  • Two Mesa, Arizona cops were recorded by a bystander making an arrest when the cops accused the filmer of trespassing even though he wasn't on private property, and if he was, the property owner did not intervene and request that he leave. It just goes to show what cops will do to stop you from filming them. Rick Strom breaks it down. Give us your thoughts in the comments below!

      Im just wondering where in that video or in the original did any of the cops say anything regarding the man filming? They said he was trespassing and then later that he was under arrest, never anything about he camera.

      @@arod245 Do you believe that the court will see this as a significant difference, camera VS trespassing? Cops need a reason to arrest people. I believe the reason was the camera, not trespassing. However as it is legal to record cops in most public situations the only legitimate charge they can use is trespassing, right? So to me it appears that trespassing was the excuse becasue the camera made the cops feel threatened. What do you think was the motivation of the cops for the arrest?

    So I worked at a bar for years frequented by retired police officers and they were all the first to tell you how AWFUL the Mesa police department was. They would tell you avoid interaction with the police in Mesa at all costs.

    Based on the number of false arrest they've done on Direct D you'd think a major lawsuit for harassment would have happened by now. This is a fear of accountability and transparency.

    Mesa, AZ PD are some of the dirtiest cops in the country.
    They keep arresting photographers for filming them even though they know the charges will be dropped and the citizens will have to pay a for the lawsuit.
    Is this the police force we want in this country, one that is willing to cost citizens money because they want to hide their actions?

    Police should be careful about how they treat photographers and citizen auditors. There are more people like this popping up on internet every day, each auditor born out of experiencing, or witnessing police misconduct. Soon there will be too many cameras out of their control.

      @@OH_MY_DOGGG do you realize how expensive and difficult it is to obtain police bodycam footage? Especially if they redact the majority of the recording. Yeah, you can request it,but they delay..delay..delay or flat out refuse to release it. Then you will have to get a court order and wait for a judge to sign off on it

      @@OH_MY_DOGGG bodycams footage is in the possession of the cops. You record - it’s yours . It won’t disappear or be altered. There are several high profile cases where family members of dead victims have had to fight FOR YEARS to get video released. Ronald Greene comes to mind.

    The 8ft rule would make it illegal for the person directly interacting with the police to record, this would / could hamper your ability to have evidence of police misconduct, since they will just lose their own recording leaving it down to your word against theirs.

    Interesting law.
    If I’m recording a police interaction involving me in Arizona I could be arrested for filming the police?
    If I’m recording a police interaction not involving me from 15 feet away and the police approach me and get within 6 feet of me I could be arrested for recording the police?
    If I’m a videographer for the local news and I’m recording the police and they approach me and get within 8 feet of me I can be arrested for recording the police?
    Seems like a lot of legislative process and debate just to keep people from recording evidence of police misconduct. I guess the civil suit settlements are really messing with some cities budgets.
    Wouldn’t it be easier to train the police to obey the law?

      No. It's impossible to train them to obey the law. The reason why they chose this career is to dominate and bully others every day of their lives, to break the law while doing it, and to get away with it. You can't train this desire out of people who spent their whole lives wanting the power and then abusing that power once they acquired it. This is their whole identity. You can't take power away from someone by asking nicely.

    For people that dont know him. If the cops just ignore him he wont get loud an obnoxious, They go to leave he wishes them a good day and then go their own way.

      Direct D is actually against incredible odds. The Mesa AZ police department are notorious for violating rights and unlawful arrest. He has so many outstanding videos on CZcams showing every aspect of police in his area. Some cities he goes to, he has no problems documenting police interactions, but in Mesa its almost always a cop trying to unlawfully trespass him or forcing him to move so far away from a traffic stop, or putting up police tape, he might as well try recording from the next county. Transparency is non-existent with this department. The senior officers are actually the worst example, and they train the new employees, to act exactly the same way they do. Horrific. How the justice department hasn't investigated them is beyond my imagination.

      It 100% is, but the issue is that the vast majority of american cops don't know the law whatsoever. They've never read the constitution they swore an oath to protect. You know their old saying if you have nothing to hide....? Well why are so many cops so damn scared of cameras then? So regardless of what you did they will scrape any charge they can just to hurt you financially and take up your time.     Arizona's anti-camera law is still unconstitutional, doesn't matter what the distance limit is. Cops will abuse the 8ft recording space immediately by simply walking toward the recorder. As soon as they get closer than 8ft, they'll arrest the person for video recording.

    What will make ur blood boil more is a month or 2 prior to this this same offiver threatened him that he'd fine away to tresspass him by solicitation or just get him. An the boom this happens. Mesa PD needs to be investegated for mass curruption. They dont even fallow policys. How can we allow people like this continue to work for us. He needs to go.

      They do this so that the auditor must pay a bond to get out of jail then spend ages trying to get the charges dismissed. Usually having to hire a lawyer because the district attorney is usually in cahoots with the cops. They are causing all the distress they can. This is sheer retaliation for filming in public.

      Even attorneys have difficulty obtaining police bodycam footage. PD'S will stonewall or redact the recording until there's almost nothing left.
      Filling out and submitting a FOIA/records request is quite simple actually.

    The utility companies have an easement, that doesn't make it public property; but the business manager/property owner would have to ask him to leave, and him not leave, before it would be considered tresspassing.
