    Great video as usual - on my claim diagnosed DBQ done it equals 70 percent all day rating special stalling because it gives me 100 even a 50 percent gives me 100 I'm laughing at the VA now bro they been denying me for 12 years i hurt me claims by speaking my mind but oh well veterans do that when the VA deny a good claim - I love your videos you destroy the other utubers by a mile -

    I had my c&p exam today and the Dr. was easy going I answered my questions straight forward and didn't talk too much. He said he agreed with me having PTSD and he was going to put in the "remarks" that I need intensive inpatient care to help me deal with my PTSD? Has anyone ever had that at their exam?

    Jordan, some C&P examiners want to know the story of what happened to the veteran ending with the condition the veteran is claiming. For example if the veteran claims ptsd for witnessing his buddy shooting himself with an M4 in the mouth chances are the examiners wants to hear about it, then social and occupational impairments are mentioned due to this. That incident will be searched in a database VA has access by a case worker and it better be there, if that incident is not in the database and the veteran doesn’t have buddy statements the claim will be denied. That’s a problem a lot of SOF guys have when claiming mental due to black ops related event that is not in the database.

      Technically not. As you can see here from the BVA’s official duty to assist documentation sentence 44, for combat PTSD, lay evidence is satisfactory as the sole requirement for “reasonable evidence”

    I submitted a VA claim, but wasnt asked for any statements, I just retired back in May from Marine Corps. Now im worried I screwed up. All they have is my 2 inch thick medical record and outside mental health records.

    Question- prior C&P what if a PTSD Veteran got a heart attack and multiple strokes and now was diagnosed dementia. How can the examiner rate the ptsd when the veteran lost his memory? Your thought on this . Thanks

    I just have to point out that total social & occupational impairment is the criteria for 100% disability, and that monthly amount is quite a bit more than the $1663 mentioned.

      For PTSD they gave me 70% and the paperwork they gave me showed what they found to determine my rating. They also told me other issues that would give me 100%. I know I could get 100% but I’d rather not get 100% for PTSD. I’m going to court soon to get more time with my daughter and the last thing I want her mom to dig up is that I’m totally impaired to take care of my daughter. Plus I work for a pretty good company that takes care of me. 80% combined is good for me but it’s hard to get 100% for me. I’ve been trying to figure out what else I could get but I’m unsure how it will work.

      ​@@brandobecerrothere shouldn't be any way for your ex to find out your disability rating. If she did, that would likely be a HIPAA violation. If you're not telling your shared acquaintances, she should never find out.

    My DBQ did not have total occupational and social impairment. But I did file a personal statement that outlines a ton of problems. Plenty of medical evidence and ER visits. Is the DBQ the only thing the rater cares about?

    I canceled my C&P for increase of my 70% PTSD. My diagnosis was listed on DBQ 3 times PLAIN as day, my nexus statement, 7 other evaluations, personal statements, buddy letters and published articles. The VA said they couldn't evaluate me because they said my doctor didn't give me a PTSD diagnosis on my DBQ. This was last week.

      I waited about 4 years after I got out to claim PTSD. I didn’t get diagnosed for it till 2019 and I was out of the army in 2014. Took less than 2 months to get a 70% claim for me bringing me up from 30% to 80% combined disability rating. In the notes section I put I could submit my helmet cam footage of combat if they needed proof of in service stressor.

    If you have been diagnosed with multiple mental health things from military and civilian doctors such as depression, anxiety, insomnia, PTSD etc, should you file a claim and submit a statement for every single one of those diagnosis? Even if the symptoms are overlapping? If the VA is only going to give you one mental health rating anyway wouldn't it be better to file just one?

      Think occam's razor... is there a single diagnosis that encapsulates all the other diagnoses? That is usually the single diagnosis that you are claiming, with symptoms that are a part of the over-arching diagnosis. So if you have PTSD, your depressive symptoms and anxiety are likely subsumed by PTSD. There are exceptions to this, for instance Schizophrenia or ADHD and PTSD would likely remain separate diagnoses.
      Edit: Yes, you should report everything, because if they put everything under PTSD for instance (like anxiety and depression) and the PTSD resolves along with anxiety, but still had clinically significant depression, the VA would still have to rate your depressive disorder. Since the depressive symptoms were there previously, you would likely have the same presumption of service connection unless it pre-existed military service. Always disclose your symptoms, even if you are sure that you will be awarded 0%, because if it is service connected and later worsens you won't have to establish a nexus later.

