Man wrongly accused of rape speaks out one year later

  • FORT COLLINS, Colo. - Police found inconsistencies in the story of a Fort Collins woman who claimed she was raped soon after she reported the crime, according to a police interview obtained by 7NEWS.
    Katherine Bennett, 21, was eventually convicted for lying to Windsor Police when she claimed Dustin Toth kidnapped and raped her. Last year, Toth, now 26, spent the day before Thanksgiving in jail.
    That same day, Bennett was called in for questioning.
    "Right now the statements I've been given don’t match evidence," the investigator told Bennett, adding that Toth could spend 30 years to life in prison for the crimes she accused him of.
    "There are some things that aren’t exactly clear to me and might not be exactly true," Bennett told the investigator. "But did he violently rape me, yes."
    When the investigator continued to bring up problems with Bennett's story she said, "It's fine, I'll drop all charges."
    Toth's police interview from that same day shows him breaking down and crying. He explained to police he was friends with Bennett from work and they had consensual sex.
    Bennett, engaged at the time, went to the hospital and claimed she was assaulted. Her fiancé was also interviewed by police.
    Toth said Wednesday that, one year later, his life still feels out of his control.
    "Bennett changed her story more than once, and that’s the only thing that saved my life," Toth said.
    The Army National Guardsman was fired from his civilian job and couldn't find another for nearly six months. He said he's been behind on his car payment ever since, and is fighting to keep the car from being re-possessed.
    He said emotional pain rivals those financial problems.
    "I feel like I'm incapable to actually trust a woman again," Toth said. "I try to every day; I want to."
    He said he finds healing in sharing his story.
    "The more I put myself out there, the more I feel a little bit better that the truth is being put in perspective," Toth said. "Giving me the opportunity to share -- it gives me an opportunity to clear my name because I still don’t think it's clear."
    7NEWS was unable to reach Bennett for comment. She was sentenced to 35 days in jail, then electronic monitoring and probation. This week, a judge granted her request to serve her probation in Illinois with her family.

      Not to mention he lost his job as well. And possibly all your possessions if you live alone in an apartment. I had a female roommate that lied as well, though it wasn't about rape. Thankfully, the DA notice some inconsistencies in her stories, I showed my lawyer screenshots of her Facebook which counters her lies. Before sentencing, the DA, my lawyer, & the judge all had a 10 minute talk privately. They saw my side of the story, & I never went to jail.

      I don't think he spent a year in jail, the description says he spent the day before thanksgiving in jail one year ago. I think he was probably just held overnight. This was nine years ago so we could probably figure out if he was ever convicted or not but most likely those 35 days in jail were more than he spent. I guess I could be reading it wrong.

    My brother had a friend make false rape allegations against him in college and he lost his entire friend group and was heavily looked down on. Despite him pleading to everyone it wasn’t true, they all believed her. Honestly ruined his last year in college and it really fucked him up.

      I had the same thing happen to me when I was at a Junior College (JC) in 1997 where I was a student and a lifeguard. A female student was drowning in the pool in the area where I was stationed at. I did everything I could on deck to save her before I dived in the pool to get her. She falsely accused me of sexual assult. I too pleaded with everyone I knew it wasn't true because she recanted her testimony. But nonetheless, everyone believed her. When I transfered out of the JC, I was bitter and angry because not once did the adminsitraion applogize for the pain and discomfort they put me through. So I understand what your friend must have endured. I hope he/she is alright and is doing well.

    I had an incident like this happen to me in High School in which I was accused of sexually assaulting a girl in the hallway. I was threatened with video recordings they didn't even have. My dad stormed into the main office and raised hell on the vice principal who interrogated me. He was incredibly shy around me after that and felt the need to say hi to me everyday. His name is *Nik Tama* , from Shawnee High School in New Jersey.

      I love how this guy received death threats from inmates, had to endure physical stress of prison, has a record for going to prison, when he didn´t spend a single second in prison... Impressive. Do your research before assuming you know everything about everyone. What she did was horrible and she deserves much worse, and he must be in a lot of psycological pain, but don´t spread misinformation, it`s a simple search and you would know he never went to prison and his charges were dropped once they realized she was lying.

You can never 100% fix something but that doesn't mean you let it continue because you want to save more victims as if there aren't victims both ways. The justice system needs to be fixed for both sides and maybe more including men's sexual abuse because that needs to be acknowledged and women who were raped while giving them proper treatment/ respect and trial instead of mistreating them. If someone falsely accuses another person of raping them, and it turns out they lied in an attempt to frame them, then yes that person absolutely should be given the same treatment as a rapist would have gotten.
      If you think that's a bad solution, well bud then you've got a problem with the way many crimes are punished.

