We get copyright claims for our classical pieces all the time-which we created *original performances* for. The dispute system is like a game of chicken. We tend to just be bold about it and give them that second dispute when we know we're in the right. Any company falsely claiming copyright over our own master recordings knows they're up for some serious sh*t.
If they reject your appeal and actually submit a takedown request, you can make a counter notification. That's a legal request for CZcams to reinstate your content. In your case, it's a public domain and a takedown request would be invalid. If TuneCore wants to go the legal route with an invalid claim to copyright, they know they're going to lose that. I expect they'd most likely drop it.
It's a pretty intimidating thing to face, but since you're confident you used a public domain Bach recording, you should have every confidence that you are in the right.
Otherwise I guess you could trim out the portion of your video that contains the recording if that makes things easier. But like you, we are sick of companies putting BS claims on our classical recordings. If they want to play chicken, they're only going to win if you let them. You're the right, so don't let them intimidate you.

We get spurious copyright claims all the time too - usually record companies claiming that our own original performances are their recording by some other orchestra, etc. As annoying as it is, fortunately we have disputed almost all successfully, but we still encounter dubious claims from time to time, e.g. parties claiming a Baroque composition is copyrighted. Or something like what's happening here with Eddy and Brett. CZcams's copyright mechanism is flawed (and btw, Facebook's copyright mechanisms are much, much worse).

Really glad Twoset is speaking out about this. My worst experience as a creator was using a my own recording of myself playing a Beethoven duet (from more than 200 years ago so obviously public domain) and having a company claim it as their own recording. I sent a dispute and received a vague answer about why my video could not be monetized. As a small CZcams channel this makes me feel helpless and disrespected

I was just going to say, there's going to have to be legal action in order for CZcams to step it up. Also I find it odd that you can't see what the dispute is, especially when accusing people for copyright.
it was also a paid concert that they hosted and chose to livestream. the company that copyright claimed it has no legal ground to stand on if twoset wants to pursue it in court
In the legal world many things are insane, for example u don't own the rights to ure own fing face if someone clicks a photo of u and makes millions of it u won't get even a penny.

Maybe a collective team of content creators that also got these false claims to fight it in court against these companies. CZcams also needs to stop slacking. They make it so easy to claim copyrights.

I think everyone would agree that you should open a fundraiser to hire a good lawyer and address this properly. Copyright abuse has gone too far. We'll all pitch in as much as we can!

I went over to their channel Tunecore and another youtuber was complaining of a copyright strike from them. In their description, they state that if you received a copyright then contact this email. Just by that message alone, it seems they copyright anything and then deal with it later.
The funny part is that TuneCore's entire thing is that you can share and create your own music. This is just so messed up and honestly really stupid. We will all be here and support you through this!

Hi Brett and Eddy, I’m your harpsichordist at the concert 👋. Thanks for calling out to CZcams to deal with this festering problem. My baroque ensemble too, gets the occasional copyright claims for clips extracted from our own live concerts which we uploaded on CZcams. It’s utterly ridiculous and the whole reporting system is in shambles. With your voice and so many comments on this thread, I hope CZcams will finally get their act together. Stay strong!
It's quite common with classical music.. cause even though the pieces are in public domain, every performance of those pieces aren't. Then, sadly, the algorithm keeps finding matches because, every performance of those pieces are all in the same key, same notes, same instruments, and they "match up". Clearly, the algorithm was meant for pop or current music, and does not work in the classical music world 😪
i can't comment on the malicious reporting cause I'm not too familiar with hpw CZcams work on that.. I think the piano piece they are talking about is the goldberg variations. poor two set..
only solution I can think of is to directly stream future performances from their website...

One thing that I would like to see changed is if you're going to file a copyright strike you need to be held accountable not only that but you must have all of the evidence presented. You can't just fill out a couple sentences and copyright something you need to have all the paperwork all of the receipts there should be a TON of evidence. And take in account when people file multiple claims. As is its a joke.

