      People should know that you have to invoke your rights to be clear. Many courts will not consider harassment as breaking your rights if you have not invoked them. Kind of like in an interrogation when the perp asks for a lawyer. That was him invoking his rights. It is much different if they harass you after you invoked your rights. If they have nothing to arrest you for at that point they cannot bully you without encroaching on your declared rights. That declared part can make all the difference.

    By the way... it's only 'CRIMINAL trespass' if you've been asked to leave a place where you aren't supposed to be AND YOU REFUSE. It's simple trespass at the initial point. Being prevented from leaving, however, IS a crime.

      I have had to say the same thing to police on more than 1 occasion. I'm European but look middle Eastern, so they give me a hard time. I think part of Police training should be legal education. Similar to what lawyers do. I mean, common sense tells me that police should know the laws they are tasked to enforce before being handed a badge, gun, taser, cuffs, and squad car.

      It's hard not to feel that way 😂 especially when you've been in situations where someone is trying to exert a power they dont have. At the same time your power is limited because the wrong reaction can lead people to believe you're the bad one in the situation.🙃

    It is absolutely a tragedy that a man is being treated like this just because the color of his skin. He obviously had seen this before and took the time time to educate himself (quite well, bravo!) in preparation for this very situation. He lives in fear of his government, very rightfully so.

    Why did the asshole tell him not to “walk up on me” when you grab him as HE is walking AWAY? The guy should be thrown in jail for kidnapping because he did hold him against his will. Also jail him for being an idiot 1) he was never told to leave and told if he came back it would be trespassing by the owner or manager. 2) you tell him he can leave, then say you can’t leave because he’s detained and it’s several times.     I moved into my new house and went about exploring the neighborhood with my dog Noah. One day we found a side street going up a hill which had houses on the right side and a forrest on the left. I was curious about where this road lead and was startled when I heard someone yelling at me. This man was running to the edge of his fenced in property, yelling that I was on private property. I was on a road which had no signs on it other than its name. He next yelled that if I was going to dump my garbage, that he would call the police. I was only carrying a shopping bag which had a few pooh bags, (I always pick up) and my house keys in it, so it was practically flat and obviously super light. So I asked him what he was talking about. He pointed to my bag and asked what I had in it. My answer, "Well it isn't my bank deposit!" I kept walking down the road and ran into another neighbor who simply said hello. These people are out there and if you own a dog and go for walks every day, you will eventually meet them all.

    Was the Dog Park a private dog park for a specific property? If so, were there signs that specifically stated that the dog park was a "Private" dog park for authorized residents? You would think it'd have a locked gate then and not be open to just anyone to walk in. If there are no signs that state it is a "Private Dog Park" then there is no tresspass. I'd be interested in seeing the "whole" story on this one.