    My vso put in “PTSD non combat with anxiety depression OCD and insomnia”
    Everything except PTSD has been diagnosed, with tons of medical evidence in my record. Will not having the PTSD diagnosis be an issue?

    Your personal statement is your only opportunity to be in the room when that VA Rater is actually making a Million Dollar decision anout the rest of your life. Write a personal statement about every condition you claim! Put your truth, in your own words, on the record!

    If i have a diaognose for back pain and neck problems, and all this is causing me to have alot of mental hardships and strains on my personal life (including anxiety and depression)and marriage is there a way i can claim mental health issues as a secondary condition due to all the hardships of my current ratings have on my everyday life. also have questions about claiming sleep apnea as a secondary condition due to my current disabilitys that also caused the weight gain, also as well there were points in my records that there have been noted that pain i was having caused me to loose sleep and having a small airway obtrusction.

    My C&P for PTSD:
    I was expecting a bunch of questions about my stressors while deployed.
    Doctor only asked about my childhood, school, dates of deployment, work pre and post sercive and then told me we were finished.
    I was like 😳😳😳 "Doc, arent we gonna talk about my experiences during deployments?"
    Doctor said: "I dont ask anything, I write what you say"
    😳😳😳 I got a bit angry inside and just told him, ok, ill tell you then... I fell for the "venting about stuff that happened", forgot to mention stuff about my lack of social life and how I go out very late at night to avoid ppl.
    I expected the doc to get me started with questions, its hard for me to express stuff out of the blue with out a direct question first.
    I felt super disappointed about my C&P. 😕
    Now waiting for a decision. See how long it takes. At this point, im hoping for at least a "service connected" not expecting high % at all.

      If you described your childhood as sad,traumatic or abusive,you have made your claim less favorable.
      Your service connection became less likely,or service trauma less impactful to your current condition.
      Tricky on his part isn't it....

      Got a decision already: DENIED. =\
      My attorney wants me to get a Nexu$$$ letter, even tho I feel I have evidence(Medal citation, evals, online news of what happened... none submitted with the claim).

    Well cool, I’m pretty sure my VSO suggested I submit my PTSD claim without a diagnosis. I have a CAB and a service connected TBI from an explosion I was in. I have a C&P exam on the 20th of November. Am I screwed since I don’t have I diagnosis already?!

    I’m a combat vet of Iraq. Ptsd was not talked about during my time in (02-06). Got out and became a police officer. I now know I had multiple issues after my second deployment but I didn’t start getting help for mental illness until 2011. Unfortunately I got medically retired as a police officer for ptsd. Would that affect me filing a claim with the VA even if I had proof with the VA of mental illness that is military related and it’s in my file?

      If you got proof of In Service stressor the you can file. Combat badge will show you were in combat. They will want a statement as well. I’d give your unit you were in and the dates of the things you experienced. What where and when is a good way to write a statement.

PTSD and also Sleep Apnea were not discussed during the OIF timeframe. When I did my Personal Statement I wrote 'Symptoms related to PTSD' - since none of my records had an official PTSD diagnosis. But I had nearly EVERY symptom related to it: insomnia, panic attacks, social disconnect, trouble focusing on tasks, hyper-alertness...you name it

      @@williest1 I never was seen when I was in the Army for a diagnosis of PTSD. My last deployment to Afghanistan ended November of 2013. I got out April 2014. I didn’t go to the va and get a diagnosis till 2019. 2 months after diagnosis I did a fast track claim and it took about 6 weeks for them to give me a 70% rating. I was honestly a train wreck when I went to talk to the VA about my issues. Make sure when you file that you put in details the location, dates, unit you were in, and what causes the stressors. I talked with other guys from my unit and they all pretty much got the same rating for ptsd.

      ​@brandobecerro what being about involved with indirect combat (both OIF and OEF) in which you didn't recieve a combat ribbon but the shit that went down was horrific nonetheless. Still have dreams and flashbacks to this day, I also have not made any new connections socially outside of work, nor do my work connections extend beyond the work place, never had this problem before being deployed. My parents and siblings noticed changes in me many years before I ever noticed, the only reason I finally noticed was because out of the blue I started having what I thought were heart attacks, but turned out to be panic attacks. That's when I started to research and look into getting mental health therapy. I was evaluated by my local Naval Branch Clinic and was sent immediately to an off base psychiatrist and psychologist. Since retiring from service I've been very alone and isolated, partly because I feel safe that way and partly I don't really know what to do (I was so used to my military routine now I don't have that anymore).

