      IMO he is too lenient. He is also too lenient on renters and screws over the landlord. He looks for any loophole to release people.

      @@markharmon7598 No, I've seen sov cits come in with a sweetheart plea deal from the DA and them bicker and argue about it and the judge negating the deal.
      I also saw one where the victim, and all his witnesses were in court ready to go and the defendant didn't bother showing up. He called in and was giving BS excuses. So the judge says "don't go anywhere, I've issued an arrest warrant and the bailiff will be coming to get you shortly". He then asked the DA and victim if they could hang around until the defendant was brought in.

    “And you shoved a can of green beans and a can opener down your pants, which means you were hungry.” Judge Middleton understands the human condition and is not judgmental of others in their need. It’s loving the person, but not accepting their crimes. Do y’all notice how thin his arms are ?

    Man, for sure if I saw someone stealing beans and a can opener I'd just let him go without saying anything. I'm happy Middleton was so kind on this case. I hope this guy's life turns around.

      "That very same day I turned myself in" told me a lot. I suspect in jail he'd get 3 meals and a dry, warm enough cot. I think Middleton can tell the difference between desperation and criminal intent. I was touched the judge asked what he was going to do, "if you need a bus pass, you come here", etc.

      What would happen if he said to the judge, I can't accept any kind of a plea deal because I have nothing to eat and if I stay in jail at least I get three meals a day and shelter. I'll bet they drop all of the charges just to get him out of there and assess the court fees. There's a rock and a hard spot here, it cost the judicial system in that area hundreds if not a few thousand dollars for shoplifters that steal minor amounts. Walmart wants to prosecute them but the court cost far exceeded anything that they took. Before an Einstein tells me what do you want to do just let them go, no, I think they should immediately sentence them to public service and not put them in jail because that's where the real cost is. Remember it's your tax money paying for this in your judicial area. The area where I live the average cost is $25,000 per year up to $50,000 per year to keep some one in jail awaiting trial and they are responsible for their health needs, think about that.

      I don't think it's "just because he's too poor". I think he did it as well. They are petty crimes and he doesn't deserve more punishment but I think it's disingenuous to pretend like he didn't do what he was accused of. He's not protesting his innocence and provides additional confirming details. This is not just picking some random poor person for no reason.

    this kid has no idea what a miracle and how rare this is. i sat in jail over 100 bucks for 60 days and NO judge, any authority said, hummm, let's check in on this individual. let's get her out, she's poor and has no one to help her. this does not happen. if he gets arrested anywhere else, he's not gonna understand and think this is normal. i almost cried - i would have been like so thankful, crying, and the fact that any part of the judicial system actually cared and saw that a person is literally is sitting in jail is unfathomable. it just is.

    This fellow ought to get some kind of bravery award for even thinking about eating a tin of green beans. Tinned green beans are the single foulest vegetable on earth. Like eating millipedes.
    I don't know whether to read that as desperation or derangement.

    I'm glad to see Judges like Judge Middleton. I hope the guy appreciated what the Judge did for him. I think it said "thank you" at the end, but it got cut-off. I just hope he appreciates it and stays out of trouble. Judge Middleton is one of the very bet!

    Costs more than $200 to feed and house dude that's why they want him out. Guy sure looks like he has a big case of "i am homeless and starving let's see what is the smallest crime i can get arrested for so i can be inside/warm and fed". or is it just me....he literally stole a can of green beans ...

    Judge Middleton, along with Judge Boyd of Texas and Judge Caprio of Providence are great examples very humane people who realise that Justice is there to serve the people, that helping people back to the path of righteousness is the right way for justice to be executed.

    There are very few people who have committed a crime that I have empathy for but this guy I do. I mean he was in a Wal-Mart and could have taken anything that had some worth to it to be pawned....but....he stole and can green beans and a can opener which means he had to be really hungry...the other place was some beer. Not really a harden criminal. Now I am not saying it was right that he stole stuff, no, he was wrong in doing that but green beans and beer when the opportunity was right there to steal something worth so much more that he could get money for. It just shows he wasn't out to get money he was just hungry and thirsty and was just surviving. I am glad Judge Middleton showed this man some mercy.

