For the PTSD portion where it responded with an ethical response, you can provide a follow up statement saying: "Provide statement for PTSD without using VA Form 21-4138" and it will give you a statement similar to the migraines example you showed.

The only thing I added is all my symptoms and it wrote a good template using all of them. Then I compared the symptoms to the 38CFR percentages. Plan on submitting soon, once I get all my paperwork in order. See how this goes. The tip nailed it!

Funny, I've been using chatgpt for help, but I hadn't honed in the search prompt quite this far. 80% with a C&P exam tomorrow for Cerv Neck Radiculopathy/ both shoulders / and knees

How did the C&P go? I plan to file a claim for cervical issues (spinal stenosis)
@@MrMont-rq1hj mostly fine, the examiner received the incorrect dbq for cervical radiculopathy, she got the cervical strain one, so she couldn't fill it out correctly. But easy, simple neck and arm turns, I was free to go as far or as little as possible

I’ll say something controversial here…I’d say the overwhelming vast majority of claims have not been won by a personal statement/lay-statement. Medical evidence and nexus will carry the weight.

What you’ll need is a diagnosis and the more evidence you have (like complaints, ‘going to doc’, etc…) the better off you are.
You’ll attend your exams and I highly recommend submitting a BDD claims on your 180-day mark.

Clay, should a veteran ever reference a specific CFR in their claim or appeal? If so, should the verbiage be quoted or just the reference #’s? Should it be on the 4138 or the personal statement? Thanks for helping us.
Personally, I would argue for the appeal over the initial claim. More importantly, if you’re able to reference your evidence and it’s reference to 38 CFR criteria.

Depends on your situation but to give a general answer I’d say per body system. More importantly, that statement referring medical evidence.

If you already have a diagnosis for cppd secondary to pattelar Chondromalacia by orthopedics, have flat feet with left ankle/foot degenerative service connected already. None of the doctors, padiatry or orthopedics, will say what the causation is. I have asked. How could you submit it for a claim?

Is there an ideal length of a personal statement? I'm attempting to write one and it seems a bit long. But I also want to make sure I get everthing. Showing the extent of how it affects my life. Should it be in great detail? Or should I make a brief statement? Thank you for your time.
Short, sweet, concise. Reference your evidence, reference any treatment plan, reference symptoms. Statements support your evidence.

I was rated 30% for sleep apnea, but the recommendation on my sleep study that I just did was to get a CPAP, so I'm guessing I just need to get that prescribed and on my record, since CPAP should qualify me for 50%
I've done all my claims solo so far, no help from a vso or anything, got off active last year.

I have a question I am at 90% disabled and I am 65 years old. I could keep on filing secondaries or I could go TDIU, but how risky is TDIU???
Not risky at all and I would ‘keep filing’ as long as you have the evidence to submit those claims. Evidence-based claims are the way to go.

The shot at VA claims Academy was unnecessary. First of all, their highest service charge is like $600 for FULL SERVICE (based on $1,000s from others). But Their CZcams channel has been without a doubt THE MOST helpful VA claims information I've gotten (for FREE). I started watching VA Claims Academy videos in early 2023 and I just got back an initial 80% disability rating! With a year of back pay! 🎉
You know, you can just give out great information without throwing shade at other people. You just basically gave them free advertising LOL
Hey brother, I have tons of videos giving those companies props for what they do. There are pros and cons, this is a con. My hope is that VSOs understand why these companies are successful and learn from their process on WHY they are successful. Assuming GUARD Act is passed.

All in 1 and there is no reason to do a statement for every single claim. I know some people recommend that - irrelevant. There are some conditions I always recommend them for. Migraines would be 1.

It didn't work for me. I requested a statement va for 21-4138 for chronic low back pain. It gave me full instructions on how to fill out the form in detail but no template.

I noticed I use the word instructions and I believe that’s why I got the response I did I changed chronic back pain to lumbar strain and requested a statement in support of a claim and I got really good results, so in actuality it did work I just didn’t do it right. Now I can’t stop playing with ChatGPT. Thank you. I appreciate all you do.

I can appreciate what you do to assist vets in getting their claims completed at no cost. However, when it comes to calling out the VA Claims Academy as a claim shark, you're wrong. First off.. I have every right to spend my money if I choose for a service. If i feel the service is worh the cost. The VA claims Academy has helped me out quite a bit WITHOUT me purchasing any of the packages they offer. I went from 10% to 90% with the help of Jordan over at VA claims Academy and guys like combat crieg. Jordan at VA Claims Academy just by answering questions via email, got me to my goal. So please, keep doing what you do to help vets but understand just because a vets is charged for a service provided doesn't make the company or person a claim shark. There are claim sharks out there. VA claims Academy is all right by me from personal experience. Peace

I also just write out my own statements in a pdf and submit them. I've never used the personal statement form.

@@TheCivDiv Greed. AI is scanning the claims now- so back in June we were told to leave the lay statements off the packets because of a 3000-3500 client backlog. If the bots are letting the claim through the Vet can give a "lay statement" during the C& P. I kept doing them- it gives the Vet a chance to talk about what is happening and since no one ever listens to them it was often a huge relief for the Vet to have someone listen. I also felt like it gave them a summary to review before the exam which they found helpful. I didn't know about the lawsuits and the lying to Congress until Sept/Oct and I don't work there anymore.