    Hey J serve in the military for 20 plus years. I have 70% rating, 30% Hearing loss, 10% tinnitus, 10% left Hand and 20% Lower back but I received 10%. But How can I request an increase to my lower back. i go to the VA for chiropractor, Community care for back massage therapy and I last year to Houston community care for acupuncture. I was an airborne ranger in the military. I have been complaining to the VA about my tinnitus and ringing in my ear. I just had an hearing test last May 2023. Still haves a major 50% hearing loss in my left ear. The ringing and whistling in my ear is getting worse and won’t let me sleep at night. i also been diagnose with sleep apnea. I was. also diagnose with prostate cancer in 2017. i when thru radiation treatment in 2018. Sorry for all the details. I have been to several VSO’s and veterans organization, VA claim insiders and none has given me any advice or help. But they all want a lot of money. The 70% i have received, I have done it all by my self. I’m just looking for someone to help to really guide me in getting to 100%. i know I have evidence and symptoms by being in the military for 20 years. Thanks. you seem like a honest and true person.       Hi Edgar, a supplemental claim for your back with C&P exam preparation should bump up your back rating significantly. The elephant in the room here as far as what is missing is a mental claim. I would look into your active duty treatment records and comb through to see if you missed an insomnia diagnosis or adjustment disorder.
      If not, SSD secondary to tinnitus and back is a great route to go.

    I’ve never officially been diagnosed with PTSD nor have I tried to get help. I was in combat and have CIB. What else do I need? Should I go to a VA doctor to get diagnosed?

      So even without a CIB, you can get PTSD or not get it with one. So the va looks for a stresser. I was diagnosed with combat PTSD 6 years after I got out of the Army and 13 years after I came back from deployment. And I was diagnosed at a C&p Exam. Never seeked mental health at all, zero since.

    Stop telling folk that they need a diagnosis before filing a claim. That’s what the C&P exam accomplishes in mental health claims many times. Especially when the Vet uses the VA as primary care.

      It would but it isn't straight addition. Your biggest percentage counts, then the others come out of the remainder. So 70%, remainder is 30. 20% of 30 is 6, which rounds you up to 75%.

    One thing you are not adding is emotions, you cannot go in say all this point blank like it not a big deal. You better be upset while talking about the issues you suffer. Cry like a baby if you can (if you are really suffering it will not be hard)!!! FYI the only reason I did not go for 70 % is if I told them really how I felt I would be in the loony bin, be careful!

      I went in and the examiner right off the bat without letting me get a word in said "first of all I have seen it all and if you think you are tough you are not" second she said "if you don't cry I don't think you are affected" I couldn't believe she was actually the person that was going to make a life changing decision for me. I ended up with a 70% for PTSD.

    Easy question for you, I’m about 7 months out from retirement “1 Feb 2024” do i need personal statements when doing BDD claims? I have about 10 different diagnosis’ in my STR and I’m almost certain i should be 100%

      Yes, I recommend submitting a personal statement with each claim, even if many of them will be super short and sweet. Do it right, do it once! Congrats on your coming retirement

    I had my VSO do my paperwork for me. They said I didn’t need a personal statement letter because all my issues are in my medical record. Is it too late to submit my personal statements? Also, do you offer just the personal statement templates by themselves?

      Yeah VSOs push some weak advice. They’re beholden to the VA to keep their accredited status, not beholden to the veteran. I’d absolutely still send the bulletproof personal statements in, it’s a massive difference maker in $$$ every month. I do not, I don’t want a ton of my personally written statements out there

    Didn’t the VA change their rating guideline’s so that you don’t have to be totally occupationally impaired? I thought now you just need to score a 4 in one category or a 3 in two?

    Hey J, If i may ask you, i have a 10% rating for adjustment disorder, i am thinking about a Depression claim, im sure i could get 70% for depression alone. but i also have insomnia. should i try to get my adjustment disorder increased and these things added to it, or just go for a depression claim? my adjustment disorder is rated at 10% but it is static, if they do increase it would my static go away? what would you do

      All three of the conditions you mentioned will be lumped together and rated as one single all-encompassing mental claim.
      Your mental rating is clearly significantly below average right now

      The diagnosis doesn't matter, generally, as long as it's service connected. So ADHD, for example is a childhood disorder, and you won't get disability for something pre-existing military service. Otherwise, don't worry about the diagnosis, it's the functional impairment that determines the rating. Depressive Disorders, Anxiety Disorders, PTSD... all are rated on the same criteria and no diagnosis is superior to another.