      I have seen cases where the victim is the one not willing to testifying to put the abuser in jail so the judge’s hands are tied. I think accepting pleas for a lesser charge than a DUI is a disservice to the safety of the community. Most defendants already have at least one DUI on their record. These are the ones that will continue to drink and drive until someone is killed. A tougher view on the impaired driving charges needs to be taken. Even one death due to drinking and driving is too many!

      ​@kayfurlano1462 sadly, those plea deals are at the discretion of the prosecutors. The judge can only sentence based on the charges, and if prosecution lowers them, his hands are tied

    courts need to implement work programs, where destitute or homeless sentenced defendants can work off their restitution, & court costs. otherwise this will remain an endless cycle of failures to appear, rearrests, and on & on. putting people in programs to work off their debts is perfectly reasonable, & would work toward remedying a few issues at once. make them scrub graffiti, or pick up trash, or any number of things which could better the area they live in. it would be free labor for the city, and it would cancel the debt for the defendants.

      They used to do that all the time, but then someone started whining that it was demeaning so now it's not even allowed to exist as an option.

      As much as I love Judge Middleton I can’t help but wonder how many of these defendants keep doing the same thing or worse because they know there’s no consequences. With these cases why even go through all of this? I do understand the homeless…more than I want to…it’s almost as if they know not much will happen. Just go ahead and dismiss the charges and move on to the more serious cases. I love that he’s understanding…guess I don’t get why go through these actions. There should be some types of programs for the homeless as someone else said. And I also wonder how many just stop trying to do any better or work at something because they pretty much know the results. Does it enable some to do nothing? I get the taking food more than I do the beer…maybe he wanted to numb his pain away. And I’m sure Mr. George dismissed most because judge asked him to & in some cases that’s fine. Guess my main question is there some enabling going on because they become use to it…just asking

      I 100% agree with the idea of like a CCC/WPA program for criminals. There are some things along those lines, and it's extremely vulnerable to abuse, but if it's done humanely I think it's the best for everyone.

    It's a sad indictment on society when a defendant is motivated to steal one can of green bens & a can opener; certainly, the man is no saint, but by Middleton's sensible handling of this case, he demonstrates compassion & empathy appropriately; I wish the defendant better fortune in his future - he was as thin as a rake.

    one of my favorite completely astute middleton observations is re WalMart and how they basically use law enforcement, OUR tax money, to enforce their stupid self checkout theft. instead of catching and trespassing individuals, now they do NOT hire any security, call police every time, and lock people up which we pay for. all because they are the suckiest cheapest loserish money sucking retail company i have ever known. oh no, we will put in all these self checkouts, pay way less for employees, and use local law enforcement when individuals may or may not skip scan. it's a joke.

    These folks and get food at any church for free. There are also food pantries in every city. Meals are also served at churches everyday in most large towns.

    I don’t know much about this guys case but damn seems he is stealing to eat and to survive. There has to be a better way to get people like this help. There’s so much more we could be doing to help instead of just revolving door of jail. I guess if there was easy solution this wouldn’t be an issue it’s just sad. Damn I wrote this before I heard he stole beers. Sort of ruined my whole feeling sorry for him. Still feel sorry but not nearly as bad.

      I wish they could be sentenced yet to work it off. They paid back their fines and damages, and constructive things were accomplished. But now that is cruel and unusual punishment, and tons of money, time, and effort is wasted. And the guilty has not been given a reason to change their ways.

      @@ronfullerton3162 I have said that for a long time. Giving people like him fines upon fines will just keep him always on probation and in trouble with the courts. They can never get out from under trouble because all of the fines. Same with traffic fines that spiral out of control. Driver can’t pay off fines so license suspended yet need to get to work so keep getting pulled over and fines just get worse. Instead of all these fines. Have them pay off fines by working for the county or city. There’s plenty of work that needs to be done. It would be win win. They work of their fines and able to get back on track. Local neighborhoods get things cleaned up and fixed I mean it just makes perfect sense so it will never happen. The justice system is not set up to get people back on their feet from mistakes but to keep them in a revolving door with the courts and justice system. It’s frustrating this can be fixed so easily. Unfortunately can’t happen because they don’t want a fix they want to say look how bad crime is we need more money to arrest these people.

