    Why say he is the CJI’s son in the headline? Just goes to show what credibility entitlement brings - especially for media outlets such as The Print. Or is it to suggest that this gives insights to the CJI’s thinking on this? Or, that we are listening to the third generation CJI - thanks to the collegium??

      Afganisthan will be getting the citizenship in 5 years. It is the fact that Afganisthan is not a part of India, and is a different country, whereas , Pakistan is not another country. Pakistan is a part of India .

    Genuine question- if one has to practice law in India, how is it advantageous to study law abroad, say, in US.
    Law presumably is different in different countries

      Just strictly answering your question:
      1. all countries borrow precedence from others countries when they are dealing with a novel case in their own.
      2. Democracies, despite having different constitutions have similar overall approach. It helps to understand how others approach/solve legal issues.
      3. Elite institutions facilitate best legal minds to come together and build networks and relationships
      4. International law and trade laws need intergovernmental understanding
      5. Of course this helps the host countries of elite institutions to gain influence in the legal fraternity

      @@veereshpmIt’s not that straight forward. Culture and formation of countries has a heavy bearing on constitution. Ours is the most complicated, it’s like writing a constitution for a continent not a country.

      @@srikantpadma3573 India's own constitution is heavily influenced/copied from the British constitution, with few major localized changes like Reservations, Personal Laws, etc. But by and large, if you understand the British constitution - you can safely say you understand approx. 70% Indian constitution as well.

    CAA is a law for people *already* residing in India as refugees. Abhinav should get out of his air-conditioned car and meet the refugees living under flyovers of Delhi since decades, a vast vast majority being Hindus and Sikhs. Legislators legislate to create maximum impact with the smallest set of rules and definitions. It's stupid to say that CAA should cover persecution based on gender identity - people weren't that woke in 1948.

    It is a SHAME that a son of CJI and an advocate who aspires to become CJI does not know the laws existing in the country. Jr Chandrachud has not studied CAA either. Jr Chandrachud is unaware that CAA is specifically for an identified group and specific purpose. For all other citizens of the planet, the existing law is adequate, and no need to repeat their religions, groups, ethnicities, etc in CAA and to abolish the existing law. The democratically elected MPs are entitled to frame laws in Lok Sabha and Rajya Sabha. They are entitled to amend the constitution again and again, further to several amendments already made since 1947.
    Jr Chandrachde is of course aware that atheists and Jews do face persecution in these countries because Islam looks at them as KAFFIRS.. He does not want to criticize the Islamic Kafir concept. Therefore, he speaks his mind about a new law for his Jewish friend. But there is no need for such a new law. It already exists in India. The religious groups that Jr Chandrachud listed have already been enjoying the benefits of the already existing law. Atheists, Ahmedias, Jews, Shias, Hindus from Sri Lanka, Nepal, Myanmar, and all religious groups including Pakistani Muslims have received the benefit of the already existing law. Example. Pakistani Singer ADNAN SAMI KHAN. Pakistani spies can also apply for citizenship under the existing law. The existing law has not been abolished. Please refer your Jewish friend to a good advocate who will submit his application under the existing law
    Original Europeans, USA & UK citizens have now realized that their language, food, dress, and culture have started disappearing. Migrants have taken over their precious assets. The UK and some European nations have implemented laws to protect their original culture, language, food, and dress. Intellectuals in these countries who had been arguing constitutional rights have vanished from the scene. India should learn from Europe, the USA, UK. India should protect original Indian culture, Indian food, Indian dress, and Indian languages and choose what is good for Indians. Accept what is good from any corner of the world but gradually discourage all foreign unwanted things. Europe, the USA, UK should not happen in India.

      1) it violates "assam accord", In assam andolan 800+ people of Assam died protesting against these bangladeshis,implementing CAA will be disrespectful towards those people and for us!

      3) it's totally different case for Assam compared to other states, because Assam is a bordering state, and throughout the history Assam is more affected and will be affected by it, not the other states.

      8) we will never give our land to a Bangladeshi!!
      WHAT PEOPLE OF ASSAM WANT?
      1) NRC without CAA and inner line permit (ILP)
      2) NRC+CAA in assam will remove only bangladeshi muslim people from assam, but ONLY NRC gonna remove all illegal Bangladeshi hindus, muslims etc...I mean irrespective of religion from assam, we want to remove all bangladeshi.
      2) The government can implement CAA in other states but should exclude ASSAM and tripura from it, As we already are affected so much, and will get affected more
      3) ILP will prevent other illegal immigrants from entering Assam
      4) The government can implement CAA anywhere but exclude northeast states who are already affected!! We need only NRC+ILP
      5) and again lastly saying, you can implement CAA all over India if u want, but not in assam/northeast states...

