As such, people of other regions of India move into a state, thus gaining a stake in the say in the state's politics and policies. This also conflicts with the predominant culture in those states, as immigrants bring in their own culture.
And we Indians are tought in 7th or 8th grade, about the right to migration within the country...
Some north eastern states do have 6th Schedule, but several others don't. Even States like Ladakh, J&K, Uttarakhand, Himanchal don't have any such safeguard. And thus Sibal's right in saying that there's no legal grounds for a state (most states) or its community to plead to court about preventing influx of migrants from any part of India (though he's pretty wrong when saying that Bangladeshis have a right to migrate within India+Bangladesh, its pretty funny😂)

I am an Indian. I became American citizen . I surrender my Indian passport . Now I want to come back to India. Now I will have to apply for Indian citizenship. Then it is up to Indian government to decide whether to give me citizenship or not. Same thing apply to all other foreigners.

@@Sakshameditz27 Bangladesh became East Pakistan on 14 August, 1947 and the Partition of Bengal was possibly worse than that of Punjab. Trainloads of Hindus were being massacred and many were too scared to cross the border as news of violence in West Bengal was equally bad. Also, as in Sindh some were too poor to even attempt to walk across the land and cross the border. But Sibal is deliberately muddling the facts by saying that Bangladesh became an independent country in 1971 and therefore was part of united India before that. During this period we did get a large influx of migrants from East Pakistan who were escaping the Pakistan army and they got assimilated among the "minority" community in India.

In a fair justice system, everyone is entitled to be heard, which means both the right and the wrong and a judgment must be passed declaring one side or the other triumphant and founded on reasoning. What would be the point of a system wherein only those whom you think are right get to speak and not the ones who are wrong? Then there would not remain any distinction before the eyes of the public, "usko bolne mat do" is not justice.

I was shacked with the kapil sibbal arguments, when he said they means Bangladeshi were Indians. Even the CJI Raised the same question. Before 1971, it was east Pakistan, and not India.,which was partioned in 1947. Immigrants before 1971 are migrated from east Pakistan, then how can they be Indians. On 16th Dec 1971 Bangladesh was formed.

@@humbleh5085 they were forced to be East Pakistani...when India and Pakistan seperated their was great influx of Bengali speaking Hindus as well as Muslims from east pakistan...but government was forced to issue permit for Muslims coming to India ..only 2000 permits were released per month ..while before those permits 25000+ Muslims were moving to India...while Hindus had no restrictions...they all were Bengali first ... and they didn't know Urdu ...one reason why east and Pakistan seperated was because of imposition of Urdu over east pakistan giving people of west pakistan unnecessary advantage...thats another reason why South India opposes imposition of Hindi over them.

argument from Kapil Sibal when he says " they were Indians in 1971".
The historical fact is that West Pakistan and East Pakistan were created on the basis of muslim majority living in particular religions within those States. Hence boundaries were drawn accordingly with options for Maharajas ruling many States to become part of Pakistan or India.
The people of "East Pakistan" were governed by West Pakistan and both had muslim majorities.
Therefore how can the muslims of East Pakistan, now Bangladesh, be Indians or " the country be India" in 1971?
After after partition, the minority,i.e. hindus and majority i.e. muslims came over to India, probably West Bengal, how come East Pakistan even existed?
If some muslims from East Pakistan came over that's a different proposition.
What is this nonsense about people having fundamental right to move from country to another country?
Why does each country have immigration laws and policies then?

I am neither a law student nor understand the practice of law but the way the Argument is being held and the decent exchange of words between MR Sibal and Hon. CJI gives me thought to my own attitude.Like how we can present our thought point and Argument in our daily life when we are in Public forum.Lots of learning on History ,language, law and constitution from this argument.Kudos to the Law Chakra team for bringing this out.