If someone is literally trying to do something so bad for Twosetviolin, he has got serious issues...these people are the most genuine and concerned people about classical music in the whole of CZcams and you're literally trying to give this treatment to them, instead of appreciating their efforts and giving respect to all the work they are doing for the community....people literally flied from so many countries just to listen to a classical concert, because they are actual true CZcamsrs just like it should be....I'll always support them as a very very big fan...!!....Twosetviolin can learn from their mistakes, and it's okay if they made one...but I literally don't see the "public or personal" good in trying to copystrike their best work...that's so messed up...Good people need not worry, stay strong and be confident always...love you both...and Brett please don't be sad❤..we're always there for you...🥰

I have seen this happen on other favorite CZcams channels of mine, ones with millions of subscribers. That is so much to have at stake when the other side probably has next to nothing at stake. It's completely unfair. I'll do everything in my power to help the creators. You guys are the ones who keep this website running! If these companies take away all of the entertaining content, CZcams will collapse into shambles. No one wants that.

@@adamknirsch7742 one strike every 3 months, ad perpetuam… last few content of theirs all got copyright notices and they simply didn’t bother disputing. So as far as CZcams income is concerned, their revenue is absolutely nada… that’s not kosher. Sure there are concert and merch revenue, but nothing will make the lost (stolen) ad revenue come back. CZcams algorithm works in a way as to give the most views (sometimes more than 50% of the lifetime views of the video) on a piece of content within the first week of initial posting… and even successfully disputed, that momentum is gone. The key problem is that BOTS are doing both the CREATING and NOTIFYING of content identifying/copyright claims (meaning both the malicious claimants and the verification system of CZcams), and the whole process is automated to high hell. No human came into the review system… not even for a creator with 4 million subscribers… that’s the problem.
As one of the camera guys that did your show, I feel so sad about this situation and many more like it, and how it affects you and the industry in general. So much time and effort gets put into such shows from every department on the back end, and from every musician on stage, and an algorithm or malicious human gets to take that away from everyone. Hopefully more can be done to at least have a conversation with a human being on the CZcams team!

Although it's a heavy subject, I highly recommend you two take this to court. This kind of deliberate action against your own works is harmful and should not be tolerated in an age where voices need to be heard. Your videos and content matter to many of us, and you should receive the earnings of your own hard work. Twoset has the support of fans and musicians around the world, and speaking up not just for yourselves, but for other content creators as well to make a change. You two have influence and a powerful voice, and it's worth considering to make the stand. Don't give up.

That's not a sustainable solution though if it happens on every single video now. For several reason. First is: the resources it takes to have a lawyer fight for every single video. And the second is: even if a lawyer manages to get the copyright claim removed - that sort of stuff takes a long time to get resolved, and the most revenue is made in the days after an upload. So...
No, I think the only solution (until CZcams changes its copyright system) is some sort of membership programme / Patreon / Nebula, etc.

They don't even necessarily need to get a lawyer, at least not straight away. I've seen SO many CZcamsrs wipe false claims from their channel by just publicly saying they're GOING to get a lawyer to look into it. None of the bogus claims have a leg to stand on, so they usually back down immediately!