      If you mean the Judge's hair, it is actually a really sweet story. He's had short hair his whole life, until the Pandemic hit and he couldn't get to a barber because of closings. He let it grow, and low and behold, his wife REALLY LIKED it... like A LOT. She insisted he keep it, and so he does this FOR HER. He puts it in a pony tail to keep it more professional looking. But keep in mind, up until the early 20th Century, long hair wore in Ponytails was Stately Gentleman fashion, and most judges wore long hair with ponytails, OR WIGS...
      Some might say fashion is returning to the good old days.
      next thing you know, people will be dressing their baby boys in dresses again, like they used to do in the 1920's and before...

    I don't want to sound like a bleeding heart, but these are crimes of desperation and ignorance. It sounds like a person at the end of his rope. For sure arrest and prosecute this, but holy crap this guy needs to be linked up with some kind of case manager or social service person or maybe a probation officer who can help him figure out how to feed himself and handle himself.
    Maybe it's just because I grew up in the country and I know a lot of guys like this.

      Contrary to what some people would have you believe, empathy is a powerful and strong tool when utilized properly by those who are strong enought to wield it. People who show compassion and empathy are not weaker than others, they are stronger than most to still feel that drive and proliferate compassion in the face of the facts of the real world. I salute you. You are more human than most humans.
      And this has nothing to do with any political affiliation, it's just real world facts.
      Nature is not kind, it is not compassionate, it is not empathetic, it is cold harsh and unforgivable... being able to transcend that nature while still existing within that natural system is nothing less than magical.

    Yup a thank you judge wouldn't have gone amiss but I'm not sure he understood just how lenient judge Middleton was. Still, he clearly isnt a career criminal and prisons are expensive places to be kept in. Nice move judge..

    Judge Boyd, Judge Shackleton, and especially Judge Middleton are the best criminal docket Judges I’ve seen. I used to consider Judge DiSanto among them but she’s too irritating and all she wants to do is punish everyone whether they’d benefit from some compassion or not. It’s not that she’s ever wrong, she just always comes across as a hard assed b*tch, whereas the others know when a soft hand will provide a better outcome than a firm one.

    This is the case of someone needing 3 hots and a cot. He is most likely homeless and using illegal drugs. Sad he is doing petty crimes to get food and shelter. The jail is not an option due to be homeless. He needs to address, if any, issues of mental illness, homelessness and addictions.

      i just think sturgis or whatever county it is, is a different world; one which i would care to be part of. when someone is deserving, middleton doesn't hold back. to see a person of authority ask why, understand, and give breaks is just shocking and absolutely wonderful. i feel like most people show up to court there that are local because they know they are gonna get a fair shake and aren't afraid they are just a number.

    Wow, there are only 96 people in their jail. No sleeping on the floor with your feet next to the toilet. I bet they even have mattresses🤯

      I don't know. We don't know how big the jail is... Some of these smaller townships only have 20 cells. That would be 5 people per cell, with 2 bunks per cell... and we might be over-estimating how many cells they have available in this township.

    I get the feeling he's stealing because of poverty and a payment plan is just going to make it worse. Courts should be directing people like this to organisations that can help, otherwise he'll be back in a few months.

      incarceration is primarily about profit everywhere - but if this kid is smart, i feel like he could back in a month with this judge and get the fees waived. the weird thing is, before and while you're in, your financial status is sortof taken into consideration. but once out the fees and payments are the same for everyone. and of course you want out, but when you can't pay, you'll just be back in. really for anyone, if you can stick it out, doing your time is always gonna be in the long run easier, no probation rules, no money, but hella sucky while in.

    The guy has a few problems he needs too face. He steals and he has no problem disregarding no trespass orders. The Judge lets these guys out without any lessons learned way too often. Maybe sitting in jail a couple weeks is Exactly the wake up call this guy needs. I really like Middleton but he is just way too easy on most of his repeat offenders.

      In a country with more incarcerations per capita, than any other first world nation? The USA uses prisons to house all sorts of types - it's cheaper than building social housing & psychiatric hospitals so human misery expands - that sir is ALWAYS dangerous... More mercy & correctly directed mercy is what's required. The judge recognises he's dealing with people & does the best he can in a broken system.

      Why don't we just strip the Due Process clause out of the 5th Amendment and jail everyone who is accused of any crime? You seem to think that jailing people is the answer. The fact that we imprison a greater percentage of our population than ANY other industrialized nation should be sufficient evidence that it doesn't work.
