    On the first story, this happened to a Bank of America branch in Florida, a few years ago. It made the news! They tried to illegally foreclose on house that wasn't even mortgaged! The owners sued BoA, and won. Months later, the Sheriff had to come to that branch and start seizing equipment. The manager made a call, and issued the Plaintiffs a check. Mighty embarrassing...

      It's not really "free money." You can only sue for actual damages that can be proven. In this case, the money for the actual work he did.

      You love easy, open and shut suing. You wouldn't love the kind of suing that usually goes on. A family member of mine was an inventor and spent half their life being sued fraudulently to have their work stolen. Came close to losing everything

    half of my college professors have told me: set a maximum number of changes your client can make to your work. You will always meet someone who is never satisfied and will waste your time.

      I have no idea how the coding scene works.
      But 500 pages for only 2k seems kinda cheap IMO. XD
      I dont know the value of some projects, I know some can take a long time, but he spent almost a month on this project for them?
      Seems like it could be a 4-5k project, or more?

      I have to question the legitimacy of the first story. First there are a number of third party applications that do exactly what the OP was asked to do for this company. Two, the company would need a working product sooner rather than later. Three, the change request would require a new billing as the original product was made to initial spec. Four, 500 pages of code for $2k .... yeah.
      Now if I'm wrong and this story is true then I suspect this story originated in a developing country. But it could be possible it originated in India. 2k USD is a lot of money in India. Even now. But it is unlikely that the customer and program designer would pay in USD. It would be in Indian Rupees.

    For the first story, whenever a client wants a new feature added say, "Sure, let me write up a proposal, and we can work up a separate contract to add that." (Unless it's an ongoing contract where they pay for your work regularly.)
    And yes, the sheriff can do that!

      Not really, the only paperwork for an existing judgement is a list of seized items. The best part is that if we'd have to come back and seize more to fulfill the judgement amount. Computers don't get much at auction, so it'd cost MARK-1 far more in equipment than the $2k. Additionally, we don't wipe the computers properly and any company info on them would be the buyer would own all that data. This could be a HUGE regulatory risk.

      @@undecidedmiddleground5633 Well there's that, and then there is the risk they publicly get embarrassed by having law enforcement start taking stuff out of the office. Both for the workers AND potentially the clients.
      Like imagine seeing the company you hired having office chairs and computers taken out by the sheriff. You'd probably look for a new company to work with.

    The aunt and uncle constantly being late and lacking self awareness is just hilarious, if they wanna be constantly late and be a hindrance to everyone then that’s their choice, maybe they’ll actually learn to be punctual one day… but I doubt it. Guarantee their kids will resent them for this growing up!

      From my experience they probably won't, we've been doing the same thing to my uncle since i was a small child (under 10), currently I'm 37 (38 next month) and we still do it because he's still habitually late

      Because they assume that since they're being shielded by a large company with a large wallet, they can essentially try to intimidate anyone and scare them into thinking they'd never win a court case. Which tbf, most times those dumbass companies do win because they do have a ton more resources readily available to them.
      Not many avg Joe's can afford to waste time and money at court and the ones that do usually have an iron-clad case like the one presented in today's post.

      The idea of "Sue me" is for something so frivolous that suing over it would be a waste of time, but people also say it thinking that suing is such a big hassle, both in time and expense, they're doubting you'd bother following through on it, and/or they truly believe they are in the right.

    Yes. The sheriff does have the authority. The only reason he didn't START with that is it's just so much fucking paperwork. It's the last option for that reason, but if someone refuses to pay a judgement, they CAN and DO take your assets and sell them until the judgement is satisfied. They may yoink money out of your account, or they'll just take things of value (like computers) to sell to make it up.
    The Sheriff was basically giving the manager their literal final chance, if they refused to write a check, there would have been a moving van out front before close of business. Luckily, the manager seemed to realise how fucked they were.

      A lawsuit costs pennies to a large corperation like BoA. Their assumption is that the judge will automatically take their side into consideration and that their lawyer would be able to draw out the case until the plaintiff withdraws due to a lack of funds.
      They don't account for their own stupidity.

    Story #1 why does OP just go along with adding extra features for free!? The 2000 dollar price was for the original specs, I thought they would sue the company for an amount equal to the extra labor, but no. It sounds like this $2000 project became a $4000-8000 one.

    #1 story - should never have agreed to ad-hoc changes without negotiating the additional costs for those changes. Change requests cost money.

