    A narrow concept of merit helps the political class hide their privilege and get away with it by blaming it on the upper caste. When nepotism is systematically rooted out of the court system especially amongst the Supreme Court advocate and judges (most of them are from political families) will merit be respected and social change can be bought forth into Indian society.

      FYI, Justice Chandrachud is a prize winning Harvard law grad & doctorate and his dissertation on judicial science is recognised in the global law community. After working as a senior adv in SC, he was appointed as an addl Solicitor General of India and later on appointed as a judge in Bombay HC. He became Chief Justice of Allahabad HC in 2013 and soon appointed as SC judge. Also, his father was longest service CJI from 1978 till 1985.

      @@kch2810 he's a prime example of narrow concept of merit. His father was quite politically connected, ensured that his son got the introductions, the education and internships he required to fulfill criterias to get into Harvard. His father did arranged the money and approvals (Bureaucratic redtape like ECNR - Exit visa) that was actively denied to the middle classes.
      You can't celebrate his achievements without ignoring the enormous political connections that was available to him by his father and exploited to achieve his goals aided by opaque system called the collegium.

      @@kch2810 baseless? I doubt you lived in the pre-1991 era. Education and jobs were rationed out (and they still are rationed out to a lot less extent). ECNR was a thorn (and often denied without political connections) for anyone who wanted to go abroad for who had to go to a global conference, program, university until late 1998. Jobs especially those with the courts still require deep political connections, a sessions court advocate applicant still needs a bench of judges to assess "the character" of the applicant. And you think it's contrived?
      Oh yes, his first job in India was Senior advocate Supreme Court and Bombay High court. That's pure nepotism right there.
      Which rock are you sitting under? I'd like to sit under that just to ignore the miseries around me.

      @@kch2810 if its baseless then why we don't see any judge who is From middle class ? Like anyone whose parents are government servants ( clerks, accountants , doctors ,engineers etc ). There are many who are I India who deserve much better place but are denied opportunities. Also harvard University is something which is not affordable even by normal citizens of other countries too. 🙄 the fact you said his comment is baseless shows your level of ignorance , I think this is one of paid media who just want to rub their mindset into public. Ok I can understand its very common nowadays , but please don't think that our iq is this much low.

    Except Dr Ambedkar himself, none of you give any credit to Mr Benegal Narising Rau who did all the ground work, travelled and met the constitutional heads in Europe and America. He did not expect anything in return! How can people forget such founding fathers in drafting the constitution?

      We do remember him sire. B.R ambedkar himself praised him,who later went on to chair the ICJ. He is well remembered,but just like the Congress have removed BOSE,Shyamji krishna verma,INA trials at length, Savarkar,he was just another move on this great board of chess.

      He was not member of constituent Assembly, however he was hired to assist the Assembly. So technically he is not founding father of the constitution.

      @@vidyasagar580 he was the technical person. Hired to throw light on Constitution drafting. While ambedkar just drafted. All the ideas were brought and pasted from other countries. Ambedkar applied no mind. And even later constituent assembly applied their mind on Constitution.

      both merit and reservation goes hand in hand. read michael sandal book. tyranny of merit. merit is a concept which we often perceive as unbiased and clean but in real its not!
      nepotism is something which we all do and face but has been so internalised that we avoid to question it. and reservation is not a benefit but rather as a tool because those people who have been forced and subjected are also deserve to get what they deserve.

Nobody gets to become a senior advocate of the Supreme Court of India and Bombay High court (without local experience) without strong political connections with sitting benches.     This is the season of speeches, especially for sc judges. Had these judges heard the cases of CAA,KASHMIR or at least habeus corpus petitions from Kashmir these sermons would have been meaningful. Escape people from sermons of judges.

    & These ppl who had enjoyed benefits from 75yrs still say unequal & ask reservations for their great great grandchildren & INVITE TO these ceremonies & U pass out such illogical statement to current generation & pushing current youth back into old-age & create caste divide
    RESERVSTIONS r meant to b for bring equality , not crushing other community ! & Hence thy had time limits !

