    👍👍👍 nakakarelate ako... WE are in possession of the property. But neighborhood claims ownership coz she said she bought the land through her aunt.and she is holding tax declaration certificate....Now here comes the personnel coming from the DENR-On Lands, when they scrutinized the paper , the Lady personnel directly tell my neighbor ,YOUR PAPER IS INVALID, IT NEVER SHOWS ABSOLUTE OWNERSHIP... ayon, Para siyang ginisa sa Sarili Niyang mantika.... Kaya sa mga Tao na in possession for long years may pera mam kayo o Wala.... Wag magtakot to know what right in the accordance with the LAW ...Hindi lahat Ng papeles na hawak2x Ng mga taking gustong umangkin Ng property ninyo ay legit....BE WISE...Dito malaman kung SINO AND MAY ALAM....✌️✌️✌️✌️👍

      Paano po yung nagbebenta ng lupa na nabili daw nila yun sa may hawak na Tax Dec?
      Deed of Sale lang ngayon ang document ng nagbebenta at ang latest Tax Dec ay nasa lumang may hawak pa rin ng Tax Dec.
      Maari po ba niyan ibenta ang lupa? at maari po bang bilihin ito?

      Sir sung gawain namin wala na ang tatay namin bay sya ang may air at may cdastral survey at tax declaration di lang namin alam kung saan ang title kadish baha Nagasaki ang mga papel lahat at may tax moping na po kmi ang gawin namin.atty tolongbpo mahirap lang po kami

      Atty, ask lang po? Pano po f yung lupa is yung survey plan is naka name nang lola ko. Tapos yung mga naka occupy sa lupa is nag bayad nang tax kaya nagkaroon sila nang tax dec. E sino ba mas may karapatan po? Ang nagbayad bang buhis ng isang besis. O yung naka lagay sa survey plan..

      Ay diba pag mag apply ng titolo ay sinuri naman ng DENR yung lupa hidi yan bastabasta mag apply ng titolo puntahan pa nga ng land inspector yun toto o ba yung nasa documento wala bang ibang ng may ari dada an yan sa mga prosiso

      Sir mawalang galang na po ,! How about to this situation ,,, the DENR ordered to vacate the area , decission of the regional director but they did not vacate till more than 20 yrs but the land declared to the firts occupant,,, who is in title to apply for titling?

      Attorney nakabili ako ng lupa sa balo na asawa kasal at nakapangalan sa name ng asawa pero patay na po, na find out ng bir na may ibang anak sa una ng asawa na namatay, pero d naman namin makita kong saan ung anak naka pirma sa death cert. Ano maari po manyari para malipat sa name namin. Ty and god bless po.

      Atty may tax declaration po kami sa pangalan ng Lolo namin ,KAPATID ng Father ng Tatay ko, Grade 4 lang Ang Tatay ko at walang pinag aralan Ang mga KAPATID nya,
      Dalawa lang sila Ang Lolo ko at Ang KAPATID nya na may Ari nang Lupa .
      Lima Ang anak ng Lolo ko. Pero NASA malayo at mga educated, nang malaman namin na namatay Ang KAPATID ng lolo na binata Walang Anak, Ang Tatay ko at Ang mga KAPATID nya ay Walang Ka alam alam . Ang Tatay ko pinatawag na na assessor's office dahil sa Lupa na yon pero Takot mag punta sa office dahil Walang pakialam, ilang basis na dumating Ang notice para ma process Ang tax declaration sa mga heirs nang may Ari na Ang Tatay ko at mga KAPATID na na NASA malayong lugar at Hindi na asekaso nang tatay. Nang maliit pa ako enu occupy NAMI Ang portion sa lupang ito, Maagann namatay Ang Tatay ko , Nang dahil wala nang na asikaso sa mga lupain ng KAPATID ng Lolo ko na binata, kahit sino nalang Ang nag occupy sa Lupa na supposed to be para sa mga hiers nang KAPATID ng Lolo namin na binata.
      Nang naka graduate ako . May isang mga concerns na mga tao na naka pag Sabi sa akin na kailang asikasohin ko Ang Lupa sa na sana sa mga pamilya namin
      Nang tinitingnan ko Ang mga documento Ang ibang Lupa ay minamay Ari na ng Walang Ka relation namin through affidivit of claimed , Ang Iba binili sa MGA taong hindi hiers nang Lolo namin,.
      Humingi.alo ng tracer kaya Nalaman ko LAHAT kung papaano NILA na transfer Ang Lupa na supposed to be sa Amin .po
      Nang malaman ko LAHAT may portion sa Lupa na yon na NASA pangalan nasa nang Grand Mother namin, at may titled na 1.4 has.
      Ang ibang area na around 5 has. Ay into occupy ng MGA Hindi relative namin , dahil pakamatay ng KAPATID ng Lolo namin na may Ari ng Lupa kahit sino nalang Ang uma angkin.
      Nang nakuha ko na Ang LAHAT na documento, ini informed ko Ang MGA uma angkin na MGA tao na Ang Lupa Nayan ay sa Amin., Pero Hindi sila nag alisan po.

