    I filed for neck pain, back pain, sciatica secondary to back pain. Anxiety and depression tmj and migraines secondary to anxiety and depression. Submitted a two year old DBQ from a DR for neck and back with X-rays and measurements along with in service treatment records for low back and sciatic issues with physical therapy. They submitted my documents and that DBQ instead of scheduling me a c&p.

    Just a comment about being specific when filing as you mentioned keeping it general. I filed for herniated discs when I left AD in 2004. Fairly recently while reviewing paperwork from then I saw the decision letter where I was awarded 20% for my back and right there in the decision letter the VBA says I also have radiculopathy (based on my military medical records). Thing is, they never awarded me anything for radiculopathy even though they acknowledged it existed and I can only assume that's because I didn't specifically file for radiculopathy in the claim.

      Different system and generally speaking if you have the symptoms of Radiculopathy, and it was recorded in the exam, the VA should’ve granted the nerve damage. 1 system is the back and 1 system is the nerves in the leg.

      Agreed, check your Med records for diagnoses and that’s what you should claim. Without diagnose they can skip over that condition and not award. I say only submit diagnosed conditions. Don’t waste time. Thanks for clay and all he does.

    I congratulate you for your most excellent work in providing us with these informative videos, i do have a question: I served between 1967 thru 71 but my STRs only provide medical information from late 69 to 71 my C -file is also limited to this same period, how can one submit a claim when the VA has no medical files for that period. Thank you

    At 70%, the only reason I could even apply is because of the PACT ACT! Lived with the issues for many years, still have some pact act doesn’t cover but should!

      I filed in August of 23 under the pact act. Still waiting for exams. Have one thing on presumptive list and several things as well. Too bad it took 30 years. Desert storm.

    Do you get a higher rating if you have no knee or ankle reflexes secondary to lumbar radiculopathy? How would you claim that?

    Is there a chance you could do a segment about VA surgeries that take a bad turn. I have been looking for information for over 20 + years.

      I’m assuming you’re talking about TORT claim. Basically a botched surgery and yes you can ‘attack’ this and I HIGHLY recommend going the attorney route.

      @@TheCivDiv I have tumors in my right hand and wrist; which is my dominate hand. The VA sent the claim back as “not service connected YET they made the 30% (and 2 0%) P&T. The tumors were discovered 17 years after the surgery that was preformed in 2002. Some I am stuck as messing with lawyers as seemed very sketchy.

      1151, The VA is set up just like the Service. If you have a surgery, and it caused you more problems, like blood clot, etc. They are responsible for that. You would file an 1151, if awarded, then they have to pay you the 30% Same as if it was service connected. The VA, told me I had COPD, and treated me for that for over a year. I kid you not, it was NOT COPD, but Kidney cancer. they had to remover my right kidney, because by the time they found out what the problem really was, they could not save my kidney, the operation cause me to get blood cots and diabetes and depression and anxiety. I filled a 1151 ( USE A LAWYER!!!) and I got 100% rating.

    One small point for clarification; Clay is correct that you can receive dental treatment for chipped or broken teeth. However, you do not want to pursue this like a typical disability compensation claim because that is not a disability for VA purposes unless missing teeth are associated with damage to the mandible or maxilla; or possibly an infectious process like osteomyelitis. You should reach out to the VA hospital for dental treatment eligibility and in the event they need a rating to establish care they will ask for a rating from the Regional Office. Just a heads up because it would be a denial for compensation even if occurring during service for just chipped/missing teeth.

Dental treatment eligibility includes Class IV eligibility which is associated with a total evaluation (either 100% schedular or via individual unemployability). However, there are several ways to receive treatment and a good resource that breaks it down is here:

      I tried va dental for years had upper and lower teeth removed because of bruxism and tmj and they would not see me until I got service connected for tmj.

      I filed for TMJ and the condition was from trauma to my jaw in service and it got closed with no notification .

