Judge Luttig blasts SCOTUS for avoiding ‘key question’ at the heart of Trump immunity case

  • Former federal Judge J. Michael Luttig joins Ali Velshi to discuss his takeaways from this week’s Supreme Court oral arguments on former President Donald Trump's presidential immunity claim, which many believe will lead to more delays in Trump’s federal criminal cases, and potentially impact the future of the presidency itself. "That this absurd argument is even being made before the Supreme Court is an embarrassment to the Constitution and to our country,” Judge Luttig says. Judge Luttig also criticizes the Supreme Court for avoiding the “straightforward, key question” about the case itself, and explains what decision he believes the justices are most likely to make.

      I am sure the dictators of the liberal party are upset that the justice system is not bowing to their demands. There is no evidence that they are going to say that ANY president has blanket immunity, but that there has to be a system that does not exist where he has SOME immunity. Otherwise, Biden will be in jail a couple days after he leaves office and Obama will be arrested in a manner of days for crimes he committed as president. There is almost no way that a president can totally avoid doing something that is against the law somewhere.

They have the highest positions of ours country's THREE CHECKS AND BALANCES and they are letting the 250 year old system break down because they cannot separate some weird love of ...some ONE person in America that gave them a job.       Justice Alito, the point is that other presidents have not committed blatant crimes. No other President has had to fear being prosecuted, except Nixon. If anyone commits crimes, under the rule of law, they can be prosecuted. Alito’s assumption that the legal system cannot hold up against attempts to politicize the law. It means precisely that the SCOTUS must demonstrate faith in the rule of law. But they have themselves been so corrupted that they assume that ALL judges and prosecutors are corrupt. No, Justice Alito, YOU are corrupt, not these other judges who still uphold the constitution and do not put themselves above the law.

He's credibly one of the most nonpartisan judges/scholars (in my view) helping us common American patriots understand that our distress is warranted. The President has broad powers, along with individual constitutional rights, such as 1st and 14th amendments.       yes, exactly. I wonder what SCOTUS endgame is: they send it back to the District Court, which will most likely rule that none of this non-sense was an official act. Trump will appeal this, they will deny it again, then its up to SCOTUS (yet again). Judge Luttig is absolutely right: SCOTUS could have make this decision long long ago, if they, at the end take it up again anyway. I really do wonder how they can get away with this non-sense without any justification.
      Alitos question directly aimed to undermine the justice system itself. Not only by potentially discredeting the DOJ but also the GrandJury ("u can get a Ham Sandwitch indicted"), as well as the Jury and presiding Judges.
      By that logic I wonder why we need a SCOTUS at all? If a President deems SCOUTS corrupt, he/she can simply "remove" them, or the Court as a whole. By not defining in this specific case what is "official and whats private", Biden could get rid of SCOTUS...
      It's mindblowing to me (even for Republican appointed judges) how ignorant someone can be...

    As a lawyer and citizen, thank you Judge Luttig for non-politically summarily identifying the key question, restricted focus, and proper purpose and process that SCOTUS should have followed. You restore our confidence in the necessary judicial system and how most judges are and should be respected as competent dedicated professionals. I join the many wishing you had instead been appointed as a deserving SCOTUS Justice. It is quick and obvious nonsense that a President could be immune from prosecution for sedition or treason or any "crime" (defined as an offense against the public) while in office which is directly opposed to their democracy role and Constitutional bestowed powers.

The current problem SCOTUS justices value their personal politics over reasoned precedents. I value the Republican and Democrat compromises of prior years before all seemingly went wrong with the late 1990's creation of Fux News and the Starr Report wayward actions replaced respected journalism facts with political falsehoods. The extremists are the problems. I continue to rely on the educated majority who know and follow the simple difference between what is right and wrong, which should result in Biden's re-election as the Republicans failed to advance a worthy candidate.

The way the so-called conservatives on the Court avoided the facts in this case suggested to me that there was no case or controversy in the interlocutory appeal. This should be decided on the evidence after trial. This Court is showing little to no interest in the actually facts just as they did on Anderson.

Honestly in the cases of Alito & Thomas alone, the fact that they chose to entertain Trump’s insane tripe in the first place let alone signal to support it should have the Bar Association itself move to revoke their legal accreditation since the fundamental act they are co-signing is the antithesis of the primary principles of legal duty like a doctor advocating to commit genocide or an ecologist advocating the wholesale poisoning of an entire ecosystem
