    My friend recently pulled an unloaded gun and he was waving or pointing at someone. Now the victim said he wants to drop the report. Now, he had an altercation before pulling the firearm. First, he pulls a hatchet and the victim went inside his apartment. My friend went to his apartment to retrieve the firearm. He knocked on his door and this is when the firearm was pulled on the victim. Since the victim wants to drop the report. How likely will the State of Florida prosecute? Worse and best outcome.

      Steven Fickey it certainly helps that the alleged victim does not want to prosecute but it is the states case. You should have your friend contact an attorney in his area to discuss thoroughly. If he already has an attorney and the victim wants to help they can contact the defendants attorney.

    What about if it’s a first offense and the victim doesn’t want to testify what would the case be ?

      depends on evidence of case. Don't always need the victim. However it certainly helps if victim does not pursue the case.

      Yes. Aggravated assault with a firearm no longer has a 3 year minimum mandatory sentence. video is two years old. Everything else applies.
