Does the benefit of the evidence outweigh the penalty for getting the evidence illegally?

Why would you admit to opposing counsel that you obtained evidence illegally? That's an admission of a crime. It would be perfectly reasonable to say, "these would not be admissible in proceedings." There's not reason to say, "We got them illegally."

Except by telling them you will offer it to all the employees, they can turn around and get you charged with blackmail. Best part, nothing your firm illegally found can be used against them in the matter. In weeks your firm looses all it best employees as they try distancing themselves from your name
