Cake decorating is an art. It takes HOURS for people to decorate a cake. I mean, I can't be the only person to sit down for one How To Cake It video only to look up and realise it has been 5 hours, right? Well, that's not what today's episode is about. It is actually about Miley Cyrus and that time she stole a cake design. No really. It got me wondering if, like art of other forms, you can copyright a cake design. Well Theorists, it's about to get LEGAL!

Such a bizarre part of the claim is that Miley used 'her handwriting' - can you claim copyright to a font that you used, when the font already existed? It's just capital letters printed - how is that part intellectual property?
Literally..it's basic hand writing that even a 7 year old would write with. It's basic print, there's nothing unique about it.
@@testerwulf3357 well little timmy is gonna get sued now!
Yes that's true but you really can't deny how similar it looked. I would have been on the Sweet Feminist's side if it weren't for the fact she asked for compensation only AFTER she sent her message and after Miley's apology. If she did put it in her first message then that would have been okay but now it seems like she just got greedy.
@@waterylemon6880 agreed on this, and she could have settled it privately since she already got her attention. We will never know what actually went through her mind but I would say it was poorly managed from her end also.
Imagine how terrifying it would be if someone could legitimately sue you for having handwriting too similar to theirs...
I don’t really think writing something on a simple looking cake takes that much creativity.
exactly, and the pics he showed of her instagram feed all looked like really simple cakes lmao
And the hand writing itself looks like a grade schooler did it on top of it. It isn't in any unique style say like how the Disney font is. It's not even in bold, italicized, or even in cursive. It's about as basic as basic a handwriting can get to be honest.
That is the art of it. It is intended to evoke feelings of home made children's birthday cake, and disrupts that with a strong political message.
i kinda agree but it looks pretty much exactly the same

Thats a half truth. Although there are no laws against eating human parts itself, there is no way to get the body parts legally, as you would have to murder them before or while you are eating them. Therefore it is illegal to be a cannibal as you would have to commit a crime to eat the human.

9:16 There's a fourth caveat. *_Level of Uniqueness._* A lot of things that people think should/could be copyrighted are not unique enough to be copyrighted, and yeah, the cake in question is not even close. Anyone could emulate this relatively simply.
Honestly, as much as copyright gets abused, anything I create goes public domain. Yeah. 'Nuff said.
There's a rule of thumb I used to hear from writing. How likely is it that in a room full of 100 people, 5 of them would be able to come up with the idea. If I wanted to copyright a book about noble space wizards using laser swords and magic to defeat an evil galaxy spanning empire, in 1920 that would be "the only one in the room" and probably copyrightable. After Starwars became a household name, I have to get a LOT deeper than that sentance to start copyrighting it. The point of copyright is supposed to be to protect ideas from being stolen long enough for them to succeed. The more people doing similar works, the more unique (and less protections) that I have get. Political message on cake, is NOT a very unique idea, it's centuries old.
This is the sort of thing that makes me think "Oh, she just wants to make herself look good/better than others instead of just supporting the cause"
10:47 I’ve always known “uncopyrightable” as the longest word that has no repeated letters in it. That’s the first time I’ve ever seen it actually used in a sentence.
spitting facts
@Eyecanic But that has many repeated letters
It's actually subdermatoglyphic
Antidisestablishmentarianism is the longest undisputed word in the english language (disputed words include medical or scientific terminology)
"In linguistics, a word of a spoken language can be defined as the smallest sequence of phonemes that can be uttered in isolation with objective or practical meaning"
Therefore, qwplmkjhgfdsabzxvcp is a word and it means "The longest word with non-repeatable characters"

What I love most about this drama is that it clearly shows that it's not about spreading the message, it's not about fighting for a good cause, it's not even for "empowerment".
It's all about personal gain, the "feel good" and personal attention.

By contrast, marks & Spencer is currently suing aldi for copying their 'Colin the caterpillar' by claiming that the cake is protected under copyright as Colin is a recognisable character, they're not trying to claim the type of cake as their own, only the similarity of the toppings etc
Came here looking for this comment and it’s honestly a p take cause the Aldi one was so much cheaper 😭
Honestly kind of suprised Aldi hasn't gotten in trouble with this before since they have made some products that look really similar sometimes even having really similar cereal mascots. Though I do get why M and S went after Aldi for this since the character the cake design and the packaging was almost identical.
Here's something that I don't see discussed, Miley was likely not even aware of the Rae cake. She was just acting as the model/spokeperson. Someone else on the team that was responsible for that ad probably was the idea thief.

Within the art world, it gets even more gray because of art appropriation, where the entire point is to use another's work within your own. Most of the time the og artist gets credited, but not always. (note, it is not art stealing, but the incorporation of an existing work into a new one)

My dad had this happen to one of his cakes a few years ago. He made a cake sculpture of a lady with pink hair piled on top of her head that transitioned into a flamingo for a charity event. Two years later another cake artist sumited the exact same design to a competition and won. He rightly put her on blast. He made a FB post with side by side pictures and links to their respective original posts. My dad's friends in the cake art community gave her the stink eye, and when the judges found out, they made her give back the prize money.
Unlike this case, that sounds like it actually would fall under copyright infringement, as your dad made a creative and original work of art.