      ISA NALANG BUHAY SA KAPATID NG TATAY KO, Kahit Tatay ko matagal naring namatay. Ang Hindi na titulohan ay MGA 3 has nalang po . Tax declaration lang ng KAPATID ng Lolo ko Ang hinawakan ko na palagi Kong binabayaran pero hindi kami Ang nag occupy.
      SANA MATULONGAN.MO KA MI . ANO ANG IYONG MA E ADVISE SA AMIN PO.
      SANA MA PAGSABIHAN MO KA AKO KUNG ITULOY KO BA ANG PAG BAYAD SA BUWIS DAHIL MATAGAL KO NANG BINUBUWISAN PERO WALA KAMING NATANGGAP SA LUPANG ITO .

    Hi, Atty! Ako po si Mae Cruz at idudulog ko po sana sa inyong tanggapan ang problema ng aking tatay. Siya po ay na stroke at labis na naapektuhan dahil ang bahay na tinirahan niya ng 60 years ay maaring makuha. Ito po ay mahabang usapin at ngayon palang ay nagpapasalamat sa inyong pagbabasa at pagunawa.
    Ang lupa po na aming tinitirahan mahigit na 60 years ay nakapangalan sa aking tita na kapatid sa ina ng aking tatay. Ang lupa po ay nasa samahan o "rights" kung tawagin nila at ang eligible lamang sa panahon na iyon na mabigyan ng lupa sa samahan kahit magkaanak ngunit iba na ang apelido. Nakatira ang tatay ko sa bahay ng aking lola, at ang ngayon na tinitirahan namin ay bakante pa sa panahon na iyon, hanggang sa naging magasawa na ang aking magulang at ang nasabing bakanteng lupa ang siyang tinirahan nila. Sa madaling salita po ay nakapangalan ang lupa na tinitirahan namin ngayon sa aking tita.     Salamat sa iyong programa attorney,ngayong alam ko na na ang tax declaration ay hindi proof of ownership...dahil ang lupa na tinitirahan naming apat na magkapatid ay binili ng aming ama ay dineclared sa pangalan ng aking pinsan na pinatira sa amin at pinapaaral ng ama ko,ngayon gusto na nyang kunin at gusto nya ipatitulo sa kanyang pangalan,pero hindi sya nagtagumpay dahil hinahanap ko ang kasulatan nang may ari at ang ama ko na syang bumili sa lupa.pero hindi nya pinakita sa akin,ninakaw ng pinsan ko bago mamatay ang aking ama....kaya ngayo gusto parin nyang kunin dahil na sa pangalan nya ang declaration ng lupa namin.

    Thanks for this presentation Atty Batas Pinoy. The problem with our nation's impeding developments are mostly because of disputed properties. No wonder why those Insik wants to claim the WPS. Because no one lives there and without coast guard to protect our territory. And there are squatters everywhere you go causing PH gov delays in road construction and real estate improvements. People need to know even if it's a long time ago, the costs of living means includes: paying for land ownership, property tax or rental for housing to the owner. For lot owners, best thing to do for your vacant lot is to fence it all around and post sign "No trespassing, private property." Hopefully that would deter squatters from building and living in it.

    Good day atty. Ngayon q lmang po na-follow ang Batas Pinoy. Sa kasalukuyan po ay may usapin kmi s lupa n minana ng nanay q sa magulang niya na ipinamana nman po s amin magasawa . Ang concern po nmin ay may gumamit ng lupa (unproductive farmland) n di nmin kilala. Ang sabi po nila ay matagal n dw cla doon - at nagtayo n nga po ng concrete houses (2). Ang titulo po, tax dec, updated recivo ng bayad s amilyar ay hawak po nmin dahil kmi nman po ang nagbabayad nito taon taon. Pinuntahan n po nmin cla at nagkaroon po ng paguusap s brgy sa harap ng kapitan noon Dec 1, 2021. Nagkapirmahan po at ayon po s napagkasunduan ay bibigyan po sila ng hanggang May 31, 2022 upang makahanap ng malilipatan at iiwan n nila ang lupa..Ang problema po ngayon ay may lalaki n nagmamatigas n hindi daw sila aalis doon dahil matagal n cla nakatira doon. Ang lalaki po n ito ay hindi kasama humarap s brgy nang magusapusap kmi at ni hindi po nmin nkikilala bgaman inimbitahan nman po ng brgy lahat ng nakatira doon s lupa.     Good morning po Sir. I greatly appreciate your program because it is informative and could help a lot of people who have no enough knowledge of land dispute, not to mention that court cases are very expensive and the decision takes so much time to years like my case. My case is this, my elders bought a farm land in 1966 which was developed continously by my elder brothers until 1996. One of my brother left for abroad in 1995 but my other brother continued the operation until he died in 1996. This was a public knowledge that the property was ours and developed by our family but then my family failed to let it be titled. In the mid of 1996 due to the existence of NPA, the entire barangay people left the place l and abandoned until late 1999 when the entire barangay was declared

