if you insurection against CONSTITUTION not against USA?
The Office of the President is run by the CHIEF EXECUTIVE OFFICER of the United States.
Not only is he an "Officer" but the verbiage specifically mentions an "Executive" in the Article 3 description.
Somehow everyone seems to glaze over this word. And given that the judges dealing with the nomenclature are looking at specific terminology since obvious DJT IS ineligible, the title description of "Executive" is the second criteria dismissing DJT from being on any ballot.
18 U.S. Code §2383: "Whoever incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto, shall be fined under this title or imprisoned not more than ten years, or both; and shall be incapable of holding any office under the United States."
Even if by some wild stretch of the imagination Trump wasn't an Officer or swore an Oath to the US Constitution, he still has violated US law.
Trump is very clearly disqualified from Office by GOP rules 25 26 27, House Rep rule 23 Section 10, 18 USC §2383, 14th Amendment Section 3.
GOP, Democrat, & House Rep rules clearly state that members who are indicted or convicted for a felony are expelled/ineligible from the Party or House Rep of the US, & is obligated to resign.
Trump has violated his own Party's & the House Rep rules, American law, & the US Constitution.
_"The Presidential Records Act (PRA) changed the legal status of Presidential and Vice Presidential materials. _*_Under the PRA, the official records of the President and his staff are owned by the United States, not by the President._*
_The Archivist is required to take custody of these records when the President leaves office, and to maintain them in a Federal depository._
_These records are eligible for access under FOIA five years after the President leaves office._
_The President may restrict access to specific kinds of information for up to 12 years after he leaves office, but then records are reviewed for FOIA exemptions only._
_This legislation took effect on January 20, 1981, and the records of the Reagan administration were the first to be administered under this law."_ - National Archives official website
Plus if you did any civil due diligence you would know that Trump broke the Presidential Records Act & many election, tax, & business fraud laws. Trump's "aMErica First" global economic war caused many international sanctions against America, Trump's COVID recession, inflation, & unemployment, also raising US national debt by $8 TRILLION, RussiaGate, Afghanistan deal, more drone strikes than Obama, tax cuts for the rich, & many other Trump secret wars & international fraudulent activity hidden from America. Unfaithful twice impeached, six times corporate bankrupt bank bailed, cowardly draft-dodging, tax-dodging, unfaithful womanising civil convicted r×pist, civil convicted tax & business fraudster, demented physically mentally & psychologically unsound wannabe dictator Trump tanked his grandmother's business, the GOP, & most of America. Trump was literally laughed out of the United Nations & NATO. Trump caused many international sanctions against the US, & small undeveloped countries had more trading partners than Trump's America. Trump caused all the current international geopolitical & economic destabilisation (including global inflation...).

If laws don't exist to forbid dictators from running for the US Presidency, then congress needs to seriously consider implementing such laws.
I don't know how Section 3 couldn't apply to a person who previously took the oath as president. Especially considering the Equal Protection Clause is at the end of Section 1.

No indictment of GOP US Representatives and Senators needed. Just a finding that they opposed the peaceful transfer of power and thereby rebelled against the constitution and/or gave aid and comfort to enemies of the constitution. That would disqualify them and remove them.

One thing that our Founding Fathers always assumed was that their Constitution would forever be interpreted by judges and justices that were actually sane or, at the very least, in possession of an ability to reason and a love for democracy. Unfortunately, those assumptions have repeatedly been proven wrong, especially lately.
Nobody thought we would encounter a traitor such as trump.
Not interpreted. Obeyed. The Constitution is clear. Every illegal must be deported.
You are correct in that the USSC is using really old laws that were and are not relevant to the modern times that we are passing through and it's suspicious that the justices are using such bullshit reasoning. The three liars that the Senate confirmed are exactly what the GOP needed. A course correction is necessary with term limits and an enforceable code of ethics not based on scriptures from ancient times. The separation of church and state is not going to get us any closer if it's not enforced.

If they returned tomorrow, they would be shocked that a document they wrote in _the 18th century,_ had barely changed at all, and these "judges" are still twisting themselves into pretzels interpreting the language of the 1700s, when they expected it would be a _living_ document.

And we had a similar gerrymander here in Western Australia in our upper house until about five years ago. The conservatives had always held a majority in the upper house until the Liberal Party here imploded, partly because they had been infested with far right extremist evangelicals (similar to those in the US).
It's a constant battle. As soon as you let your guard down, they do it again. This is part of human nature and how we jockey for political power. Quite certain ancient Egypt had similar problems. It's important to keep fighting for democracy. I live in Chicago and people tell me, "Chicago is so corrupt! They keep arresting people for corruption!" And my reply is, "That's great! I'd be much more worried if the never arrested anyone for corruption!"

I don't believe he has a Felony conviction. He has been ruled responsible (E. Jean Carroll case), but that is a Civil case and not criminal which would allow for a Felony or Misdemeanor conviction.
If he is convicted in the Documents or Election Interference cases (of which the Georgia Election Interference case includes RICO) then that would lead to a Felony. Those would definitely disqualify him, and why he is trying to delay them so long so he can try to get back into the White House so he can pardon himself.

I would like to speak about good faith actors. If the Republican elected congressmen and Senators had acted in good faith we would not be here now. I have heard it mentioned that they privately don’t support Donald Trump and are afraid for their families and their personal safety. I hope that we don’t allow these bad faith actors to remain in power. They put their self and their families above the oath of office to protect the Constitution and the people they were elected to represent. Yes I am ready as a citizen to stand up for what is right.

Thank you. Now I get why the Minnesota and Michigan courts ruled, or rather didn’t rule, in the way they did. All this talk about ‘punting’ made my brain shut down. I don’t do team sports - except for democracy, which is both a team sport and a contact sport. A whole lot like rugby, to be honest.
And there's no punting in rugby!! I'm also at sea when they talk in those terms.
How is it fair to the other candidates with the courts not getting the issues around Trump's eligibility resolved in a timely fashion? Not that I think much of the other candidates personally, but it's just not right. The 14th amendment is clear, the facts are clear, it is time to cut the crap for the sake of we the people.

In February 2020, The United States Court of Appeals for the District of Columbia Circuit in K&D LLC v. Trump Old Post Office, LLC, 951 F. 3d 503, concluded, at President Trump's request, that the U.S. President is a federal officer, when they wrote: “President Trump removed the suit to federal court under the federal officer removal statute, 28 U.S.C. § 1442(a)(1).”
