    Whether we make a will for general provident fund of govt employees. Bcoz GPF rules says other than family member can't become a nominee. In this situation will make for other than family member is valid Sir?

    Sir please guide that can a relative of wife of an intestate male claim title to the property on the ground of long possession and after fighting a long legal battle with govt.agency, under the conditions that none of agnates and cognates of the intestate male took any part in the legal battle along with the relative of wife of an intestate male.

    In majority of cases it is uncontested eventhogh court fees has been higher than suit, what would be remedy for akin to suit court fees.

    One Religious Public Trust is there.As per it's Constitution trusty is to be appointed on heirship basis.Then under which Act heirship Certificat to be obtained?under Indian Succession Act1925 or under Bombay Regulation Act ?

    What if the succession certificate is granted for immovable property and the person who received the succession certificate from court in his favor sells the same and thereafter the succession is challenged by other heir...what could be done in such case?

    I am the legal heir and my uncle claims he is the nominee and joint account holder for my fathers financial movable asserts. He is unwilling to provide me my father’s pan card and aadhar card or it’s respective details. Claiming he doesn’t have pan, aadhar card and IT returns.Also, not providing me with the bank account , mutual fund , and FD details stating that he’s name is as joint account holder and nominee because it’s tied with his identity. Even though pan and aadhar card are tied to financial assets he is unwilling to provide me pan and aadhar card number which are clearly stated on statements and certificates stating its his personal info even though he is nominee and joint account holder of my fathers financial assets

    1. Is a succession certificate needed to transfer immovable property to myself when my parents passed away without a will and I am their only child? I already applied for a legal heir certificate.
    2. Is a succession certificate needed for the sale of my father's immovable property after his death? He did not leave a will and I am his only child. My mother passed away too.

      As far as my knowledge goes, Succession certificate is required for movable property. Having said that for you will also need family tree and legal heir certificate issued by Tahsildar. Anyways, please consult advocate. Thanks

      It depends on which State you belong to, as it differs from State to State. Normally for immovable property, when there is a will then it will follow the probate procedure but in absence of any such will, the immovable property can be inherited throu Letter of Administration (LoA) under Indian Succession Act, 1925.

    Hi!
    My father in law got 2wives (1st wife) Christian love marriage (2nd wife) family arrange marriage than 1st wife got 1 daughter only but 2nd wife got 3son and 2daughters.
    My father expired recently by living property which was gifted to 1st wife 22years back(ORAL HIBA), both my father in law, my mother in law and daughter used live from last 22years but now 2nd wife sons tell 1st wife to vacate independent house as they are legal hire after they dad expired.
    We told them that this property is gifted by husband 22years back but they are not able to digest and fighting with us.
    Note:-
    1. 1st wife CHRISTIAN
    2. 2nd wife MUSLIM
    3. We are still in the position in the ground floor but above 2 floor given for rent since 22years rents used by 1st wife but used give to father in law for his needs and for maintain his business.
    My queries:
    1. As per you she is 1st wife legal owner but they are holding original documents so they are saying they are legal owners. What to do now in this situation and how to get legal documents from them or any other alternative methods to acquire legal documents on 1st wife’s name?
    2. 1st wife would like to registrar this property on daughter name right now. What is the process as she doesn’t have any legal documents?
    3. As per you who is the legal owner and what legal or police action can be taken to make them understand that this is our property?
    PLEASE REPLY THIS QUERIES ON URGENT BASIS.

    If any person died without will and he was unmarried and his parents was died before his death and his brother and sister also died and he has two mothers then how can his property will be distributed among his nephew can stepmothers nephew entitled share in property
