The legislation aims to bring obligations around hate speech in line with the Constitution and international human rights.

That law is SO unconstitutional, it is actually hilarious! But then again, the Constitution itself is a massive joke. You see, free speech is enshrined in the Constitution and no ordinary law can undo that. Unless, of course, the law is meant to eradicate "inequality", because THAT is indeed allowed by the Constitution. In fact, Article 9(2) of the Bill Of Rights allows the government to create ANY law (such as BBBEE, expropriation of land without compensation, and so many others) to eradicate "inequality". Effectively, they can create a law to relieve you of your false teeth if they believe that will eradicate inequality. So perhaps this law is all about inequality too. Who knows. Perhaps only our esteemed Constitutional Court judges who apparently know what inequality is. Fucking hilarious!

I can't agree with this. The aim should be to make all people equal before the law. In the 90's (I'm British) the old Soviet bloc twisted fundamental human rights away from protection of the individual from the state, and towards protection of the individual from other individuals. The reason the rights were implemented in the first place was to stop movements such as the Nazi party from treating individuals (Jews in this case) from being discriminated against by law. What we now have in my country is people running scared for fear of being perceived as showing hatred towards certain groups which culminated in a BBC documentary two years ago which interviewed paedophiles so the public could understand that they may be a marginalised group. That's how bad it gets and it's coming to you.
The problem with constant implementation of more rights for protected groups and minorities is the arguments become worse and worse and in the case of SA my fear would be that taking the fight to them in this way could end up in civil war or something crazy like a Cape UDI. The best way to do it would be better education, removal of the Cadres, BEE and for god's sake the ANC all of which can be done at the voting box.
