- LIVE COURT CAM: NM v. Gutierrez - DAY 10 - CLOSING ARGUMENTS - Defense for Hannah Gutierrez rested after calling one more witness to the stand. Gutierrez, 25, is charged with involuntary manslaughter in the death of cinematographer Halyna Hutchins on the set of the movie 'Rust.'
Alec Baldwin, star and producer of “Rust,” was pointing the gun at Hutchins when the fatal shot was fired. Director Joel Souza was also injured in the accident. Baldwin claims he pulled back the hammer of the gun but did not pull the trigger. Gutierrez faces up to 18 months in prison and a $5,000 fine if convicted of involuntary manslaughter.

again, two others were indicted. One took the plea and Baldwin's trial is upcoming. So she isn't the only person being held responsible
Dave halls took plea because he set up hannah it was planned its setup he knew all along
It's absolutely her fault. Anyone else's involvement or fault is no more than the butterfly effect of her negligence. Nobody else was in charge of making sure the weapons on set were live round free and safe to be used for acting. Baldwin and Hutchins were doing their jobs. Baldwin has acted on hundreds of sets and was doing the same thing he had done so many times before- making sure the shot would look right. No one thought anything of it, because that's what actors and cinematographers do. Because they expect that the person responsible for the safety of the weapons has done their job.

It comes down to she was young and shouldn’t have been in charge I worked for years under someone before I was ever considered to be a lead armor and that’s with Gunsmith and Military Training. Yes she is at fault but the production is as well for cutting corners

I have no gun knowledge, yet if someone put me on that set and told me that I was the main person responsible for gun safety, I'd be checking and re-checking to make sure every single thing loaded into that gun was 100% a blank. Having watched the entire trial I agree with the verdict. The fact that the jury came to their conclusion so quickly indicates it was unanimous. She really can't use a defence that she was young and inexperienced. She willingly took the job on knowing this. Her incompetence led to the death of a lady, and the loss of Ms Hutchings life is the real tragedy here.

@@perezlyn pretty obvious if you are paying attention...beside the metal detector and search protocols before entering the Court....and a deputy sheriff took custody of the firearm until needed in court and the fact that the court was aware of the firearm kinda tells you that it's a safe and has been checked...it may appear that he pointed a firearm at the judge but he didn't...it was a movie prop...the judge ,prosecutor and deputy all knew that it was safe or it wouldn't have been there...the judge should have explained that..if they were so worried about it being loaded in court why didn't they have that deputy sheriff check the firearm before handing the bag to the guy....they all knew it was safe

This family should be grateful that they have their daughter. 18 months is not long at all and maybe this will help her. I don't think that this girl is a bad person I think she made a lot of stupid choices but she's got her whole life ahead of her and I think that she will be okay.

This verdict was justified. I'm glad for Halyna's family and loved ones. It can't undo the damage that the loss of her life at the hands of Negligent people. I think Dave Halls should've faced the same fate as Hannah.
It'll be interesting to see how the Baldwin trial in July will shake out.
I live in Albuquerque and will probably go to Santa Fe, to attend at least one day of his trial.
My uncle was a Superior Court Judge in Los Angeles and he signed the Warrants for Tex Watson, Patricia Krenwinkel, and Linda Kasabian.

Agree 100% about Halls. This conviction and remanded in custody is very harsh considering he has walked away. And after changing his story about passing Baldwin the gun. I loved this prosecutor until she asked for custody. It was really unnecessary.
18 months is not long enough for a life lost. If she just would have done her job what a senseless loss of life.

Production was to blame imho. The first group of the production team that left, put the filming back, and that it so there were filming days lost, money lost. Besides it was a “B” movie. Very unfortunate.

If she doesn’t learn a lesson all on her own without her family always propping her up she will completely fail in life. She is 26 for heavens sake! No one wins here. It was sad watching her family get upset. But then again, Helayna's family has to live without her. But it was especially sad watching her Father at the end looking lost. Her Dad, who by all accounts was respected as a professional armorer with an inpecable reputation. Im sure he taught Hannah the best he could. Too bad she didnt take guns as serious as he did.

