Any resources for public health records for the presence of Mycobacterial abscess complex in the dorms or work areas at Kunsan AB Republic of Korea? Possibly other servicemembers obtained records from the bio-environmental office. I submitted a FOIA request for inspection records, air, Water and Soil sample lab reports for building 1512 and their response was that the military isn't required to collect or maintain public health records for dormitories, only occupational work areas. I had my attorney submit a FOIA for public health inspection records, air, water and Soil sample lab reports for the building that I worked in and after a year of waiting they still haven't responded.

I was first awarded SMC S for housebound. Then a year later they realized they messed up and increased that S to L for A&A. They also gave me P-1 for a slew of other SCs. So I was rated at SMC L1/2 when I got LOU of both feet. Instead of getting SMC O for 2 Ls and onto SMC R-1 with the A&A, they took away my P-1 and gave me P-2 which raised my rate to SMC-M. My current attorney did not want to file a 20-0996. He said we could not win at the HLR, BVA and even the CAVC level. So, I filed a 20-0996 myself and I am waiting on a date for a "informal conference". Do you think I can win this at this level or will they deny it and send it to the BVA? Can your firm help?

I have 3 conditions that were considered for IU 70% 20% 10%.....and I have additional conditions. If my additional conditions equal to 60% can I receive SMC-S?

What if you are eligible for SMC s (100% single rating and 90% additional ratings combined) but also qualify for aid and attendance SMC L ( regular assistance bathing, dressing, and bathroom)?

My rating is 140%. It is comprised of brain damage that they refuse to service connect even though the secondary disabilities associated with a TBI are! I was forced denied revive connection for 35 years before service connection was realized and they were forced by a judge to grant me those secondary disabilities. They refused to pay any back pay or provide me with SMC and I do not know how to make them do it.can you help me with my concerns?
You mention smc s, if you have a one condition sc at 100% and the rest of condition sc total up to 60% the you are eligible for smc s for $3500.00. Is that $3500.00 is addition to your monrhly va disability compensation? Like you get your monthly disability plus the 3500 smc. Is that right?
No , you get the SMC payment because it is higher. It's not an addition to, it's another rating you will get. I am 100% P&T and get SMC-S.

i dont think so-- it is my understanding that the SMC has their own tables and if you qualified for say 6000 SMC you would take your regular VA 100% out of that--you no longer get it---- but my goodness I would glady give up 3000 for 6000

This company reviewed my case...I m tdiu.....p and T....and said they are not taking my case....wouldn’t tell me why
I receive my letter from the VA stating that I’m 100% disabled. The letter also states that the VA is recommendING me for SMC is this automatic or do I have to apply?
You have to apply at the VA it will not affect your disability rating but it is a special monthly compensation.

Hey guys, so I have a question for you. I have a stand alone 100% scheduler rating for a single condition and I am rated for 9 other conditions that combine to 90%. They are rated as 50, 40, 30, 20, 20, 20, 20, 10 and 10. I called my VSO yesterday to ask why I wasn’t rated for statutory SMC S. He agreed and thought I should be eligible for it as well so he made a call to the Fargo VARO to ask what was going on. The rating manager he spoke with said I was not eligible because I needed a single stand alone condition to be rated at 60% in addition to a stand alone 100% rating and since my next highest rating is only 50% I am not eligible for statutory SMC S. He’s saying it’s not a combined rating of 60% but rather a single 100% rating and another single 60% rating to be eligible. Is this correct or do I need to lawyer up? I was awarded the single 100% rating effective June 2020 so I’m looking at significant amount of backpay if they have misinterpreted and misapplied the regulation. I appreciate any help you can offer. Thank you!
Did u summit more more claim after u reach 100% service connected. Cause I am currently 100% p&t and thinking sbout summit more claims. Currently 140%
@@Madd100kidd no, these are all the same claims that I’ve been rated for since 2016. In 2020 the 70% service connected condition was increased to 100% and I was deemed permanent and total.
Yes you are right and the VA is wrong the percentage don’t matter as long as you reach 60% you’re entitled to SMC S
@@richrod1678 thanks, I think I’m going to wait until I hit my 10 year in Jan 2026 then file for SMC S and back pay to June 2020. The guy my VSO talked to doesn’t even know his own M21-1 raters handbook.
What about R-1???? Aid and Attendance- daily care?
You first have to qualify for the first Aiden, attendance which is SMC L. If you don’t qualify for regular Aiden attendance, they will never give you the higher level of aid in attendance.
If anyone is reading CZcams postings that created this video I have 2 disabilities of 100% each which are 100% spine and 100% PTSD but I only get paid for one 100% rating unless the V.A. has somehow added special payment on their own but I doubt that please advise. Both disabilities are severe because neither has progressed.
@Matthew Lesko - I applied for the restroom remodel and qualified for that so are there other grants? I can still walk without assistance and that is on me because my primary physicians have tried putting me in a wheel chair or those scooters I see veterans on but I keep telling them to shoot me first. As long as I have the will to walk I will never use the scooters or wheelchair I don’t even use a walker and the one they gave me works great as a bag holder for the aluminum cans.🥴

Hello!
The only level of SMC that’s paid in addition to your disability compensation is SMC-K. SMC levels L to O are paid on their own, they’re not paid in addition to your disability compensation. So, for example, if you’re getting TDIU a little over $3,000 a month and you also qualify for SMC-L, you’re not going to get $3,000 plus $3,900, you’re just going to get the $3,900 each month.

No, you can’t work, SMCL is Aid and attendance it’s not like your housebound you can’t work
