      The problem is that the culture of protecting the institution above the individual is the culture that this evil shit thrives in. If you want to prevent this from happening in the future, you must punish the perpetrators at an institutional level, not merely the individual level. Otherwise, this will happen again, and again, and again.
      The point is that allow this evil shit to happen cannot be in the best interest of the institution. We need to devise a system of laws that make exposing corruption within the institution and eliminating it promptly in the best interest of the institution. Merely punishing the individuals involved breeds a culture of secrets.

      That's where interpretation comes into play. If the laws have been deemed not broken by the body that's in charge of enforcing them. Then they have not been broken. If you disagree with that, change the people in charge of the laws. I'm not in favor of arbitrarily exacting justice without due process.

      It's ridiculous to say shutdown ALL athletics because of the gymnastics program. The other sports programs handled assault situations appropriately. If you want to shut down gymnastics then so be it.

      Yes he does, and that's fine, however he is for going a step beyond that and punishing the school for laws that either don't apply, don't exist, or aren't enforced by another governing body(the NCAA). I'm against arbitrary 'connecting the dots' logic that would allow that punishment to take place without having due process in place first. Like i said before, we are a nation of laws, not the wild west.

      What do you mean throw it out? Do you mean make sure they can never use it ever again? Why would they put that limitation on themselves when they don't need to. Their bylaws basically say they can do whatever they want whenever they want to so why would they want to f that up? That is a silly suggestion because it's completely illogical. That is basically saying the NCAA should just punish themselves which makes kind of sense because I think that is how people feel but its not happening. The only thing that works against the NCAA is pressure from the Power 5 schools with talks of leaving the NCAA. So if it's a power 5 school it's probably not going to ever get too harsh of a punishment.

    The program should not get the death penalty. What if a if kid worked his/her entire life to get to MSU and then the death penalty was given? It would not be fair. That would hurt ALL THE PLAYERS on the TEAMS who had nothing to do with it. But those in charge such as staff should all be fired and replaced YESTERDAY. Fire those in power who had the ability to make a difference but didn't. I don't believe any program deserves a death penalty because you will then be punishing people who may have had dreams to play at the particular program such as "Michigan State" and now will have to transfer. Got news for you...transferring isn't that easy especially for Freshmen who will have to play JUCO for 2 years or sit out. What if they get hurt playing JUCO? Everything goes down hill from there. The NCAA does not make it easy. We all need to acknowledge the terrible crime that took place but don't hurt others by proclaiming death penalty to an entire athletic program.

      Penn State players had nothing to do with that. Sandusky's crimes had nothing to do with football itself. And before you claim "cover-up", Sandusky's prosecutor himself said there was no evidence of a cover up from Joe Paterno and the administration. Facts are stubborn things.

      Suspend the institution (MSU Athletics Dept.) that has enabled rape on a mass scale until systems can be put in place where this won't happen anymore (because its' not just Nasser, it's the administrators and what happened with Dantonio/MSU Football). That doesn't have to be forever, but when you got a decades long track record of enabling rape, besides the money and arrests, hit pause until you can fix what was broken.

      Bullshit. Their football and basketball programs were not allowing or enabling rape. They followed all the guidelines that are spelled out to do. You can't just make up new rules and say they should have followed that instead. If this is the new standard then I want to see calls of death penalty for every program in the country that are going through the same things as MSU. They are only getting more attention because of Nasser. How about we start by shutting down Ohio State sports because their wrestlers were raped for several years without anyone doing or saying shit.

    Will does have a point - you can't just make up rules/punishments on the spot in order to address individual things. That leads to chaos and arbitrary enforcement. Michigan St. does deserve harsh punishment, but you have to find a way to do it with the laws as currently written. Change those bylaws and in the meantime, Al Capone them! If you have to put a murderer away for life because of tax evasion, then do it if that's the only law you can get them on breaking - same thing here. Dept. of Ed., I'm looking at you!

    Also its stupid to think there is going to be anything in any bylaws that is going to force an decision like this NCAA decision to turn out a certain way. Everything is a "GUIDELINE." The bylaws are written by the organization usually through their lawyers. They aren't going to put anything in thetr that is going to limit their power or discretion in any way. It's all going to be "We can enforce that, but we don't have to."

    It is ridiculous to say shutdown all sports when accusations were handled appropriately in the other sports. Max is just trying to make headlines. Literally no one else is saying death penalty but him. Then he is all a sudden weak and quiet on the OSU allegations.

    The NCAA proved they aren't getting involved in these kind of scandals when the took back the punishment against Penn State. Remember why they did that? The argument was because you are punishing the players and other people that had nothing to do with it. So those people that pushed that argument is why the NCAA isn't doing what you think it should. Point your finger at those people too. It's the innocent players who are to blame ironically.

    Just watched "Athete A" on Netflix. The NCAA executed SMU for WAAAAAAAY less back in the 80's. If there is any sports program that deserves it, its MSU. Baylor came dangerously close during the Art Briles era. I think the only thing that saved Baylor was the fact that they quickly fell on their own sword and begged for mercy.

      SMU got the dearth penalty as they were a constant violator of NCAA rules from about 1974-1987. IT\t is specifically designed for violations of NCAA rules where the NCAA has control and for alleged criminal activities(I say alleged as that what a crime is until proven in a court of law)

    This has NOTHING to do with the football team. At least the Penn State situation happened within the football department so you could justify the Death Penalty. If you punish the football team because of a perve doctor and what he did with gymnasts, that is the definition of unfair.

    What does the death penalty help? You punish the students and athletes for something they didn’t do? This is a law/criminal matter not a sports matter they didn’t cheat at a football game. The people involved are and should be subject to criminal prosecution/investigation. Yes everyone involved or in charge at the time this was going on should be immediately fired or resign. The NCAA stopping the athletes from competing or forcing to transfer doesn’t solve anything imo.