The prosecution's closing argument is compelling. Hannah was never seen shaking a bullet or round. She would lazily shake the box knowing that other 'idiots' (in her mind) have done the hard work. Makes sense that Sarah Zachary had problems because Hannah refused to work, basically. Others said the same thing, except production who are only trying to cover themselves for hiring her. Unfortunately. But no one said she shook a bullet, even production. The closing argument demonstrated her terrible work ethic in all areas. But also reckless. It seems that if she didn't discharge a blank deliberately to blast someone's ears off she'd have 'withdrawals' aka the N. Cage saga.
That's what I got from the closing argument. The defence's closing began as a shambles as Halls is speechless, unable to construct a coherent defence. Watch it.
They got it right, the prosecutor was amazing, and not only thorough but she was able to lay it all out and deliver the instructions to the jury in a simple and concise manner. She was excellent at not only doing all her homework and I mean all of it, she worked really well as a team player and I have to bow down to this amazing woman. One thing that touched a nerve for me in Mr. Bohl’s opening statement was when he alluded to the fact that she was not only young, but also a woman. The gender comment bothered me but I let is go. I am so glad Kari Morrissey didn’t forget comment either. For the first time in the entire trial Hannah looked like she was going to cry when she found out her fate. Congratulations to the prosecution team!

Sure, the set was a mess, that's no excuse. Sure, she was young, female, and inexperienced. Well, she knew exactly what she was signing up for. The Defense themselves said: "She basically grew up on set with her dad" at the start of the trial. She knew exactly what kind of storm she was walking into, better than anyone her age. There are so many strong young women who kick butt and _demand_ respect. Hannah was too eager to be liked, she wanted to be cool, to YOLO her way through life, and that's all fine but not when you choose to take on a role where keeping others safe is the primary task.
I liken this to a pilot who is required to reject a flight if the plane is wonky. Even if the company is screaming in their ear. Even if they're just out of flight school. Even if the Emperor of Japan himself is in the back demanding to take off on time. The pilot is the boss of that plane, even though they technically have a bunch of executives above them paying their bills.
There were 100+ people on set who were _counting on her to keep them safe._ "But Baldwin was scary and I was stressed" isn't an excuse. Unlike Hannah, Halyna wasn't a nepo baby who got handed the job through daddy's friend, she had to work hard to even be there. Hannah's lucky to get away with involuntary manslaughter because if they had drug-tested her, she may well have been convicted of second-degree murder.

Go watch the search warrant body cam of the prop truck in which Seth Kenney is present to put his two cents in to influence Det. Hancock as he did the entire investigation. He talks about that gun and round and even says "I'm still learning about some of these guns myself" and that he had to get her the correct size rounds for it. Nevermind heade sure to be there before police and already had the safe's code from Sarah. I've never heard of a potential trial suspect being given that much access and influence as he had over this main detective, and seeing all the filmed banter between them it is highly inappropriate and compromised the investigation.
Starting at 7:55:00 Hannah says "Sentencing is in May?" and her lawyer didn't try to get her the soonest sentencing date. He could have asked judge to sentence her asap. He was initially looking for a date in May. I wonder if it's his strategy to have her sit in jail as long as possible before sentencing so that he can argue the sentence should be time served.
In the end it won't matter. She'll get credit for time served. But I agree. He was a bit of a numbskull.

Seth Kenny was clearly never treated as a suspect even though he supplied the dummies and all the live rounds were homepressed with Starline shells just like the dummies he supplied. She didn't have to bring the live rounds to be negligent and the theory she was turning live rounds into dummies on set was ridiculous.

He has a strong motive to point the blame to someone else and its shocking how he basically led the investigation. The lead detective's behavior was completely inappropriate. The only reason Seth's company was searched is bc Hannah's lawyer was demanding it. They didn't bother dna or fingerprint testing the live rounds but they did test the 5 dummy rounds in the gun bc they were accusing Hannah of lying and switching the rounds aka tampering with evidence even though she always admitted to loading the gun. Sarah is the one who threw out ammo and didn't mention it until a month later after lawyering up. What kind of Prop Master throws out reusable dummies after shaking each one to make sure they aren't live?
So she faces a max of 18 months. Even if she gets that, she would be eligible for parole in nine months. Not sure why it was necessary to revoke bail.

For sure she will get the max 18 months . That judge had her mind made up from the beginning. I don’t think she could say the word remand any quicker than she did 😅

It has nothing to do with politics or his status or lack thereof as an actor, or about checking his own props. He pointed the gun at people, a no no. Gun safety on set assumes the gun is loaded and never points it at anyone. He caused the gun to fire..either his thumb slipped off the hammer, which will cause the hammer to strike the bullet & cause it to fire..which is what happened when Sarah caused a misfire...or while the gun was cocked ready to fire, he pulled the trigger...he was not scheduled to fire the weapon then. So no one was in protective gear or ready for fire in the hole. He was negligent..someone was killed. So he is charged with involuntary manslaughter. Hopefully, he pleads guilty now and saves everyone a trial.