    Story 1: this is exactly why I at least would never take flat rates. The company can keep requesting that you keep changing things, and they don't have to spend anything to do so. Not to mention this company was lucky -- $2,000 was an incredible deal. I'm pretty sure that most developers, myself included, would've started at $20,000 and that would've been the base price excluding hourly rates. And that's being generous!

    The SF travel story reminded me of the day I was scheduled to start at noon. It had been raining buckets for several days & my usual route was flooded. I took the alternate route, along with every other person in the known universe apparently, so at noon, I was stuck in a traffic jam. As it turned out, the creek had risen an also flooded this road, so I rang my dickhead boss & got "Fuck! Why is everyone telling me they're late because of flooding???". My response - "Because it's flooded? Anyway, I'm going home because I don't own a hovercraft.". He tried to go off at me when I managed to get to work 2 days later. It didn't end well for him because I got head-hunted the day before. 😂

    *Story 1* is also an important lesson in how to defend yourself as an independent contractor. I hope after this story, OP added charges for additional labor and late payment into their customer contracts.
    The first time I ever worked a major project as an illustrator, my client had written the contract and I found myself trapped creating complex illustrations with multiple characters in dynamic scenes for only $25 per illustration (the simpler illustrations we had agreed to were not specified in the contract).
    I was not free until I had completed the last page, after which the client pursued me for multiple years hoping to revise old pages with my improved skills for the same rate, assuming she planned to pay me for those panels at all.

    Story 1: There’s no way I’d allow new feature requirements to be introduced without additional billing for those change requests… It’s one thing to deliver agreed-upon scope and something in that scope isn’t meeting client needs or expectations, it’s an entirely different thing if you’re introducing scope creep as the reason for additional changes… The fact that he only sued for the original $2k is crazy to me.

    With the story of OP telling his now ex-girlfriend that she can keep the deposit and clean the apartment herself. Since OP mention something about the EX not liking to clean, at the very least not the toilet. Thus maked me wonder if part of the reason why he did that, was that he figured she'd either not clean or do such a bad job at it ..... that she wouldn't get the full deposit back, or not as much as she'd think she would.

    First story: There's a British TV reality show about magistrates who go around collecting overdue debts. They have the authority to immediately start hauling stuff away to be auctioned if they don't receive payment in full on the spot, and if the person gives them too much grief or gets threatening they can call in the cops. They don't screw around.

    Can confirm that the APEC summit caused traffic EVERYWHERE in San Francisco. They closed off sections of streets in multiple neighborhoods, rerouted buses, cable cars were non-op for the week, the downtown area was CLEAN for once. It was a mess

    Story 2: I live in the eat bay and can attest that when they were here traffic sucked and I had to use the San Mateo bridge just to get into the city and see my sister. If we didn't have all the chaos then traffic would only be like 1.5 hours for 40 miles. Going home is always worse at like 2 hours.

If the agreed upon amount for product delivery was 2K for 2 weeks of work, one would assume that the additional features(and the time spent working on them) would be charged extra. So, let's assume the OP worked at least 4 weeks(but it sounded more like 8) on aforementioned project, and would still demand the original price despite two to four times the workload, OP is either an idiot and bad at negotiating prices, or OP is an idiot for thinking his made-up story doesn't have some glaring logical/narrative issues(thermonuclear war anyone?)

    1st Story: it sounds like the company was deliberately trying to make OP create something for them for free, which would have been outside the scope of the original contract - so long as they kept NOT accepting the work as “complete,” they could have had OP contracted for one then, but work on another, far more expensive project for them at a bargain bin price

    Story 2. I work for myself with a business partner. We had to take the whole week off work during the SF conference. So we didn’t get paid, but we were not gonna sort through the mess of protestors, secret service stops and blocked off streets. It was crazy.

    WRT Story 1: at one time I had an assistanceship that had me working for a faculty member who did a lot of consulting work. He mentioned that if there were problems with collecting, he'd slap the offenders with a "mechanic's lien". Usually worked out and his side consulting seemed fairly profitable (it helped that the college he was in liked to have its faculty doing this as it "raised their profile").

    For all those stories such a number 1 where the looser in a court case doesn't pay by the deadline, the one supposed to be paid should be able to take the other party back to court for 'contempt of court' since in essence that is exactly what the individual is doing. No idea if it actually works that way though....

Except they did it to people who never did that to them, who were in fact on always on time. Just awful people all around. Fortunately not family, so eventually ended 20+ year friendship due to a variety of BS.

