  • Sleep apnea is one of the most common service-connected conditions veterans report to our law firm. In this video, VA-certified disability attorney Krystal Lechner explains how the VA evaluates and rates sleep apnea.

    You may be wondering: What kind of VA rating can I get for sleep apnea? There are three main tiers of ratings from the VA for sleep apnea.
    - Documented sleep disorder breathing with no other symptoms is rated as 0% disabling.
    - If you are diagnosed with obstructive sleep apnea and also have periods during the day when you are super sleepy after a full night’s sleep (hypersomnolence), then you may receive a 30% rating.
    - If you need a CPAP machine to sleep, you meet the criteria for a 50% sleep apnea disability rating.
    - If you have chronic respiratory failure with carbon dioxide retention, cor pulmonale (hardening of lung arteries) or a tracheostomy, you may be rated at 100%.
    There is even some evidence that sleep apnea and PTSD in veterans are connected. Learn more here: www.woodslawyers.com/are-ptsd...

    I got this as part of my disability. You guys should really do the sleep apnea sleep study while you are still active duty before you get out. if you are going to get out of the military plan all of your disability stuff before you get out. Don't go waiting to do your medical exams after you get out. During my last year I set up all kinds of exams for the things I would file for.

    I am rated 50% for Type II Diabetes. I've been Dx also, but not rated for, Sleep Apnea w/2L O2 at night AND Hypertension. Seeing Pulmonary/Sleep Physician tomorrow to discuss a potential connection for the connection for these last (2).
    For years and years... my Type II Dx was left untreated and referred to as simply "Pre-Diabetic"... then when the Polyneuropathy appeared... "Oh yeah, you're Diabetic!". Just prior to that visionary observance, I had a Sleep Study... "Yeah, you've got Sleep Apnea!" but no mention connection. With CPap, I was assigned an Oxygen Generator with 1L at bed time. Then a year and a half ago, had second Sleep Study done and Oxygen level was bumped up to 2L at bed time. As even with CPap, O2 levels were still dropping into the 80's.

    I had never even considered that sleep apnea could be an issue for me until I got a Whoop strap. Then I noticed that I have between 12 and 17 "wake events" every night. Upon my blood labs the VA doctors have said I retain some elevated amount of Co2 in my blood and I'm rated for PTSD/TBI with insomnia and trouble sleeping. Additionally even when I'm awake at times there's greatly extended pauses between breathing.
    After taking all these things into consideration I have scheduled a sleep study.
    My question is that if it is indeed sleep apnea, are secondary conditions given their own independent rating or will the PTSD rating just be raised?

    • @woodslawyers
      @woodslawyers  Před rokem +1

      That's a great question, Chris. Because of the relationship between PTSD and sleep apnea, veterans can claim a secondary service connection with PTSD. You must first be service-connected for PTSD, which you are. Then, you can file a secondary claim for sleep apnea. It is very important that you complete the sleep study to avoid denial of your claim.

Since these are proposed changes, they will not affect evaluations of any veteran currently receiving compensation for an impacted disability.