      @@codychavarria6088 not exactly, depression is subsumed by the PTSD diagnosis, unless there is evidence to show that it's a separate and distinct disorder. In that case they combine the rating and award the veteran the higher of the two for mental health, much like what they did on claims of sleep apnea and asthma (both are breathing disorders). So if you have asthma at 30% and sleep apnea at 50%, they award 50% for sleep apnea and asthma together. If you have depression at 50% and PTSD at 70%, you would be awarded 70% combined. If, however, your PTSD resolved and depression remained unchanged, and you were re-rated, you would likely be decreased to 50% for the diagnosis of the depressive disorder. Just as if in the future they decided that treated sleep apnea is 0%, and one gets re-evaluated, but has asthma at 30%, the rating for breathing disorders would fall to 30%. It's a strange and unpredictable system, the best strategy is to report everything, be honest, be treatment compliant, and have everything well documented - then let the chips fall where they may. There were issues that I would have expected to have gotten higher ratings on, but was rated 0%, and others which were rated higher than I anticipated (by as much as 20-30%), based on the medical evidence in my military medical records. I cannot overstate the importance of going through your medical records with your primary care doctor to make sure that your medical records are accurate and complete.

      You can to get it service connected but I wouldn't count on getting a higher rating than ur current 70% and they don't combine because that would be pyramiding. Honestly tho I just recommend not poking the bear

    My claim as been pending since august for witness of a suicide from 1997. Hard to get records of that incident . I have a imo from this last year. What can you do for me if the claim is denied . My C&P seemed not to go well in my opinion

      @@vaclaimsacademy all I had was back , ankle and shoulder incidents in service . I just had my C&P exam today . Back was 10-15 degree ROM . But he didn’t use the goimeter for shoulders . Never had mental health . Thanks for the response

      If you have a VSO ask him/her politely to go into VBMS and show you what the C&P examiner wrote. Google the person’s name and rank and something related to that incident should pop up (an obituary at least) and be ready for a supplemental.

    My first and only rating is 50% ptsd after being out over 20yrs from the Corps. I got denied tinnitus but currently appealing. How long do I have to wait to request an increase for ptsd I should’ve been at least 70%

      I would do a supplemental claim for an increase in ptsd right now. No point in doing an appeal for tinnitus, takes years for a low value claim

      File the claim yourself. You don’t need to pay anybody, just file for an increase. don’t worry about tendinitis it’s only 10%. you have nothing to lose, you cannot be reduced. 20 yr rule.

      @@mrjoeloksI’ve been out longer than that. Filing a claim now. It’s amazing how the stuff I went through still affects me to this day. Almost daily I have an epiphany about things I do that lead right back to what I went through in Iraq.

      You are the best! I'm aggravated bc I signed on with Trajectory to help me file my claim bc I don't have the $$$ to pay upfront. Do you take payments after getting disability percentage and can I even get out of working with Trajectory? All I've done is signed a paper they sent me last week. I haven't provided them with any information yet at all. I'd definitely prefer to work with a player like you!!!

      There’s consequences to the decision to not go on record. Now you’re really in a bind as far as your claim goes to be frank with you. It doesn’t mean it’s impossible, but it’s not ideal

      It's time to start getting treated and then once you have been in treatment for a while determine whether or not you are making progress. If it is service related, seek care, then decide whether or not to claim. Getting care is more important than chasing a rating. It won't take long to determine whether or not you should make a claim.

      How’s this fraud? I have 70% PTSD. Deployed to Afghanistan at 19 years old in 2011. You’re telling the VA (YOUR STORY). You might not be fucked up like others but don’t call someone’s else’s story fraud. You don’t even know how many jobs I’ve quit due to PTSD. How many managers I cursed out. How many failed relationships I’ve had. Is nothing fraud to it dumbass! I’m living proof!

      No Sir! the fraud is the VA, they are set up to disqualify you using a "snapshot in time" instead of a life of pain and suffering. This is why you must have documentation to support your claim and go to your C&P as if it where your worst day ever. Example: I used to run, hike, ski, now I can barely walk, no gardening, housework, auto repair, animal care (I own a small farm) but if I went in for a C&P I guarantee I could do what they ask in that snapshot of time (10 mins) only to be disqualified. So no, it's not fraud to learn the ins and outs of a C&P and what they look for, you're only trying to level the playing field.

    I was denied anxiety. I know for a fact that I was adding fluff during the CP exam, dont be like me guys and gals. Im in the process of claiming adjustment disorder. I appreciate this video and your dedication 🫡