    A lot of general category people get frustrated when facing life and blame the failures encountered on 'quota' system.
    It is not fully correct. India has a lot of other more important systemic problems and reservation is a small problem amongst that. Lack of job opportunities, population, developing country status, lack of manufacturing/entrepreneurship etc are the real problems rather than reservation alone.

    Please don't gas light people who are working hard on merit by putting all of us under a privileged umbrella. We work hard and not all of us live in ivory towers . Please come out of your bias and break that privilege bubble for some time. I ain't against reservation yes many scheduled caste and tribals actually need it but reservation is no more about social mobility or upliftment but it's more about vote bank politics and creating and insuring a teflon image of a leader . Its is being used as a scapegoat or a glorious promising curtain to block real life issues like not enough schools in tribal areas , not enough teachers in underprivileged areas , not enough literacy for the marginalised or health care and nutrition .I rarely see the underbelly of the situation being addressed . Why isn't any dalit or tribal actually asking why even after soo many years of reservation are we actually still behind? Why only few Dalits or tribals prospering but not the majority?why the caste system still exist ? Why do obc even need reservation when they were never systemically marginalised?It only means this system is genuinely flawed or need additional help .Sir working hard and achieving merit requires hardwork . Hardwork is hardwork privilege may help but it never goes a long way . At the end it's a person's talent and not privilege. You cannot take the lake near the horse you have to bring the horse near the lake . No doubt privilege helps except few really unfortunate souls who have my best wishes almost everyone is some way or another is privileged. If someone has house and car but may be a terrible family, if someone is poor may be that person is academically amazing etc . Most people are blessed in one way or another also most people are unfortunate one way or another . Thats what average people are .

    Social security - majority of govt offices , colleges , & universities occupied by SC,ST OBC
    ECOMICALLY - EVERY ST,SC , OBC have fee reimbursement + loans for less interest + colleges without merit , + jobs & Ecomical stability without merit for almost 75 yrs
    UR super rich - fled away from this country because they anticipated this SILENT GENUCIDE will happen , which is unfolding on MIDDLE TO LOW ECOMICAL STATUS UR Student , whose parents stop eating 2times /day , just to pay fee of COLLEGES OR for book , bcz thy r sined to fall in UR & after getting ranks on merit - U say merit has no value !🙏👏👏 This speaks everything sir about our justice in this country !

      See, If we go back to your comment, the complaint is about not getting a worthy job, let alone “a job”. This in itself is a privilege, considering there are communities which are considered not worthy of even standing in front of the so called upper caste. Having said that, this is not to trigger you or anyone reading this comment, so that you jump in and start defending yourself. This is rather for everyone to think why reservation is a step in the right direction. Now you could question, why when I’m not the direct oppressor supposed to endure discrimination in the form of reservation? The truth is, you have indirectly benefited from the exploitation carried over by your ancestors for thousands of years. The last sentence might have hurt you. If so, I apologize as it is not my intention. Back to my point, people who call themselves upper caste think of reservation as a punishment. The TRUTH, IT IS NOT. If you are still not convinced, let me ask you a question. My father is wealthy and he pays more tax than the bottom 90% of the people in this country COMBINED. Hold that thought. Now why should he pay that much? Aren’t we using the same road, public transport, etc. if you find that argument insensible, then unconsciously you support reservation.

    Upper caste Hindus demographically make up less than 30% of Indian population. By this logic the comments here should be equally for and against reservation. Yet the comments here are overwhelmingly anti reservation. So if we only consider understanding of english and Internet access, the upper castes are privileged enough. Still you all think of yourselves as the most downtrodden in the country. Why? Because you think it's normal to have such privilege. Some of you say you left country due to reservation? Leaving country means you have had no small privileges.
    I am proud that our country's constitution doesn't just assures equality on paper but takes proactive steps in law to ensure this. Not even countries like USA and others have done any such things to root out racism. A country will progress when poverty is rooted out and social justice is provided. By these standards we look on the right track.