This whole debacle kinda proves it is not actually about getting the message out there. It is literally about branding.

It's quite frequent in the art community for people to ask for compensation as these things are what they do for a living.
@@yuushanaruto9676 because this isn't art for art's sake. This is just political propaganda, and as the video points out, the design isn't intricate or original enough to qualify as a piece of art (you may want to consider it art, and that is your interpretation, but legally, it's not an artpiece).
Given the political nature of the cake, the message, and the fact you legally don't have any rights upon it (as much rights as you would have putting a BLM pin on your jacket) you would EXPECT the original artist to be happy the message is being shared by an artist with millions of fans all over the world... but apparently money is more important to her than her political ideology- which, when you're talking about how abortion should rightfully be free and available to all individuals, becomes a big fucking yikes.

A word ubiquitous as “yup” shouldn’t be eligible for trademarking.
He has a very specific way of saying it in the show. It's he word he uses to place bids at auctions. I suspect he trademarked the way it's said and the context, not the actual word itself. It's like how you can advertise selling apples, but you can't open up a computer store called "Apple".
Ohio state tried to copyright "the"
I always enjoyed game theory but food theory is you and more up my alley. I don't really console game much anymore but I will never stop enjoying good food and wondering about the science behind it
30 seconds in, writing down my prior knowledge to see how it lines up: yep!! I work in a bakery and you can’t put logos (including college insignias) on cakes or the store and the cake decorator can get in massive trouble if it gets reported.
“Welcome to food theory, where Everything is actually made of cake, except for the arguments, those are rock solid”
So is an old cake
Nah. They’ll spoil and fall apart before they turn rock hard. Maybe cookies or biscuits but not cake
Idk Fruit Cakes are notorious for being hard and dense
@@tyber_roman313 a properly stored fruitcake lasts for a long time - were talking years. If it's a real one and you occasionally baste it with the alcohol. also a real one is far better than the multicolor brick joke from stores.
My mom once made what she dubbed the "Penny Cake" after following her or my dad's great grandma's cake. The birds wouldn't eat it. The woodland critters behind their house where they put it wouldn't eat it. It was like eating a penny.
Old Cotton Candy. It eventually solidifies into LITERAL FUCKING ROCKS. Sugar rocks (and no I'm not talking like rock candy I'm talking like a layered sedimentary fucking rock here)

M
Everything the public has to have to live a normal life SHOULD NEVER BE ABLE TO BE COPYRIGHTED
To the people who think that they actually have a right to the letter M: in short, no they dont. When it comes to things like a colour palette or in this case a letter, it just means within that market (So with ups brown, another postal company cannot use that same shade of brown) it cannot be used - not that the letter m can't be used at all, but that you can't name YOUR candy ' M, ' 'M's [blank]' or such.

Next theory: Does drinking coffee too early stunt your growth? Or have any negative health effects?
Caffeine is the main source of the concern I think, so it’s not just coffee covered by that, but also basically all “energy drinks” and a ton of sodas.
I drank so much soda as a kid and I’m 6’4”...but now that you mention the caffeine link, I did drink a lot of caffeine free sodas come to think of it...interesting.
YES!
I don't think so. I mean I wouldn't want a three year old to drink a pot a day, but at around twelve, I think that drinking a cup or two of coffe wouldn't be the end of the world.

Honestly, I was on Holloway’s side when it came to credit but then she started asking for financial compensation and the whole thing fell apart.
Agreed. It’s totally reasonable to want credit, especially since the two cakes were so similar and carry a strong political statement. I can’t fault Miley too much because we don’t know how involved she was here. Someone on her team likely created the cake for the picture. She may not have been aware that the cake was inspired by thesweetfeminist, but once she found out, she gave credit where it was due.
yes and it was for CHARITY this holloway women is ridiculous
Agreed. The credit was all she needed to do. Asking for money for making a similar cake is stupid. That's if you draw a generic character without credit and then have to pay a fine of $100. Stupid
Agree, it was for a charity she apparently supports so why not be glad credit, flattered by the usage, she wasn't out any cash or at stake for losing sales on the cake.
@@StartingOverSingleAgain plus the fact that it’s not like Miley is trying to sell the cake or the photo of the cake.
Y’all remember when the Fine Bros tried to copyright “reaction videos” and tried to play it off as “benefitting everyone?” Fun times..

Very different beast
@@adamsfusion excuse me 🥺
She just seemed like she wanted attention because I highly doubt miley actually made it she was probably told by her team to make it for the charity
The girl really did want attention and money for free, it was obvious. Who tf tells someone to pay up money for a basic cake design just because you made a basic cake design first??? That's like if I were to draw a circle with a face in it and charge everyone who did after, that just makes you a bad person and it's ridiculous.
i wonder how long it took em to make logo go 3d and and cut in half at the start of the episode