    Hi Clay great info. I know at some point you made a video about common secondaries for different conditions. For shoulders you had neck pain for a secondary. Do you know of any research to connect. Been out 20 years + and want all the evidence I can get. I see a lot of info linking neck to shoulder but not the other way around. Thanks for all you do.     where can I find these in cfr 38? seeing so much that I did not know and was never told to me by the VSO. I was totally ignorant about all of this and was denied on all the problems that have cause the bigger problem. I was unaware of the conditions that were related to every thing on the Master List and was not able to add them due to my ignorance.

    What if there's no service treatment records aka missing proof? Theres a bitvof helpful information on the exit physical. The Army records are from the 1970's that I just got from the National Archives. Is a C file different?

    I have a question regarding some of
    The PACT act claims, I have been previously denied for a condition and then the PACT act covered it under presumptive. How would I go about trying to revisit? Supplemental? And also I have been watching for a while, I am a current customer of VACI and after watching yours and many others, I have decided to use my own knowledge after my business with VACI has concluded. Not looking to use them going forward. Thank you for your videos and what you do!

      Feel free to join TheCivDiv’s Facebook group and post your decision letter anonymously but in most PACT denials it’s due to not having a diagnosis.
      There is a chance that your condition has a KNOWN source and if that’s the case (which is rare) then that condition is no longer presumptive.

    Totally lost in the fog. Listen to your video about Rating Code Sheet or Code sheet hope that is the correct saying. Today contacted my VSO and asked him to help me get a Rating Code Sheet. He said he could show it to me and go over it but that's all. VA said he can't print it and give it to me. So, what's up with that. I had to fill put a form 20-10206 I checked off Claim File (C-File) and again he said when you get theses file Code Sheet may not be in it.

    What about have ingrown toenails? I have like 3 removals on both big toes throughout my time in and finally got them both killed so they won’t come back. Is that claimable?

    Is there an amount of apneas' that must happening per hour to claim OSA. Are the apnea events based on your cpap report?

      That amount is what requires various forms of treatment. So there is a BiPap and a CPAP and a few others. CPAP hits a certain criteria that is of the higher scale. Sleep Apnea also has mixed, central and obstructive. And yes, the CPAP records the data but the sleep study records your apnea events.

    How do you know if something is diagnosed in your records? Ive been seen for mental health and prescribed meds for it, also for my back and neck pain and prescribed meds for it but I dont see where things are diagnosed

    Just trying to get some clarification. If I was diagnosed in the Air Force for issues, do I still need a current diagnosis of the same issues with my current provider 15 years later? Or do I only need the military records if it's all there?

    If I was only seen 1-2 times for an issue can i claim it or is that not enough "evidence"? Im getting mixed opinions about needing specific diagnosises on my problem list or just records and documented complaints on things. I have all my major claims with plenty of encouters and visits but there are some minor things that i feel i have and qualify for at least 10% on (still AD about to do my BDD)

    I did bdd prior to separation a decade ago,got IVDS for low back and just had MRI for full back and boy it’s not good. Even though I’m hundo p&t, could file 2ndary or possible eligible for SMC

      You could…tbh if it was me, the only way I would consider submitting more claims is if my evidence was air tight and I KNEW the SMC would be awarded and worth it. Only you can make that decision.

      Talk to your healthcare team - nothing else to it. Treatment varies on YOU and YOUR symptoms. Medication, therapy, learning tools, it all varies.

    My effective date will be OCT-1-2024
    Will they rate on the rating scale prior to may19th….or the rating scale of OCT2024

      Sinusitis is presumptive if you meet the pact criteria , you need to make sleep apnea secondary to something that it has a medical connection to like migraines or tinnitus.

      Depends when the brain surgery was and if ‘that’ was service-connected and now you’re looking at residuals or the VA botched a surgery or you had this surgery during service…

    Whatever you do, be aware to have a basic understanding of what Project 2025 has to do with VA benefits. Who is endorsing it and why is important to either support it or repell it and how to do either or. Is very important to be informed because is going to impact every single veteran.
