      Thanks atty. Related yun case namin sa topic nyu, may tax dec kmi 1951, extra judicial partition1949 at may survey plan din 1918,kaso wala kmi title. pero atty. May nang aangkin dun na iba may tax dec din sya kaso affidavit nya lost documents, may laban ba sya samin atty halimbawa? Yun lupa nakatiwang wang now

    Salamat po Attorney! Makakatulong po sa case/ situation sa amin. Maliwanag po Ang explanations mo at nabanggit mo din po yung term adverse. Yung sa situation naman namin. , More than 70 years na Ang boundary o bakod ng lupa from Lolo, hanggang Tatay namin at mga kamag anak. Then ngayon po ay gustong I claim ng kapit lupa Ang malaking bahagi ng lupa namin,gustong ilipat Ang boundary, na yung bakod o boundary na Yun ay hindi pinag awayan o existing na from generation ng Lolo at Tatay namin. Kami na po Ang existing owner ng lupa kasi Yun po Ang pagkakahati na binigay ng mga ninuno namin. Tuloy tuloy din po Yun at uninterrupted. Alam na po namin na safe po kami, pero nakakadurog pa rin po NG puso na may mga tao, relatives mo pa naman na may mga self interests na ganun, hindi na po sila nahiya sa mga elders namin na gusto rin nilang agawan ng lupa.

    1. Our mom got her share. We had the property surveyed and titled under our mom's name.
    2. Our mom died, so it is our dad & 3 brothers & 3 sisters left
    3. What is the next step for us so the property will be titled to us?

    We sold a tax dec prop originally owned by my grandparents. Paid estate tax when they died then again paid estate tax when my mom died. Yes 30yrs plus used by my grandparents

    Excellent information and explanation Atty. My question po: My two lots were used as part of a three-lots security for a loan taken obtained by my brother from a rural bank 30 years or so ago. Since that time, the rural had been sold and undergone several changes in ownership and name. Whoever is the new creditor bank has not paid the yearly taxes. Several years ago, I found out that the Tax Declaration in the municipality where the lots are situated was offering amnesty for unpaid real taxes. I checked with them and found out that the Tax Decs are still under my name so I updated the real estate tax arrears and have been paying the taxes since then. Going by the acquisitive prescription that you mentioned here, can I go ahead with lifting the mortgage annotation on the TCT on the basis that that the creditor bank has failed to foreclose on the mortgage within a prescribed period of time? Would greatly appreciate your advice/thoughts on this and how to proceed Atty! God bless po in all your endeavors and continued service to the community!

    Sir kami po pinapalayas ng isang tao na nagmamay ari ng katabing danaw ,actually ,tenant lng po siya ....3 bahay po kami na ginugulo niya ..inaangkin nya po ang mga lupa na kinatatayuan ng bahay namin..sakop dw po namin ang lupa na sinasaka nya ...ngunit 1990 pa po kami nakatira dito ...at hindi po ito sakahan...mismo po na tunay na may ari ng ,danaw ay nagsasabi hindi po sakop ang lupang kinatatayuan ng mga bahay namin ...hindi na din po mabawi ng tunay na may ng danaw ,ang kanyang lupa ,ngayon po ,pinapalayas po kami ,gusto po ipagiba lhat ng mga bahay

Mahirap lng po kami ,ang bahay po namin ay sementado pati bubong ,ito po ay pinagsikapan ipatayo ng lola kung namatay dhil sa highblood sa umaangkin ng lupa,nakakalungkot sir dhil gusto niya ipagiba bahay namin na sobrang pinag sikapan ng lola ko....dapat dw po kmi magbayad ulit ,,....di napo namin alm gagawn namin sir

    ayon sa experience ko as a DPLI. evaluate mo kung what year yan kasi nung araw pwd mo itax declare kahit forest zone FZ. Once kasi na FZ dmo sya pwd ipatitulo kahit pa yan situated at the seat of a city center bec of its classification.

    Atty., hi sa inyo!! Sa tagal ng panahon sinangla ito nga hindi kamaganak naming asawang lalaki lang ng kapatid ng nanay ko. At ng itoy bayaran sa halangang 1000 pho. Tubos 500=1500 pesos ng itoy tubusin hindi na daw dahil ni ramata nila ang titulo . At itoy nilipat sa pangalan ng sinanglaan nila na tao. Na nakikitira lang sa bahay ng lolo namin. Ngayon sila na ang nagmamay- ari nito sa lahat ng lupain

    Thank you Attorney for the information which gave me an idea when buying a property and also for our inheritance property. We have a land and the mother title is under the United States of America which is needed to be subdivided among the survivors heirs family members! Although this is a big headache for us as incharge of the property and i know this will cost for a couple of hundreds of thousands of pesos to break the mother title!

    To summarize, does tax papers make you own the land? No, only a claim. Does living in the land make you own the land? Only if you live there continuously for 30+ years without anybody else claiming the land. Conclusion, verify your land ownership with a title and tax papers from the government.

