Can 138 notice be sent after 30 days?
Complaint case under Section 138 N.I. Act must be filed within 30 days from expiry of notice period. Such reckoning would be without prejudice to the right of the drawer of the cheque to show that he had no knowledge that the notice was brought to his address or previous address.
How serious is cheque bounce case?
In India, a person issuing a cheque will be committing a criminal offence if the cheque is dishonoured (cheque bounce) for insufficiency of funds. Cheque bounce offence is punishable with imprisonment for a term up to two years or with a fine twice the amount of the cheque or both.

@@priyankdhimole priyank ji mene ek party pe case kiya hai uska 8 lakhs ka cheque return hua hai , case 6 mahine se chal raha hai or usse mujhe aab tak 4 lakh diye hai 2 vari 2 2 karke , aab voh mujhese or 6 mahine mangraha hai toh mene mana kiya or case chalvaya , aab uska vakil esa bolta hai ki cheque apradhi ne nahi bheja hai judge ke samakas or judge ne kaha phir inke pass cheque kaha se aya or apradhi se 4 lakh kese diye, aab sir mera aapse ye sawal hai ki voh prove kese karega ki usne nahi bheja hai cheque or judgement stage kab aayega.
Kamal Ji, सुप्रीम कोर्ट का साफ कहना की किसी व्यक्ति का चेक किसी के पास आया है तो इसका मतलब लेन देन हुआ है, यदि चेक जारी नहीं किया तो आपके पास कैसे आगया, तो वो कभी प्रूफ नहीं कर पाएगा, वो बस एक ही सहारा ले सकता है कि चेक बुक गुम हो गई थी, आपको चेक बुक मिल गई और आपने फर्जी साइन करके चेक का दुरुपयोग किया है, लेकिन कोर्ट इस बात को भी नहीं मानेगी, क्योंकि यदि चेक बुक गुम भी हो गई थी तो उसने शिकायत क्यों नहीं की इसकी बैंक में या थाने में। तो आप बिल्कुल निश्चिंत रहें, आपको आपकी राशि मिलकर ही रहेगी। यदि वो नहीं भी देता है तो उसको जेल भी होगी, और कोर्ट उसकी संपत्ति कुर्क करके आपको आपका पैसा देगी। हां रही जजमेंट की बात, तो इसमें केस दर्ज होने से 1 साल या कई बार 4 साल तक का समय लग जाता है। मेरे पास ऐसे कई केस हैं चेक बाउंस के जिन्हें 3 साल से ऊपर तक का समय हो गया है। हालांकि समय लगता है लेकिन इंसाफ होता ही है।

न्याय विभाग या मंत्रालय ऐसे ही कानून बनाता है जिससे वकीलों कर्मचारियो,आदि का रोजगार बना रहे ।वरना यदि चैक खुद अपने हाथ से भरा गया है वह भी लिखित अग्रीमेंट के साथ,फिर बाऊन्स होता है तो तुरंत सजा या जुर्माना होना चाहिए ।पर यहाँ तो तारीख पर तारीख पर तारीख पर तारीख पर तारीख पर तारीख पर तारीख,तीन साल तो मुझे हो गए ।
तीन-चार साल मुझे भी हो गए 🙏

आप ये बोल रहे है की आपने चेक लिया है और एग्रीमेंट किया है, लेकिन जिसने चेक दिया है वो बोलता है कि चेक गलत तरीके से आपने लिया है, तब चेक लेने वाला सही है या चेक देने वाला सही कह रहा है, इसके लिए ट्रायल करना जरूरी होता है, लेकिन ट्रायल चलने में टाइम लगता है....
@@viveksolanki98 चैक एक बार नहीं तीन तीन महीने के बाद तीन बार चैक दिये हैं मजबूरी बताकर समय माँगकर ।चैक पूर्ण रूप से उसके ही hand writing में लिखे हुए हैं यहाँ तक कि date भी,साथ ही स्टाम्प पेपर पर वचन पत्र भी उसके ही hand writing में लिखा है ।तीसरी बार चैक बाऊन्स कराकर केस करना पड़ा कुछ गलत गतिविधि भाप कर ।कहीं भी मैनें चैक से कोई छेड़ छाड़ नहीं की ।बहुत अधिक विश्वनीय व्यक्ति था चैक देने तक तो ।

Whatever may be da expert opinions like yours & any other Advocates, being a severely victimized person like me i.r.o. a bounced/dishonored cheque issued to me, I do deeply feel that da provision stipulated in Sec. 138 of N.I. Act, 1881 followed by Sec. 143 A (inserted video an amendment effected in August, 2018) is quite inadequate considering its speed as well as procedures followed by all da Hon'ble Courts especially, da Lower Courts, functioning in all India level. Years after years have elapsed but for holding a hearing no Courts have taken proper initiatives even considering their seniority. Many many thanks to Indian Justice delivery system !!!!

Bank se bounce hokey yadi mujhe cheque 2oct 2020 ko mila, phir mai 4 oct ko jisney mujhe cheque diya tha usye likhith mey notice by postel service Dawara bheja 15 din ka samay diya.
Cheque dene waley ko wah 7 October ko mila .. aur usney mujhe payment nahi Kiya hai. Mujhe case kab file kar sakta hu.