I know, it looked like Hannah her lawyers and her family were ready to start celebrating even before the verdict was read. I really think they all thought this was the end and Hannah was going to walk out a free woman. There is something wrong with this entire family.

Tough on the young woman but you got to remember what this case is about - another young woman, a mother, has lost her life through the negligent actions of Guitierrez-Reed. If she had done her job correctly we wouldn’t be here today. In addition there are others on set that have involvement in the tragic incident and no doubt we have still to deal with further court time. This should be a wake up call to the film industry on safety on set and people must be responsible for their roles and others must respect their decisions.
I wouldn't have found her alone guilty.

She wasn't found guilty of drug use. Baldwin trial is coming up. Unless he pleas out. They don't try people together, usually. Hannah was responsible for the guns and safe use of the ammo and she was negligent. Two people were shot and a young mother died. Her son will grow up without one. Whatever Hannah's sentence will be it's nothing compared to that. It was a position of responsibility with serious consequences for failure, not a cosplay.

If you watch the search of his place on police body cam it is actually shocking because they allow him to roam freely while they search, and take him at face value to point out where in his entire messy ammo hoard they should look for the live rounds. And of course it's a month after the fact, mind you. He asks the detective he's had 40 plus phone calls with if she wants to spend the night there - oh, Just joking of course, because that's totally normal for a suspect and detective. They even offer to stay and reorganize his mess afterward. Unreal.

What I learned is that competent armorers on movie sets not run by cheapskate egomaniacs are still probably deluged by mixed up, incorrectly labeled rounds. Impressive that there are so few accidents of this sort. Big props to the real armorers.
It’s her fault. Doesn’t matter if it was low budget. She accepted it, and if she didn’t like it she could have quit. There are few accidents of this sort because all the other armorer’s feel responsible for people’s lives and don’t have a sliding scale on safety depending on the budget. When you first start out and want to make a name for yourself you get low budget shows. It was such an incredible opportunity for her to prove herself. You always start out getting paid low and working your butt off and then if you have to on your own, working nights weekends free to prove you are good, then as you go and you build your reputation the phone starts ringing for your services because they heard what a great job you did on some other job on the way up and you make more money. Its gets tiring hearing people complain about the low budget. Complain about “The Man” people who have put their low paying time in on the way up the ladder to become big names. Sitting in her car and not doing the work she was there to do and not taking her job seriously is why she will go down in history as the worst armorer in the world. this is why you hardly hear of anyone else. Lives were counting her.

She was no longer a girl but a 24-year-old young woman. At the latest when she realized that she could not do her job, she should have given up the job. Why didn't she do it? Overconfidence? The thought of being part of a Hollywood production? Or was she completely intimidated?
She will be in prison for a short time. Then she can rebuild her life. I hope this time in prison and the shock of being taken away directly will help her realize what her part is in this tragedy. That she will grow and take responsibility for her actions.
I also feel sorry for her. But she still has the chance of a new life.

Bowles has no chance from the get go. But I admire his calm, his resolve and his standing up for the defense. I think he is a good lawyer. The problem is: per duty and per definition, an armorer is always guilty when something goes wrong with weapons on a movie set. Even if he or she did not bring the live rounds, even if they tried their best... it is their job to be the first and last line of defense in terms of weapon safety. It is an unsurmountable responsibility. His arguments would be convincing for any person on that set except the armorer. It´s a tragedy. But he had no chance and tried the case professionally as far as I can see.

They got a lot of natural gas money around NM, but, they don't have anyone that knows movies and they're not going to get anyone that does know movies step foot inside the state. Too bad, too, because that WAS a pretty kickass little set.

Off script or not, it was HER responsibility as the firearms specialist to ENSURE that the rounds were dummies and not loaded. Alec IS an A list actor who is not the lone actor to improvise nor go off script. To imply that he is responsible in any way for the death of the cinematographer is absolutely wrong. Is he negligent? Sure, but guilty of co-conspiring to shoot and kill Ms. Hutchins, ABSOLUTELY NOT! The jury got the guilty person and she should be treated as such.