Actually, I am glad that you guys brought to light this really bothering topic since the internet and youtube became a more unbearable place to enjoy and share any proper content. My old channel was actually banned and removed just because I uploaded my recordings from the competition where I was playing in a piano duo (Astor Piazzola, Debussy, etc on repertoire) and solo program (including Serbian composers such as Marko Tajćević, Predrag Milošević, etc). I didn't even get a chance to defend my content and ask for an appeal. It was just removed without any further dispute and I am really angry at youtube ever since. It was 10 years ago. And nothing changed. This platform is failing to satisfy its purpose and it's just about money and the entertainment industry. Instead of checking out for real the content, here just on a whim, anyone can post anything and not get banned. But also anyone can get banned also on a whim for proper content and own content that doesn't harm any rights. Especially concerning classical music. Not that companies claim what isn't in their field of ownership but also youtube doesn't do anything to resolve this Perpetuum mobile. Society also became more toxic and I am free to stay - stupid, or better to say brainwashed by stereotypes and the system which is going too much wrong nowadays.
So here we have: 1) youtube banns and removes content that is proper, legal, and personal work that doesn't infringe any rights, just because not giving a damn to actually check out reported content and confirm if there are wrongs at all. 2) youtube keeps and doesn't do anything about non-censored things which promote hate, abuse, racism, angst, death, etc, because also not giving a damn to check actually what's behind the curtain of an ''innocent personal video''. - Particularly talking, in this case, a) about an application made by some USA psycho who claims himself otaku, called ''Yandere simulator'' which is dreadful for any human being, not just kids. And videos about this awful thing and ''gameplay'' with tips on how to kill classmates, are spread on a daily basis almost without any censorship for gore/rage/violence. And b) about such lunatics such as TVFilthyFrank
who do spread terms such ''weeb'' ''weeaboos'' harassing and humiliating those who appreciate Japanese modern entertainment culture and anime and popularizing the hate/judging/racism basically amongst the youth. Really for the past 2-3 years youtube honestly became a really crappy place. If not for music videos, recipes, and TwoSet, I wouldn't even visit it to waste my time anymore.
There are better platforms to upload videos and share your hard work (normal and positive hard work, not damaging anyone's dignity and life).
Personally, I think classical musicians should unite and form own video platform where could be uploaded all the work (be it performances, educational material, entertainment content etc).
As for now, the only thing we can do I think is to push into responsibility the whole youtube system.
I think Eddy said it perfectly: one person can just go and ruin all your hard work without any repercussions, at this point ytb is halfway to becoming just a platform to facilitate haters
It reminds me of the Persona purge. I was a part of this Google+ community years ago, and we had noticed that soundtracks and concert footage had been mass flagged and seized by a random Russian account.
This shit is nothing new, these issues have been left to fester for years and has been hurting every creative on this forsaken platform.
I have had this exact thing happen to me. A leech claimed my entire album, called Aubade & Nocturne, and it totally broke me. It was like my life, as a creator (composer and producer) was completely taken away from me. In the end it took years, the AFP and legal action to reinstate my authenticity over my work. If this were to happen again, I would go straight to the Australian Small Business and Family Enterprises Ombudsman and ask them to contact the leech company (not CZcams) on my behalf to resolve the situation. Only the leech company can remove the claim on your work in the CZcams system. CZcams can't do anything to help. You have to deal directly with the leech. Also the leech companies have bots and AI that automatically scan audio and if your audio is even slightly similar to the leech's catalogue of music on their label/database, a claim will be made. And automation is added to automatically reject the incorrect claim process through CZcams. Also, use an official distributor that attaches ISRC and UPC metadata codes to your work to upload to CZcams and other platforms (Spotify etc.) because that circumvents the bots - because the audio is in an official register that asserts your ownership in the metadata. If you don't do this, others can steal your audio and copyright strike you.

Receiving copyright claims for classical pieces is unusual but it happens too.

I've had the same problem for many years. Although the dispute process has got better as time went by it's still inadequate when counter-claims get rejected, and, as you say, there's that threat of a strike that makes you hold back and not take that last stage. There's not enough transparency in the dispute process, and it affects classical musicians more than any other online creator. I wish CZcams would make a slightly longer dispute process after a counter-claim was rejected - and take away the threat of a strike.
It is unbelievable how long stuff like this has been going on and YT just turns a blind eye. Leeches is absolutely right. These people just take creators’ hard work out of pure greed. If there’s anything us fans can do to help you, please let us know. I feel so helpless watching this happen to your 4M concert over and over again. The concert was so beautiful and it touched me in ways I can’t even describe. I feel like it must be almost as precious to me as it is to you. All the best you guys! We’re behind you every step of the way!

Its not the first time CZcams has put a blind eye to genuinely great content creators like you. That is very true. CZcams are uncontactable. There is no customer-service or support in place.
Based on how it's being described by everyone, the dispute system seems heavily skewed against content creators because if they get 3 strikes, they lose their channel while the companies filing the claims face no consequences if they're wrong; so the latter are free to just keep filing claims left and right (shotgun effect) until something sticks. To even the playing field a little bit, why not institute a policy where, if the company filing the claim loses a dispute 3 times, THEY then lose the right/ability to file any future claims forever? Content creators get 3 strikes, you're out? Then place the other side in the same boat so they also feel the gravity of the situation. It gives them then a (major) reason to actually do due diligence first and only file claims that they're fairly sure are valid. The companies may complain that it's unfair because an incorrect ruling may mess them up forever, but I feel that that's exactly what content creators are feeling right now with the dispute system.

