  • What happens when an F1 student marries a US citizen?
    The process is pretty straightforward. First, the U.S. citizen submits an I-130 and the international student submits an I-45 to change their status to lawful permanent resident.
    After you submit these forms and some other forms you will also have to submit documents that show that the U.S. citizen can support the foreign national and will not become a public charge.
    Once all of these steps have been completed the foreign national will receive a work and travel card, which will allow the foreign national to obtain a Social Security number so that they can start building a life together with the U.S. citizen.
    From here the next step is their interview at USCIS, which we practice with our clients before the real thing. If they pass the interview they will receive their Green Card and have the ability to apply for citizenship after a few years.

      If you are talking about citizenship, the clock starts for three years from the start date of the green card.

      Definitely ask a lawyer because there is more/different paperwork (I think). Like *the i-485 is i-485A (under the blah blah Act of xxxx year).* Not exactly that name, but you get my point. *My experience is easier & straightforward* because I have not overstayed.. but I know it's possible just a hassle. good luck

    Hi Jim! Great video! Maybe you can make another video giving an answer to my question: I am a US Citizen and my partner is a British citizen who teaches school in Beijing. He is planning to come to the US to get a masters degree (F1 visa i assume) and wants work part time as well (possibly still teaching online students but don't know if that's part of the F1 visa). We have also talked about getting married in the next year or 2. What's the best/fastest way for him to become a permanent resident? Should we get married BEFORE he comes here to attend school? Should he come here on an F1 visa and work while studying and LATER we get married? Trying to figure out what's best and what is allowed in each instance. Like for example, if we did a fiance visa he might not be able to apply for school for a year, or he has to leave the country after 90 days and THEN can apply for school? What if we get married but he still needs to work in Beijing for 6 more months...can he go back there temporarily? OR If he gets an F1 visa and we get married AFTER six months to a year of him being here, then by the time his school is finished a year after that, the permanent resident status would have been approved by then? I wonder because of the financial support thing... he can support himself financially but do I have to because he won't be able to work in one of these instances?

      Green-card holder minor who's outside the US. Where is the petitioner (or are you the petitioner)? Does the petitioner want the minor to stay with them in the US? If for any reason the US Resident Minor is in (any) the country outside the US, there should be a visa to allow the minor to stay in that country. (typically a student visa). As to your N400 you've been waiting 2 years and that's quite long. They (uscis) said it's being reviewed then you should wait. USCIS should send you 'written' notice of that.

    I am a USA citizen and my girlfriend is ( “F1 student visa “) . Her status was terminated on February /2020 , she has 5 months to apply for reinstatement and the deadline to apply is going to be this July 24th / 2020. We started dating 1 year ago and we decided that we want to get married ,( legit marriage -we love each other ) . We want to get married this October 4th 2020 at church ( we are Christians) , and we want to expedite the process of green card by getting married now before July 24 ( the deadline to apply for reinstatement) so she doesn’t apply for reinstatement . We want to know if we would have any problem considering the time line we have ; we would have to get married at city hall and send all paperwork for green card to the immigration before July 24th ???? Please help ! Thank you so much !

      @@burekking5306 yes!!! We got married then and we submit all the required form and documentation and we did not have any issue with any paperwork ( we filled ourselves). After that couple months went by and they sent set the interview for us and it was an easy process and we pass! Today we are well, she did get her green card!     I was a bank employee in INDIA and I have applied for sabbatical leave for studying 2 years masters in United States but they rejected my application
    And now I am in F1 visa and staying in US now my employer has sent me an email that THEY WILL INFORM THE US EMBASSY THAT I HAVE VISITED US WITHOUT THEIR PERMISSION AND I AM ON UNAUTHORISED LEAVE.
    So will it affect my stay here in US if they inform US Embassy?

      Yes they can if they earn enough and they will need to show proof of income when the foreign national is applying for their F-1 visa in their home country as that information will be printed on their I-120 if they're approved of the visa.
