This former judge is weak. All responding officers breaking into a home of a citizen over a traffic infraction not witnessed by the first officer on scene. This judge is less harsh on those that break into the home?
When Police make an arrest, they are SOLELY and COMPLETELY responsible for the health and safety of that suspect. If they beat or intentionally injure a handcuffed subject, it is not only a violation of rights, it is a crime. A handcuffed subject cannot even protect themselves during an unlawful attack by an officer. That makes them especially vulnerable. I hope the officers are fired (all of those involved for filing false reports and for not reporting the assault) and charged. As to the lawsuit, I hope the Officers are stripped of their qualified immunity ( they knowingly acted outside the law and policy, as such they acted as a private citizen) and have to pay damages PERSONALLY.
