If a property is given to you, does it also belong to your spouse?

  • Are your parents planning to give you real property? Will the property form part of the conjugal property in case the heir is married?
    It’s normal for our parents to give us their properties. Usually, parents like transferring their properties to their kids when they are already old… and usually, the children are already married.
    So what usually happens is itong lupang ito para kay Kuya, ito kay ate, itong pinakamagandang lupa kay bunso…But what if there is only one property to give away among many heirs and they all have spouses? Owners na rin ba yung spouses?
    This is exactly the question of our reader Vi, HI VI!, and she writes:
    “Attorney, My father intends to assign my sister and me as heirs of land he owns. However, I am already married, will it become a conjugal property? Would there be any legal conflict if my spouse and I decided to put up a structure on the land? Thank you!”

    Pano po if patay na po yung parents at autimatic mapupunta ang property to the next kin, tanong ko lang po matatawag po ba yun na conjugal if married na ang anak?

    Mag-asawa po kami, legal po sa west, pwd po b na bigla nya po ako palayasin sa bahay nila, sana po matulungan nyo po ako.

    I watched your video about property ownership ng dual citizenz. My question is my 2 children are natural born Filipinos but NZ citizen now. Will they inherit our property without legal hassles ?

    Hello po Atty. Recently po kasi namatay po si papa at may mga business po siya na nakapangalan sa kanya as a sole proprietor. Hindi din po siya nakapagsulat ng will dahil hindi din namin po inaasahan na tatamaan po kami ng COVID. At yung Auntie po namin, na kapatid po ni papa ay nagfalsify ng documents para po ma transfer yung name and property sa kanila. Ano po pwede kong gawin?