      Free from insurrection (NPA). Barangay folks went back. Unfortunately, my family failed to go back immediately n a stranger came to occupy our land which my family developed for almost 35 years and tried to claim in the Bureau of Land the ownership of the land in 1999 when they transferred, not knowing that we have Tax Declaration based on the Deed of Sale executed in 1966 and was duly anotated at the Registered of Deeds. We came to note of their intension only in 2000 when one of the claimant when to our house in another Municipality to ask for our docements which made as astonished because the Bureau of Lands, in Tuguegarao City, Cagayan, failed to give us notice, despite their conducted hearings. Immediately upon knowing this situation, we went to the concerned Bureau to inquire, Indeed, they already had hearings to the case, so we made an intervention immediately and elevated the case to the Department of land in Mla as well. The BOL in the province expedite their hearing already in our presence but they favored the false testimonies of the other party and made a decision. We appealed in the Dept. of Lands in Mla. Who conducted an investigation which reverted the decision of the Bureau. Unfortunately, we are again behind because they already appealed in the Court of Appeal which uphold the decision of the Bureau using the findings of the Bureau only. It went until the Supreme Court with their evidences disregarding the Decision of the Dept. However, we had a case of harassment and claim of ownership at the Regional Court, Brach I of Tuguegarao since 2000 which was decided only in 2016 in our Favor. But the other claimant elevated again to the Court of Appeals which is still on going. NOW, the PROBLEM IS: 1). Can I already apply for the Titling of the property based on the Decision of the Regional Trial Court Decision? Because it take time again for a case to be decided?

    Hello po attorney! Nice to hear your program. Parang dito ko po makikita ang solution ng aming problema hingil sa lupa. Mayroon po kaming kapirasong lupa na iniwan sa amin ng aming mga magulang. Sa aking pagka kaalam before the world war II broke up, my grand parents to my mother side already possesed this property and introduced improvements therein by planting coconut tress and other fruit bearing tress.
    My grand parents acquired their tax declaration on 1949 after the war. When my grand parents died, said tax declaration was transferred to my mother named Amina Elian in 1954. I was born in 1960, and I witnessed said improvements. At the age of 7 years old I already helping my father in hauling coconut for making copra. I also help my father in planting additional coconut and other crops in this land. This could mean that before I was born, my grand parents already planted coconut tress in this land. During my childhood until this time I don't remember anyone telling us that they own this land. In 1965, the cousin of my father name Masla Macaumbang applied title to a parcel of land containing an area of 120Ha. They have acquired their tax declaration in 1964.This land is located at the heart of the city (Pagadian City). Hundreds of claimants already established possession within this parcel of land including ours having an area of 3.7Ha. The claimants file a petition in the court after knowing that their land was being titled by someone. Our land was again included in the claim of certain Francisco Vertudez who also filed petition and their petition were granted by the court in 1986. It was followed by the issuance of separate title but our area was reconveyed to us by Mr. Vertudez by virtue of waiver of rights in 1992. Since then we already live in peace in this parcel of land.
    On April 22, 2022 a sheriff came to our area to execute the writ. They told us that this land belong to the heirs of Masla Macaumbang and his brothers and sisters.
    Attorney Sir! As of now we are still occupying our land and we will never give up because this land belong to my grand parents. We are their heirs and we will fight to the last drop of our blood to defend this land.
    Please we need your brilliant advise.