It gets involve to prevent, to repair, and to rehabilitate. It's not just a bad conception of justice to think that it has something to do with punish, it's either a form of hate speech based on feelings as fear and the need of revenge that it's proven at the end as imposible to be accomplished, because spoiler: 99% of the damage that an individual is able to do over another is imposible to repair, and imposible to punish proportionally. How do you punish, for example, a murderer? You can repair the lost of a life by taking another but even if you kill that person he would have done something to deserve it so it's by no means a proportional punishment for the assassination of someone who was innocent.
      I don't actually know why I even try to give reasons cuz people like you always answer with legit cries trying to justify the law of Talion, but anyways I hope you try to understand what I'm saying at least so you learn that there are better ways to deal with your feelings that trying to kill the people that made you feel that way in the first place. Anyways, as all, it's useless cuz nowadays that philosophy has become even a political ideology for all sorts of extremists so I will stop answering here.       @Kevin Chen If someone lies to the court and the people and ruins another persons life then the accuser who made the false accusation should have their life ruined as well equivalent exchange destroy someone's life, your life is destroyed as well. The accuser should also have to pay for all damages.
      Also put a fire under the courts and police if they fail to get all the evidence and fail to investigate that the accused is innocent fire the people failed to get the evidence and fine the court and police department, the fine would cover restitution to the accused innocent person.
      Also too harsh? He was accused of some thing that could get a man raped in prison, beaten in prison, or even killed, and when he is out he would have the label rapist attached to to him fore the rest of his life which could prevent him from getting a job or housing.

      We all agree 35 days is way too short. But what should it be? How should it be calculated? Should it be same amount of time given the falsely accused? Would assume that courts have a guideline for all false accusations, probably doesn't follow above calculation, i.e. convicted of falsely accusing another of murder is not going to result in a life sentence.

      this happened at my workplace. A female employee that had been caught stealing and just minutes before being dismissed accused the manager of "touching her", in a particular location of the store. Hours and hours and hours of video were checked by several investigators and nothing found so we asked Human resources to sue her and they said "what for? he has been proven innocent so why do you want to sue her?" i couldnt believe it and I told them "you sue her or we will sue the company, it's up for you to decide". End of the story? well, she got away with it and she kept spreading weird rumours after that. Me, being a woman, can't feel any more disgusted about that bitch.

    Worst part is that record even without being convicted is has traces still there. It’s very much possible for it to show up on a background check especially the arrest.

      I saw a case where a man was wrongly accused for rape when he didn't even touched the girl, actually the guy didn't wait for traffic signals and the girl told her she will ruin his life for that. The man was jailed for 12 years of his life, lost his wife his education, his job and reputation and infact later the victim girl didn't even respond court notice and wasn't punished at all

    My stepson was 15 when he was arrested for rape. The prosecutor never interviewed the "victim" until a week before the trial. My stepson spent his 16th birthday locked up because they refused to grant bail. He spent 5 months in jail. After the "victim" was finally interviewed a week before the trial, again, after 5 months, all charges were dropped as it was clear the girl was lying and her story was nothing like her original complaint to the police. She contradicted herself on every question asked and admitted it was consensual but she was mad at him days later. No apology from anyone. Not the judge, not the prosecution, no one. The arrest was made in September and he dropped out of High School after being released because even though she lied everyone looked at him like a rapist. He was threatened and shunned. What happened to the girl? Absolutely nothing. There's some justice for you.

      i disagree. I think the local law enforcement and/or DA office should be sued. Its innocent until proven guilty not the other way around. They didnt have evidence enough to convict PERIOD. We need to have laws put in place that holds the government at the highest standard when it comes to breaking the constitution. When judges, law enforcement, and D.A.'s start doing REAL time is when they will start falling in line.

That is how the law is supposed to work. She did not put him jail. Of course she is to blame, but to say she is the *only* to blame for the law enforcers putting him in jail tells me you do not see the bigger picture. This will continue to happen until the enforcers are held to the highest standards of upholding the constitution. It is unlawful arrest. *Knowledgeable* people sue for unlawful arrest alot and win every time, because if it is obviously unlawful, then its always a very easy case to win. Law enforcers don't care about this money, because its not their paychecks, salary, careers, or livelyhood being affected. Which brings me back to why they need to be punished(jail, unable to ever work in law, restitution, ect).
      The problem within the system would literally fix itself. They would stop breaking the law knowing that they will actually be punished like us normal citizens.
      edit: One more point about her serving time and paying...Well there is not a fair enough law put in place to do that to her. That would require changing the law. But what the officers did by unlawful arrest with no factual evidence is already in affect but not being enforced. They enforced the law on her but they got off clean. Even if he sued that would still not be fair because he has to front the lawyer bills to fight in court, wasting time and utimately just taking american tax payers money.

There normally isnt that much evidence to go off of in rape cases, the women can refuse to allow any swabbing of the vaginal area making DNA testing hard. And if he did do it they'd have to make sure to keep a potential rapist off the streets while they put the case together. Still think he could've just been placed on soft house arrest until enough evidence was collected, but our law men are a tad too lazy to do a little extra paper work it serms
