It’s not that simple. First he needs her to make some sort of ruling to send it to the 11th circuit for recusal. Which she has refused even now. He needs actual evidence that isn’t just based on prior. He also gets one chance and if he screws it up that’s it and Cannon could use it against him. It’s not that straightforward.
this has been answered countless times. It's not about what anyone thinks-even the judges who advised her to recuse herself. It is extremely difficult to have a federal judge removed from a case and Smith/DOJ need to wait until she makes a ruling that can be appealed. She has avoided making rulings. But hopefully her cumulative errors are adding up to enough cause.

first of all that right is granted to the defendant - obviously that is not here . However the public in this case also has a vested interest in a timely conclusion to this case. Unfortunately the system does not take a lot of that into account - remember our criminal legal system grants an awful lot of protection to the accused - just because this monster knows how to exploit that to his benefit is not reason enough to destroy that .

The sixth amendment is predicated on the following four factors: (1) the length of the delay; (2) the reasons for the delay; (3) the accused’s demand for a speedy trial; and (4) the prejudice to the accused). (1) and (2) need to be called into serious question in this case. (3) and (4) are up for debate. Obviously (3) is the question here, but since he isn't incarcerated (yet) he has no motivation to push for a trial. And the judge is very slow on modifying his terms for release. Translated: he's out on bail and has ZERO reason to speed up his trial. In fact if he delays he can potentially be put in power to erase all of these actions. And I say: This is why we need to amend the laws to prevent this from EVER happening again.