    Caste discrimination and previlige must be made illegal...it's not good practice for my lordships to make complaint as they have power to make laws itself suo moto..if such previlige and discrimination do exist the courts must take at up suo moto and make exemplary punishment.
    But the humor is those who hold power never want to bring changes.
    My lordships have power to change this country but my lordships do not exercise the power for reasons known best to them and watch people suffer.
    Lord Krishna once said there is a difference between duryodhana and yudhishthir.
    Duryodhana knows dharma/duty but doesn't act on it and wants to follow adharma.
    But yudhishthir knows dharma/duty as well as act on it..
    That is the difference.. mahabharat war was faught because someone tried to disrobe a women..and nowadays we sit in trial for years and acquit rapist for lack of evidence...
    Moto of supreme court " yato dharmasya tato jaya"
    One who does his dharma/duty always wins.
    Similarly Knowledge of law is one thing but bringing it into practice is something other.

      Earlier he blamed the police for poor investigation for least conviction in SC ST case,
      He is a judge, how he reached such a conclusion without any data for that matter.
      He may be a brahmin Or may not be one. But this does not give him the right to say anything without any basis.

      @@Lawyer_Hindutva am not here to convince you or give you stats which you should be Looking for on your own... talking about police spoiling the investigation, Arushi Talwar case is a prime example of how carelessness and stupidity on the part of police ruins the whole case.. initial stages of a crime is crucial time for collecting evidences and police are the ones delegated with that responsibility and if they fail to do their job honestly and dedicatedly then later delegating the case even to CBI would do no good.

      That's not how rule of law works. There are maximum frivilous cases which are filed under SC st act.

    Privileged and underprivileged sections exist in all settings. A Merit based system, makes sure, the difference among the classes is minimised, moving forward. Some sections may take longer to progress, but eventually they will close the gap. It will make sure of financial, intellectual and emotional elevation of the sections.

    Anyone who has a problem with him reading from a paper or with the fact that he comes from a privileged family, know that he is not sitting free.. He is not a politician who has to impress the crowd... It's a lecture where people from legal fraternity are sitting, and he has taken time out to address them.... When you speak without preparation, you might miss out on something/ not organize the content well... It's alright to write/ make someone write when you are so busy.... Anyone who has a problem that his father was a Judge, have you ever been to the SC and seen how he listens, throws brilliant questions, and has the guts to dissent ? People with not even half as much merit as him, commenting like fools !
    And then come the upper cast who are representing his words in the wrong sense and garnering support for it ! Now that's privilege !

Adhaar was obviously not a money bill, but he was the only one who could say that... I've seen those proceedings, so I can go on and on about how he brought up really important questions .. He kept himself unaffected by public opinion and gave a legally sound judgement in Arnab's case...
      Coming to this speech, misrepresenting his words because what he's saying is uncomfortable, doesn't take away from the fact that there's truth in it... So while I do feel bad when someone gets through with an extremely low score because of reservation and I don't make it with a much higher score (just faced that in Haryana Judicial Services), I feel even worse when I see people who've scored more than me but in terms of skills and legal aptitude they are far behind... I've seen so many coming from really good law colleges (I myself am from one) and schools where they made it through merit, or being in government job where they made it through merit (I've worked in a PSU with others with so called "merit"), but when it comes to working, they are so stupid... Can't even draft, they don't know under what provision a certain Complaint/application is to be made, can't interpret provisions... Can't even write mails... They are not freshers but with enough experience to be able to do these things, but they can't ! It's this lack of skill, maturity and professionalism that keeps them from clearing exams which actually have a level (like DJS), but they'ill comfortably blame it on reservation... Meanwhile others who don't behave like them, have true merit, use their resources and clear these exams..
      I think twice before comparing myself to an SC/ST because I've seen how they are still treated despite being educated and working in the same office as us... It's done so slyly, that you cannot do anything about it... It is more concerning to see people with privilege, better social status in every way, connections not having actual merit, and complaining... I mean you couldn't even understand such a simple comment above... There's nothing about his or anybody's "greatness" in my comment...

