Why do lawyers defend people accused of crimes.

  • Do criminals or people accused of crimes deserve to be defended by lawyers?

    Thank you lawyer Tina. I understand this talk so well but I have a question 🙋‍♂️. What about lawyers who have been told or have confession from the accused that they have committed a crime but they go to court to poke holes into the prosecution for the person to go free. I know there are very good criminal lawyers who can do that. Is that okay too?

      If i have a client who says he committed murder, the law forbids my client from saying he is guilty. The law forbids that. Even if he says he is guilty, the judge will say no oo we have not heard you.
      The lawyer is required to ask questions through cross examination(that's what you call poking holes) for the court to be satisfied that truly, the police have satisfied the requirements for the law to give them the life sentence.
      If after cross examination, the judge is convinced that this does not meet the requirement, then that's it. He will be allowed to go free. That is okay too.
      Because just because someone killed someone, does not mean that the person has offended the laws of Ghana and has to be punished. No oo.
      You see, there are defences in law. The law gives excuses for some behaviours because the law knows such excuses are necessary.
      The lawyer can do all this without lying to the court or committing a crime. Because lawyers have a duty not to lie or mislead the court too.
      ** Just because someone killed someone, or someone took something belonging to another person, or some stabbed another person, does not mean a crime has been committed.