      Based on the facts of your narrative, assert your ownership. You mentioned about "writ of execution". I don't have facts of the case. Nonetheless and simply put, there was a case filed in court pertaining to the subject land. The question now being what did your family do about it? Did you assert and depend your possession and ownership in court through your lawyer? If is so, then, you may have lost the case, either by default because you did not appeal the decision of the Court BEFORE IT BECAME FINAL AND EXECUTORY. The fact that a writ of execution was issued and entry of judgment was made, this means that since no perfected appeal from your end was made, then the issuance of the writ of execution becomes a matter of course. You confer with your lawyer and asail the decision of the court by CERTIORARI under rule 65 of the Rules of court. Whether this remedy is still appropriate under the circumstance may only be answered by your lawyer as he/she is in possession of the records of your case.

      kung ikaw mismo ang nka pangalan sa titulo pwede ka nman humingi ng kopya ng titulo sa REGISTRY OF DEEDS na nakakasakop ng jnyong lupa.

    Hi Attorney! Nice to hear from you again. While I was listening to this topic, I just came to realized what had happened to us 30 years ago kung saan nakatirik yung bahay namin for so many years, in short we are the actual in possession, suddenly my father’s distant relative wants to claim the lot without any documents on both sides, but as I learned from your explanation kung sino yung nakatira ng matagal ay dapat sila ang may actual in possession. Again in short na ibenta nila sa iba at kami ang naging tenant.. hmmm long story Attorney and I don’t know how to shorten it but anyway I run this video twice without skipping ads.

      Hi Mary! Glad to hear from you again! Thank you for the persistent support. The keyword in this issue, is ACTUAL POSSESSION IN THE CONCEPT OF AN OWNER, plus tax declaration certificate plus the payment of real property tax are prima facie proof of ownership. Prima facie is not conclusive until a title is issued under our Torrens system. Hence, if someone is an occupant for 10 years to 30 years, even though he/she has no tax declaration certificate yet, and herecomes a stranger with a newly issued Tax Declaration certificate over the same land, the supreme court ruled, that the Tax declaration certificate without constructive or actual Possession of the land in the concept of an owner, cannot prevail over the occupant over the land in the concept of an owner(not as a tenant, lessee), even in the absence of a tax declaration certificate.

    Attorney i am your avid fans of your blog, i would like to ask with you the legal advice regarding the mother of the family if she can still have a legal share to own the land if the mother was been legally married to other person after her 1st husband was died , the said property land was acquired to owned by her 1st husband as inheritance property from his family.

    Hi! Attorney i have more clarification tungkol sa ganitong topic. "TAX DECLARION OR TITLE OF LOT VS. IN POSSESSETION OF PROPERTY for 64 years na. nakatira yung tiyuin ko. Nyayon yung lang problema namin wala kaming record sa lupa. Yung kabila naman hndi mapaliwanag kung paano nabili ang lupa. Sa side namin attorney nasira na ang bahay doon sa lupa dahil sa bagyo recently hndi na nakatira ang tiyuin ko doon pangalawa hndi na pinapatayuan ng bahay ang lote doon sa nagclaim dahil may tax declaration cla at turn into a title in 1995. Balak na rin nila magpatayo sa lote na inangkin na nila dahil ni land grab lang ng tatay nya yung lote kaya nakatitulo cla. Yung lola ko walang grado at yung mga tiyain ko walang pera pambayad sa tax declaration at penalty. Attorney mawawala ba ang continuity ng lupa or possessesion kung sakali mapatayuan nila ng bahay?? How long ba kami pwuede mag file ng illigal entry sa kanila kung ipilit nila magpatayo ng bahay?pwuede ba i cancelled ang title knowing na yung tax declaration nya ay para sa residential only at hndi sa buong lote na cla katabing lote rin nakatira. I hope bigyan mo ito ng paliwanag dahil parehas na parihas sa video mo kaya lang titulado na at ginigiveup na ng toyuin ko dahil naguluhan na cya at wala pang pamgpagawa ng bahay dahil nasira sa bagyo.     Since my mother’s death in 2014 ako Po ang nag take over I’m paying for yearly property taxes. I Repaired all roofs and fallen garAge maintained the safety of my parents property . My mother handed me the title of the property years before she died and we made writing to let all her siblings that were there with her in Rhode island to know her desire to sign up for the transfer or disposal of the property in favor of me her daughter . Two of my brother passed away and didn’t sign up for that waiting for my other three older brothers to take actions . Now after so moment years the property has been open to Pay for all taxes incurred after the death of my mother. My oldest brother finally came to pass the word that he is going to transfer it to me. How do I stand on this . My mother wrote a will in the presence of her sister who is still alive at this time she’s 93 and two more witnesses but one died . She wrote a note address as her living will and signed it . I also signed it that she’s in favor to give it to me. Since then I manage to care for the home and my mentally disabled single brother who lives there . My brother and my mother had both signed that request for the property to be in my name