    The hypocrisy of it all...that this honorable Justice is a product of the very elite he so deplores. He himself is a Brahmin and son of a former CJI. WHILE that doesn't deprive him of his rights to talk of these things....the very thing he deplores is no longer the reality in modern India...particularly urban India. The incident he begins with were part of the late 19th century. No one talks of the very same structures which helped Ambedkar..to help come up in life...support from the so called forward community. Its people like the present speaker...who instill a constant negative message rather than take a more sympathetic view and help the society grow.     Exactly. I don't see the point of taking exam, let people of category take whatever seats they want, no matter how rich they are or for how many generations they are enjoying the privileges of belonging to a particular caste. If any year 1,2 seats are left, we who may not have enough to get good education but are General caste, will sit for the exam.
    This is the man who helped Modi to brutally ra.e our constitution by allowing reservation in medical education to cross 50%. My people who may not get to eat properly twice a day won't dare to dream any more, so that Amit Shah's and his sons and grandsons and their grandsons can study in foreign schools.

    I am not able to understand a country where Ramayana is written by Valmiki, Mahabharata written by Vyasa, and even today Both are kept at esteem, and puranas, Vedas, Upanishads all these no body said it is written by Upper caste or Brahmin, but respected more by Brahmin. How this theory of non touching came, and when from ? Hindus have no Brahmin God, but non brahmin is worshiped by Brahmin. Shiva, Krishna, and many more. Brahmin is not a caste it is way of living, which is a tough path.

      @@RippleReader124 a thief came to Mr. X house, he tried to unlock mr. X scooty by applying the key. Mr x and family say him in the cctv camera, they alarmed and the thief ran away. Later that evening the thief was seen again in front of the house. Mr X and family immediately stopped him and tried to enquire. A little quarrel started. Turn out that the thief was working in the house of Mr. Y who live in the same locality and the terms of Mr. X and Mr. Y were not good.
      Next morning a case under SC ST was filed against Mr. x (thief belong to the chamar caste as per the certificate produced by him) ... It was alleged that Mr. X and family abused the thief by castism remark.
      In reality they did not even knew who that thief was.
      Police filed chargesheet and trial court framed charges.
      There are n number of cases like this. This is happening in the society . In the name of SC ST Act, people are filing case if they indulge in any kind of dispute.
      And it is where Mr chandrachud's statement becomes deadly.

    Going by this logic, no one is meritorious! Should not a say a reserved category person who was economically poorer or had a more difficult childhood be considered more meritoroius than another probably richer reserved category person? But again what if the poorer guy actually got an NGO help, while the richer guy had a tumultous childhood? I mean this is life, everyone`s situations are different. While we have to work on reducing the social divide probably by stricter implementation of discrimination laws and more resources to the backward section, we have to also ensure to choose the best person for a job, irrespective of everything else. This selection process in itself maybe a different argument altogether.

Groups were added with the change in dynastic rule in medieval India. Customary law has roots which implementation of conventional law can uproot but with time. By identification of the castes and tribes listed not rechristened them as SC/ST. Achievements of the citizens are not judged first by their social status rather by their intellectual capabilities. We have had brilliant ministers like Late JagJivan Ram who held important posts .Even if was considered granted due to reservation and not merit but every ministry he handled did well. Do we lack the insight of noticing the capabilities as a person allowing our tutored mind to give reservation the advantage and not his capability. Is this a cover up by the deemed superiors in society.

    12.25 sacred land of gods. You're referring to India,. You're seeing with color blinds. You're not seeing the minority act differences.

    14.25 humilition by dominant society. Who is being humiliated in college entrance exam redilts and seat allocation even after securing above 90 percent. Who is being humiliated in getting government jobs.
    Who is being humiliated at time of promotions.
    I've been a government employee and ended wher i started. I got increments but not promotions.
    Because i dont have the certificate.

    This is the same guy that made verdict in Shabarimala issue. I assume he believes every one in India is privileged upper caste. He see everything from his perception of which he was brought up. I never in my life got any government benefit but paid my taxes. I believe I also have to right to get the same benifit they give to others. 😅 Literally my country and its government had done nothing for me other than take my money in the name of taxes. The so called privilege of upper class. By the way I am still homeless
