ They will thank you for it.

I truly feel sorry for their daughters. Even tho they're very young, I'm sure they can sense that something is amiss, and going back & forth between mummy & daddy is usually not a stable way to be brought up. It's not like Joe can't see the kids if they move to the UK.

Children deserve equal time with Both parents. How can we draft up a 50/50 schedule that works for everyone involved? It will save so much $$ if they work together to creatively think about what could a 50/50 schedule look like for them? Keeping the kids at the forefront. Putting all personal issues on the shelf for a moment. The kids will benefit most if these two parents can figure out how to co-parent.

Like when they're happy, they have kids and their kids become the "crystallization of their love". When they're unhappy, they get divorced, their kids become bargaining chips. Come on now. You shouldn't have kids with someone if, in the event things go sour, your number one priority becomes how to best spite your ex instead of trying to make sure your kids can adapt to their new reality as quickly and as painlessly as possible. Like put aside your ego and hurt feelings and do what's best for your kids.

Sophie has been filming in the Uk for months & left her kids with Joe . Joe is touring and taking care of the kids. My question is if Sophie’s family live in the UK & she’s working in the UK why didn’t Sophie split the time with her kids why did she leave them the entire time Joe was on tour? Especially as a mom I would never leave my 14 month old kid for that amount of time.

Custody battles can last years. Custody isn't even determined until divorce is finalized, and divorce can take years. They might be 10 by the time this is done considering how messy it already is.

I know that generally one parent cannot take a child out of the US if the other parent does not consent if both parents share custody of the child. I am not sure how it works if the child in question has dual citizenship and they are being brought to the other country where they are a citizen of. So, even if he didn't withhold the passports and gave the passports to her, would she be able to take their daughters out of the country if he didn't consent to the actual leaving the country?
They do have duel citizenship but he has the passports and won't hand them over. This is gonna become a huge international thing between American Law & British Law.
@@bellereinette2938 it won't. Every legal analyst has said her filing is BS. The Hague statute doesn't apply in this case because they haven't lived in the UK for 6 months or more. They were there in April and were planning to buy a house, but then came back to the USA with their father while he was on tour. As long as they haven't lived in the UK for 6 consecutive months, it cannot be considered their habitual residence. And if it is not their habitual residence, then stopping them from going there is not abduction.

Please note that one of the lawyers here peddled speculation about "something that was seen or heard on a ring camera". That should tell you that their analysis is not based on legal fact but more on entertainment. At no point did Sunny claim to be sharing a legal opinion on the issue. But if you watch the ABC News coverage, they actually brought in a legal expert to explain the Hague statute and whether Joe is in violation. Spoiler alert: he is not. They also explained that Joe is not barring the children from going to the UK. He is okay with them living in both countries AFTER they reach a custody agreement. It is the Florida court that is preventing the kids from leaving the country. Even if she had the passports, she won't be allowed to travel with them as per the court order.

The abduction bit is a legal term, it doesnt have to mean you are kidknapping and holding them hostage... it could mean that the chikdren are not currently where they had been agreed to live/had been living. So trying to say that calling it abduction is "overstepping" is just trying to make Sophie look bad, when technically that is what is happening according to Law.
Hardly moved to the uk in 3 months and settled in that time. Plus all ive seen is hate for joe not sophie. We dont know whats going on behind closed doors and we shouldnt be playing kangaroo court
