    But some people ask, "What exactly is a Contract to sell?" Most people keep signing it without understanding what it's for. Sometines they ask "How is this different from a Deed of Absolute Sale? How do i make one and ensure that it contains everything that i need."

    What if po business ang binenta kaso nag ka problem sa buyer, hindi nya inoperate ang business na binili nya sa seller. Lahat ng arrears si seller padin nagbbyad. But when both parties decide to sell it, nagdedemand si buyer ng returns.

    Question ; if the seller lost the original title and the buyer paid 50% already but cant produce the original title . Can we cancel the contract and return the payment to the buyer . The contract stated that upon pymnt the 50 she will get the products . It take effect since 2007. Is there any expiration of contract to sell?

    yong buyer po ng property namin ay nasa abroad po tapus mag papayment po cya in full payment through bank by using manager's check po. peru yong lola ko po tatanggap eh wla po cyang bank accnt. kaya mag oopen po kmi ng accnt. sa BDO kaya lng po hinahanapan po nila kami ng deed of sale eh sabi ko po wla pa pong nangyayaring bayaran kaya hnd pa po kmi nag deed of sale kaya hinapan nlng po nila kmi ng contract to sell as requirement para makapag open si lola ng accnt. sa BDO. tama po ba yon?

    Atty may bumili po ng property namin may contract to sell po kami 2018 papo ang agreement namin 2024 napo hindi padin nila nabayaran ng buo at di nila nasunod ang nasa contract dahil 12 months lang po usapan namin pahirapan po masingil ano po kaya dapat naming gawin atty. Salamat po.

    Hi Atty, we are acquiring a pre-selling property and we are done with downpayment for 18 months. But the house was not built yet. We were asked to sign the contract to sell but the house was not constructed yet even the drainage of the unit was not prepared yet. Is this possible? do we need to sign the contract to sell as we were asked to? Or we have to wait for the house to be fully constructed first?

    Atty ano po ba ang nakapaloob SA contract to sell at contract for sale .. KC po may kinuha po Kaming housing , almost 6 yrs na wala.pa din po nakatayo. . Sept 2016-May 2018 nagpayment po Kami Ng reservation and down payment . Tapos pinapirma Kami Ng contract Ng Month of May Kasi Sabi Ng staff ni developer bayad na Kami . Pumirma po Kami Ng Month of May Ng contract ... Kailan po ba pinapirma Ng contract to sell at Ng contract for sale ? Kasi po Ng makaharap namin si developer last March 17, ang Sabi Di pa daw Kami nakafull payment .. SA totoo Lang din po Di kumpleto recibo namin dahil minsan iniuutos non ang pagbabayad . Tinqnggap po namin un sinabi nila na Di Kami nakakumpleto pa Ng payment para SA DP..ang nakakapagtaka po bakit Kami pinapirma na Ng contract Kung Di pa Pala kumpleto ang bayad namin. Ngayon po inabot na Ng 6 yrs wala pa nakatayo na bahay simula nuon Sept. 2016.
    Atty Puede ba mabale wala un pinirmahan namin contract dahil SA sinasabi nilang Di pa Pala kumpleto ang bayad namin SA equity/down payment ? ..Puede po Kaya namin mabawi Ng buo ang aming naibayad na SA equity/DownPayment ?

    may question po ako, bibili po sana ako ng lot sa isang subd. nagbayad na rin po ako ng reservation fee at nag bigay na rin po ako ng PDC para po sa monthly amortization, ang problem ko po, malapit na po ang first monthly amortization ko pero wala pa rin pong contract to sell ako na signed, ppwede ko po bang hindi bayaran ang monthly amortization ko habang hindi pa ako binibigyan ng contract to sell?

    Ask ko lang po. If yun cts may conditions for the buyer to shoulder the cgt, dst, transfer, etc, need pa ba ng itago ng seller ang notarized copy nito? Fully paid na ang buyer and binigyan na ni seller ng doas with blank date si buyer pero ang obligations like cgt hindi pa inayos ni buyer next time na daw nya bayaran.

    Hindi po common ito contract to sell. Maraming mga oppotunista na buyer sa walang alam na seller kaya kaso ang dulo ng kasunduan.

    What if I never signed the contract to sell (because the real estate firm never sent it) , but only the reservation document indicating I agree to be bound by the contract to sell terms. Would I still have a fighting chance to win the demand for all payments i have made to be refunded in full despite having paid only 9 months in installment?

    Hi attorney, please give me some advice. Im selling now my house & lot and ang mode of payment is CASH or bank financing. Meron na akong buyer at thru bank financing ang preferred payment nya. The selling price of the property is 4M. We agreed na 1M ang cashout downpayment nya sakin and yung balance na 3M ang iloloan nya sa bank. Ask ko lang po kung need pa ba nmin mag execute ng Contract to Sell? Or deretcho DOAS na? Since mag bank financing po siya, ano po ang pinaka safe na proseso gawin? Mag ask muna ako ng Letter of Guarantee from the bank and bayaran nrin nya ung 1M cash out bago mag execute ng DOAS? Im not sure kung need pa po ng CTS? Thank you attorney.

      Hello po mga sir. May bisa po ba at pwedeng ipag laban ang contract to sell between seller and buyer ng lupa na walang TECHNICAL DESCRIPTION pa nung nagka pirmahan kasi tru pag ibig po. Nakapag down napo ng 15% pero after 5yrs hindi natapos ang proseso, pang 5yrs na lumabas ang technical description. Kung nag bago po ang isip ng seller na gusto nalang nila i refund ang down payment para mai benta sa iba ng mas mahal,...paano po kung ayaw namin magpa refund dahil gusto ko ituloy ang pag bili, ano po pwedeng gawin?     Ask ko lang po sana kung dapat naka indicate sa CTS ng kontrata yung date of turn over po ng unit?
    Anu po magandang gawin kung hindi po ito naka stipulated sa kontrata?
    Nakabayad na po ako ng almost 2 years and 2 months sa developer Bale tapos ko na po yung equity ko at naka continous payment po ako sknla at meron na po akong notice of approval from pag ibig, kaso po ang problema as of now 0% po ung unit ko kaya hindi makaproceeed sa loan take sa pag ibig. Wala po maibigay na turn over date yung developer ko pero naka continous payment po ako. Anu po ang dapat ko gawin sa sitwasyon ko po?

      Kaya ako binasa ko ang cts at ng mabasa ko na walang compliion date at turn over date binawa ko ang binayad ko na rs at dp.importabte na basahin ang cts ng mga developer kasi bago mag go kasi tayong mga buyer ang kawawa sa huli

      Ofw po kasi ako mother ko po na 67 years old yung nagpirma dun sa cts ko but hindi nakaindicate dun yung delivery purchase hindi din magresponse ang Imperial Homes Corporation bilang Developer.
      Ang binibigay lang nila sa akin ay verbal date of turn over which hindi nasusunod up to now 0% pa din yung unit