They are welcomed in India but through the normal route not CAA
      And the Sri Lankan tamil fucking killed a Prime Minister. They are anti centre. They are tamil nationalists of extreme proportions. Citizenship is a prerogative of centre government and that has been mandated by the constitution.
      And this land is not a place to bring all people from everywhere. BJP was very clear about its policy. It was in the manifesto as well. And when it has gotten the mandate by the people then it should be allowed to carry on its policies. You can criticize. You can change the government. But you cannot just stop a rightfully elected government from fulfilling its promises.

      Article 14 is not only sates equality before law. The complete statement is equality before law and equal protection of law under equal circumstances. Do refer charan sigh choudhary case were supreme Court have interpreted article 14 very well. And another point whatever rights we have got is not absolute under Constitution they comes with reasonable restrictions. Article 15 clause (4) deal with sc, st and backwards classes special privilege. Therefore nothing is unconstitutional

    The judicial system today is pathetic because of overanalyzing like he is doing and not allowing any reforms. Once the law is created any exceptions will be course corrected. You can't delay the law citing such reasons and allow the persecution to happen. There are other means to attain Indian citizenship for them. CAA was promised by Congress as well.

      Not practical but ideological only. Why Jews etc religion people brought into discussion while they are not in the list of 31313 people who reportedly applied for citizenship. It's under Nehru Liaquat agreement in which only non muslims of Pak non Hindus of India I.e Muslims have such rights.

    Article 29 and article 30 has been rebranded to accommodate minority communities from foreign country, this is what CAA is all about....it is as simple as that....if CAA is unconstitutional, then how is article 29 and 30 constitutional....the word minority itself means in comparison to something bigger, so there will be a majority religion to compare it with....

    One of the most idiotic speeches- His services should be made available to Syria, Iran, Turky, Palastine etc where there are more problems for non muslims of the muslim country and solve those problems. India was partitioned on religious basis, Pakistan declared it as Muslim nation, but India didnot because Nehru was a Muslim (with fake Hindu identity). Later his party, stealthily included SECULAR in the constitution- not with amendment by due process.

    Actually i feel there is need for constitution to be reviewed periodically & updated to be really robust.
    Just like how software require frequent updates to fix bugs & errors. Constitution also needs updates & fixes.

    CAA does not barred any other community, it is not specifically mentioned they barred these communities. It is just a simple thing that communities( not mentioned in CAA) have to follow the traditional way to apply for citizenship and others get through fast-track( under this amendment) because the minorities from those 3 countries have data, reports not only from those 3 countries but also from UN about their suppression, murder, and offenses against them in the name of their religion ( it is not a myth but a reality). CAA doesn't bar others. why are we making logical and practical law a controversial topic.

      So Talibanis, jihadis from Pak, HAMAS etc should be allowed under CAA to make it secular? This particular CAA applies to persecuted minorities of Pak, Afghanistan and Bangladesh to rectify the effects of hurriedly created Pak on religion basis but left many Hindus among religious zeilots who started persecuting Hindus etc making them run from the three Muslim countries. So only non Muslims from there have such right that was arrived at under Nehru Liaquat agreement not for others, other religion people. This Chandrachud vomited Lutyens narcissistic view point to show Modi, his party and even RSS as culprit. Why he mentioned RSS. Did RSS exists then in present structure.     It is near impossible to frame water-tight laws. He is arguing only on the basis of the leakages in CAA, the obscure cases. Will he take responsibility of practical implications of his suggestions?
    Btw I am agnostic, but in official forms I claim to be a Hindu.
    Would you call Bhagat Singh a Sikh or atheist? Would you call Savarkar a Hindu or atheist?

    Listing out other persecuted groups based on their identity or a lack therefor that are not covered under CAA in itself does not discredit the need for granting citizenship to religiously persecuted groups of the Indic-fold specifically.

    I sincerely wish this Jr Chandrachud agrees for a debate with Mr. Sai Deepak on this issue. I am sure, he will be completely exposed about the hollowness in his arguments about Ahmadiyas, Bahais and Jews. He has no empathy for fellow Hindu and Sikhs being prosecuted in these Islamic Nations.
    I suggest, all the high profile Politicians and legal luminaries opposing CAA must be sent to these Islamic nations and stay there for an year to experience first hand how it feels to live as Hindus / Sikhs in these barbaric countries.
