    Very helpful
    Mother in law has lived in the US since 2001, without legal papers. She’s in the US illegal now.
    Her adult son is US citizen
    Her husband has a green card.
    What would you recommend she do? And is it better for her son to petition her or her husband?
    Is it better to apply for her green card while in the USA or it’s better if she leaves to her country and then apply?

      @mary, the son can petition her then she will need an i 601a waiver and her husband is the qualifying relative. See my vido on the i 601a waiver.

    I have question
    I entry to USA as a j-1 for one year , my status end in 01/25/2024
    But before this date I apply to student F-1 . Now I am waiting for F-1 around 4-5 month .
    But I want apply for asylum after one year , but not more than 6 month.

    You once answered my question, if I can apply for an adjustment of status, even if my wife went to prison because of parole violation. I've been trying to get approved for weeks, in order to visit her ,and get a form signed for my application, but no approval yet. Is it advisable to mail her the form to sign ,and mail it back? Thanks

      Yes you can correspond by mail. Keep all correspondence as evidence.

    My mother was approved for the green card back in the late 80’s which was petitioned by her brother who is a US citizen.However , she never moved forward with it at the time. Is it possible to revive that application again?

    @ Gary Law. I just need some clarification regarding Immigration and Nationality act section 245 (I). Coz I already submitted my I -485 and now currently being reviewed but I came across with this section I really don’t get it. Coz I overstayed my visa and we applied for I-130 family based visa year 2022 so I’m not sure if I still need file that form for that section together with my I-485 should be. Appreciate you’re response sir so I will do correction while it’s not being approved or no decision yet. Thanks!

      @jessica--245i allows those who had an application filed for them before April 2001 to pay a penalty of $1000.

      No. Quilantan is only for those who entered without a visa.

      there is no time frame by law, but I always say at least 3 months.

    Hello, Please I have a question. My spouse is trying to adjust his status thru marriage. However, he entered the U.S through Mexico border on foot. He was detained at the Homeland security holding center, interviewed and later allowed into the U.S with a pending court removal hearing and seeking Asylum procedure. He was given a working permit but his court date has been rescheduled several times over the course of 3 years since he entered the U.S.A. And then we met and got married two years ago. We have been scheduled for an interview on August 1st for the marriage status adjustment. My question is do you think bc he entered the U.S on foot the matter of quilittan will apply to him?? In the documents in which he was released from the immigration holding center it states that he was neither admitted nor paroled into the U.S. which is confusing bc they released him and gave him a working permit. Thanks for the reply.

      Hi Doris, unfortunately he does not have a legal entry. He is given the work permit because of the asylum. You need to consult an attorney. Maybe he can seek Voluntary Departure and return with the green card thru you! But please seek legal advice before you do anything.

      @@GrayLawTV I have AMAZING Good news !!! We went for the interview on Monday, it went so well and was approved. Today is Saturday and he received the green card in the mail !!!! If that is not divine intervention...i don't know what is !!! We are so elated.

    My opt expired and I'm on my 60day grace period. My I-485 has not been filed due to retrogression. Priority date is June 12th.
    When my grace period is exhausted how can I remain in status until my date becomes current to successfully adjust my status?

      @dos--You can either pursue a new course of study or go home and pick up your green card in your home country.

      The window from when my case may become current to when my 60days is up is less than 30 days.

    Good day sir. Thanks for the video. I am on a j-1 visa and applied for a waiver. My visa expires in 6 months and the waiver can take more than that to be approved. Meanwhile, I found a company providing me employment based greencard. What should I do? Thanks.

      You can indeed apply for the green card. This takes at least 2 years...so if the waiver is not approved, you can return home for 2 years and come back with the green card.

    Question: will the final action date for EB-2 advance significantly come October 1 and the beginning of the new fiscal year? Will they clean up a lot of the backlog from FY '22 and resume the FY '23 petitions?