    Very clear and comprehensive, thanks Atty. If I may add to your list: Have the land surveyed: a relocation plan which should be approved by the DENR. If the buyer's survey plan is approved, then, per record of the DENR, seller's possessory right is assured; otherwise, - meaning denied approval - either because under the subject lot is inalienable or a prior survey plan has been approved - seller's right to the land still needs to be clarified further. A person can have either possessory right or ownership right to the land. Is he or she selling both? Thanks for the privilege.

    Sana po idagdag nyo sa TIPS na i-verify sa Register of Deeds office ang naka register na owner ng property. Naka indicate naman po yan sa Tax Dec, di po ba?

    Meron lang din po akong Katanungan
    :Meron po akong na acquired na Agricultural Land estimated 2 hectares Transfer of Rights lang po through Barangay/Sitio Certification at Pirmado nila ito, ang lupain ay hindi rin alam kung may tax declaration po ito, sabisabi sakop ito ng lupaing Katutubo/Ninuno/Manila WaterShed/ Protected Area bandang Purok Manabtak,Sitio San Joseph, Barangay San Jose, Antipolo City or Baras Rizal (Hindi rin po alam kung saan nasasakop na munisipyo)
    Ano po kayang Steps gagawin ko upang magkaroon ako ng Know how sa property na ito na 7 years na sa akin Upang magkaroon ng Tax Declaration and eventually Land Title? Maraming Salamat po.

    Magandang Araw Po Atty Ako po at 67 yrs. Old na last March 30... Nang dahil Sapag Claim KO nang aming Parte nang Lupa nalaman KO SA Register of Deeds na Hindi po ako na registered as my Father's Surname rather as my Mother's maiden name.
    I was living with my Grandparents ever since
    I was 7yrs. Old & Graduated High School using my Father's Surname and been known thru the community as such.

    Ayon sa r.a. no. 6657 sec. 14, registration of landowner Ang nakalagay at ito na yong tax declaration, at doon Naman sa sec. 15 registration of the beneficiary at ito na yong titulo, Ang Tanong sino Ang may-ari yong may hawak Ng tax declaration o Ang may hawak Ng titulo? Kasi yon Po Ang paliwanag Ng r.a. no. 6657 or carp law.

Ask ko po if maari ko po makuha ang minana lupa ng lolo namin na inàangkin ng mga apo ng pinsan ng lolo ko.Wala pong kapatid lolo ko nag iisa lang po syang tagapagmana at hindi nya pinagbenta ang property na iyon.May laban po ba kami bilang tunay na apo sa korte ?lampas. 50 years na kc d namin kinukuha ang lupa kc nasa mMaynila kami naninirahan at now dto na kami sa aming prob sya. Nakatira ngunit meron na pala sguater nakatira sa coconut land na iyon at nagbbenta pa ng lupa dahil sa lolo daw nila yon na basta na la lang tumira at hindi kumunsulta sa tatay namin na ngayon patay na.Wala po silang proof na donation galing sa lolo namin o ebidensya na binili nila ito sa lolo namin.Bilin po ng tatay namin na kunin napa namin ang property kasi hindi nila ipinagbenta iyon para pamana sa amin..

    May Tanong po ako attorney, may ibininta sa akin na portion of lot, pero na belong po sa timberland Kaya, mura lang. Dahil understood na hindi pwede patitulohan dahil timberland. Ang Tanong ko, po:
    1. Ipinahintulot ba ng batas Ang ginawa ng right holder na ibininta nila Ang ilang bahagi ng lupa na timberland?
    2. Ipinagbawal din po ba ng batas na bilihin o bumili ng portion of land na timberland?

    Determine kung ano ang classification ung lupa. if A&D safe yan pero pag RP ang declarant hindi sya safe kasi kahit kelan man dmo pwd sya applayan ang titulo.

    Tanong ko ay ganito:
    Ako ay tenant ng lupa since 1980’’s
    Now, gusto ko sanang bilhin dahil sabi ng may ari pwedi kong bilhin.
    Wala akong sapat na pera para ibayad ng biglaan o full payment.
    Atty. Gusto kong malaman kong tutuo ung programa noon ng GOBIERNO/AGRARIAN REFORM na pweding babayaran ang lupa by means of hulugan tuwing anihan???
    Yan po Atty. ang nais kong malaman ng kasagutan.

    You need to revise Philippine property law. Tax documents do not confer ownership of the property. It's called ILLEGAL SQUATTING/POSSESSION OF PROPERTY!

    Good day attorney. Sana po makagawa ka po ang episode about sa bintahan at bilihan ang temberland free patent title. Mejo nagugulahan po ako dahil sa mga loophole ng batas. According po sa nabasa ko pagdating sa temberland free patent ay covered by agricultural free patent from commonwealth act 141. And feb. 2019 have new law sign by PRRD an act a free patent agricultural act abolished the commonwealth act. 141.

    Hello Atty. Nai transfer na sa pangalan namin ng ate ko iyong real properties ng parents ko , May title na since namatay ang parents ko last 2004 and 2009. Kaya lang sa real property tax declaration is nasa name na sila. So, I let the Registry of Deeds dito sa province namin na Kung pwede ilagay na Lang iyong names namin kasi my title na. Verified nila iyong requirements at May kulang CAR daw, it’s 12 years ago na at Hindi ko mahanap iyong requirement na yan . Kailangan ba iyong requirement na yan , titled naman na iyong property.