With games it's more understandable. The music and other sounds are copyrighted. I'd argue it's counterproductive to discourage people from creating content using your game, but it's within their rights. In the situation here, the claims are false (likely knowingly false), and are illegal.
Yes, I understand that, but now I realize I didn't specify. It was mostly the destiny 2 community I was speaking about, not the music, but just general gameplay being copyright claimed by an account impersonating Bungie (the company over the Destiny and Halo series) and unrightfully getting channels strikes leading to bans.

This is your work, your sleepless nights and early mornings and stress and elation, your 280 hours/week of practice, your time there on stage with all your fans silently cheering you on. No one else is entitled to it. Regardless of how you decide to proceed, just know that you've inspired countless (actual millions!) of people with your humor, your hard work, and your love of music, and we'll support you as best we can.
As they mention in the vid, fighting these sometimes results in a worse punishment because the people making the judgements often have zero context and just side with whoever seems the loudest, most convincing (falsified and misleading info allowed). They just slam the ban and move onto the next. And then appealing becomes even more difficult because you’re talking about a channel ban with content dumped into the void.

youtube's run by google that makes their search engine look like it's done by a 6 year old when it used to be clean and professional. I know youtube tries, but we have to realize google's caving to trolls - so their barriers are down and now the trolls are spilling out to the youitubers. It won't be long before they come for us. It's very important the point you're raising and what these companies are doing is fraudulent. I have had it happen with videos I've made and suddenly the video muted with someone making a copyright claim, purely on spec. Yes, using PD music that has happened to me also. These companies are leeches.
Companies who do this should be banned from claiming anything, even if it's their stuff. Only way to get rid of claims like this.

From a strictly "principles and morals" standpoint, no one has the right to stop others from doing something just because it's copying. Fundamentally, there is no moral reason to comply with copyright law, only a legal and financial reason. Imagine a talented bard in medieval times forcing other musicians to give him money any time they wanted to sing his little tunes. Or imagine if the first person to wear shoes declared that no one else could copy him and wear leather on their feet, unless they asked his permission to use the idea. Nonsense. Copying is not wrong. Humans are great at learning from others what works and what doesn't, or what is pleasant and what is dangerous. It slows our collective growth to tell everyone to be original, or demand from others that they give you portions of their own earnings so your success can leech off all those who learn from you.

I can say as someone who's dealt with this from the other side (as a copyright holder), yes, these companies are absolute leeches. We have no choice but to work through companies like TuneCore and HAAWK because CZcams doesn't allow us to directly access the Content ID system. These companies aggressively try to monetize everything as much as possible, and in my experience, seem to be intent on doing everything possible to prevent the actual copyright holder from having any control over which channels get whitelisted and which don't.
I found myself in a ridiculous situation earlier this year, where, the only way I could get HAAWK to stop harassing channels who had legitimately paid to use my music, was to sell the copyright for those tracks to a third party so that my contract with HAAWK would be terminated. They just flat-out refused to remove my music from Content ID, or whitelist certain channels otherwise.
Thank you for posting this. This is extremely insightful and shows that absolute power absolutely corrupts. CZcams is trying to take the easy way out of the copyright situation, and we need to make it hurt for them to keep doing so.

If you guys have a youtube representative, i suggest you guys to talk about this to them or send this video via twitter and tag youtube to spread the word out (us as a twosetter can help to retweet and tag youtube as well). It is gone far to long about this copyright system, and truly a lot of them are leeches (like seriously leeches and try to make profit from other people's work, a lot of bad intentions) for several years now. Like bruh idk how many staffs that work on youtube copyright claim division but dang, this problem doesn't get resolve till this day. hey Brett & Eddy, for what it's worth, this has happened to my channel several times - some other recording artist / label claiming my recordings of public domain music - and on each occasion when my first appeal was rejected, I always called their bluff and did the second-level appeal, at the risk of getting a strike on the channel. so far I've been lucky and all my second-level appeals have been ruled in my favor. but that's a risk I'm willing to take because my channel isn't my livelihood. the stakes are higher for you guys - I definitely get why you're hesitant to push this further. I will happily donate to your legal fund if you decide to lawyer up