    First story...he should have gotten the $2,000 when the first spec was met. Each Change Request after that should have been an additional fee, because it sounds like additional functionality, and not a bug fix. So the OP should have gotten paid based on the very first agreed-to spec. Then when OP showed up and the customer went "We want X, Y, Z", OP could have said "Ok, that will be $X additional amount." And so on.

    Road closure story
    Reminds me of when i got out of a dentist appointment cuz Pres Bush came and they shut down a section of high way for safety. It was shortly after 9/11 and we didnt own a gps so my dad wouldnt have been able to figure out a different route to get me there on time. He had to call my mom, to have her call the dentist explaining why we couldnt make it.😂

    The first story shows the importance of having a good contract when it comes to software development. If the contract is for a flat fee, I make sure that the contract always specifies that if the client requests cumulative changes that amount to more than 15% of the original agreement, that I can bill for those hours. I always have them sign the graphical design acceptance. That way, I have paperwork that that’s the design they agreed to. I have them sign any change requests as well.
    That way, there is no need to hope the “judge likes my story.” I can simply proof that this was the agreement and they wanted changes that go beyond that. Also, doing this has never caused any legal problems. And I’ve had some very sucky clients over the years.

    I'm a constable, and in my state Sheriffs and Constables are authorized to levy property of people and business to settle unpaid judgements. Most of the time when presented with a levy and sale people will pay up. But there is a lot of psychology involved in how the various options are presented. And in most cases as long as the property is a type covered by the statute a levyable, the Sheriff/Constable has a choice in what is put up for auction. Actually having to have the sale sucks for everybody involved, but it does happen at times.

    The level of scope creep in the first story should have warranted a new contract after the first request at least. In future, they should add a line item to their lump sum at an hourly rate for additional features not originally agreed upon.

    My mom was always late and while I broke myself of this habit, my brother didn't. It got to the point where he was making us wait 20-25 minutes each time we went out with friends. So I started telling him a time 30 minutes earlier than everyone else. When he realized what was going on, he was mad but actually did eventually apologize and change his behavior.

    There was a homeowner that went after the bank who tried to foreclose on the house even though the mortgage was fully paid off. Homeowner’s attorney showed up at the local branch with the sheriff and started confiscating computers and furniture in front of customers. Local branch manager cut a check post haste.

    6:05 they absolutely do have the authority to confiscate anything and everything that is company assets to satisfy a judgement against them. They can freeze bank accounts, have mail forwarded to a court appointed receiver and even cash checks made out to the company until the judgment and all associated fees for enforcement of a judgment are satisfied.

    Story 1: honestly, he should've took the opertunity to ask for more. He did the job to the oroginal spesifications, but they kept asking for more wotk done, without paying for the time and effort. Those either should've been a part of the original request, or a new job.

    Friend of mine works electric, he was laying cables and that stuff, then the one he did the work for asked if he could also "lay some over here" he said that he could, but it would incure aditional fees and such AND a signature, client said yes and did the paperwork, end of project the client refused to pay for the aditional work and it went to court, company friend worked for simply whipped out the "new plan with client signature" and the case was settled right there, client thought he could get them to do extra work and not pay, but friend and company had experienced it before, therefor the "new plan with signature" thing.

    For the fourth story, it actually is legal. If you refuse to pay on a judgment, the sheriff can come and start seizing equipment to sell off to pay off what you owe.

    To settle a court judgement? Yeah, that sheriff absolutely could have done that. Best part is, if he takes too much stuff and the auction overpays, the company would have to file four hours worth of paperwork to get the left over funds returned to them weeks to months later.
    Ever seen one of these take place? The officers (legally) can't know what is worth what, so they have to take every asset on hand for the auction.

    Yes and no so theres a thing called a writ of execution. If you have a judgment against someone who dosnt pay you getol one. They the sheriff may seize property to auction to wipe out the debt. Some things are protected and may not be taken, but if ya if they have one he could def do what he threatened. The the writ may be canceled by paying in full.

    On story 1: Yea, the sheriff usually has the power to do so but my understanding is that it needs to go through the court. The thing is they will intimidate so usually, it isn't just the sheriff there. My guess is that the sheriff came with a team of movers and box truck so that if they did have to repossess the equipment, they were ready to do so. Also, if they did have to repo, I believe the people who had their things repossessed had to pay the fees associated with it.