    Unfortunately I fell out of status when the pandemic started. I got covid had severe complications and when I decided to leave my son ( us citizen) was found that he has a rare disease and we can’t leave . He needs a long ( very long ) treatment.       You should extend your EAD and upon receipt, it will automatically extend your EAD for 6 months. You need to maintain your status with an employment based adjustment.

      No...applying for an f-1 will not affect your green card case....but if your under 21 years of age, two years is too long....you need to inquire.

    Pls when I track for my green card it says delivered October 6/2022 but I didn’t receive it I went to the post office they said it was delivered to the address given I think my daughter’s husband who lives in the same address return it to the post office without telling me cause they are going to divorce or refused to receive it
    I don’t know what to do to get my green card again or where to ask pls I need your advice

    My husband didn't know he is unlawful because hi is an American Indian born in Canada. He entered the USA with his status card for American Indian. Told the officer that he is moving to SC Lancaster where he bought a house. That was in 1992. Now the USCIS denied his I-130form. Hi send it for me , I'm married to him since October 2019.
    We had a interview on 28.february 2022. And the officer said I will receive my green card in 30days. Everything is ok. Now, on 4.November they denied my husband's petition I 130 because they tell him he is not a lpr. So they denied my I 485, because he would not have the right to apply for me. I'm just shocked 😳

    I was married to a military man in 2018 and after two months of marriage, he put me out and I end up into a woman shelter, because of his several women that he's having and I talk to about it. He filed for divorce in 2019 and I sign it in 2020. Is there anyway I have a chance of get a green card through my situation?

      Yes you Can !! Did not waste any time, you have 3 years from the legal divorce to Appeal the case in get the Green Card, look for a good Lawyer 🙏👏👍✊🏾

    Dear Sir, If I enter USA by my IV category SB1 visa, Should I get a new Green Card? Or Is my existing green card (expiring on 05-21-2027) still valid as a proof of my permanent resident status? Can I exit and enter USA using my existing green card? Thanks

    Is there any way I can do adjustment of status to my green card when I married to green card holder since last year. My I 130 petition is under processing since 1 years. But am thinking it’s gonna hard for me to maintain my f1 status. Is there any way I can adjust if I fall out of status. Thank you.

      Hey Praavesh....if your spouse becomes a USC and you fall out of status, you can indeed still adjust! Try to hang in there though as the 2cnd preference is current for you. Push them in trying to get the approval so you can adjust now without waiting.

    Good morning sir..I am f2a category my husband from New York puting for me and everything is ok my case complete sin 4fed 2021 nvc send email to me say them is waiting on guyana embassy to set date for my interview to send done my document. With in 60 day they get back to me I finish .went i contact guyana embassy them say that the waiting nvc to send done my document first come first service first come first service I get a 120 day more waiting time I almost finish it and no respond bk I am confused rigth ..I really miss my husband ...my question is y d embassies r taking so long to give people date for interview ...dis long waiting is breaking up alots for people

    Hi Mr. Humberto. thank you so much for this video I and my brother came to the US in 2016 as an underage with a visiting visa. in 2020 my dad who is a green card holder filed for an AOS for myself and my brother before I turned 21 last year. is there a chance of it getting approved and what would be a good way to prepare for an interview in a case like this?

    @Gary Law. My case is that I came to USA via B1/B2 visa right before Covid happen and before my visiting visa expire I apply for another 6 months extension. I waited for my extension to get approve for almost a year and a half and when I got my form was already expire so I just pay for extension for nothing so Me and my partner got married and he filed for I-130 petition and were still waiting for the approval its been almost 10 months. I just want to asked if it’s possible or okey for me to apply for I-485 (Adjustment of Status) while waiting for the petition to be approved. By the IM already fall out of status coz my visiting visa was expired. Thank you

      it depends of husband's status. If he is a citizen, you can.
      I just want to share my experience.
      I had a completely same case ( my husband is a green card holder), but our petition has been approved and I have applied for i-485 and after one year of waiting they denied my application for adjustment of statusand explained that I was out of status when I was applie .
